HomeMy Public PortalAbout2017-05 Authorizing expenditure of Funds for the development of the National Law Enforcement Museum in Washington, DCRESOLUTION NO. 2017-5 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING THE EXPENDITURE OF FUNDS FROM THE UNITED STATES DEPARTMENT OF JUSTICE EQUITABLE SHARING PROGRAM FOR THE DEVELOPMENT OF THE NATIONAL LAW ENFORCEMENT MUSEUM IN WASHINGTON, D.C.; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the construction of the National Law Enforcement Museum (the "Museum") began Saturday, April 16, 2016; and WHEREAS, the Museum, is a 57,000 -square foot Museum which will be located adjacent to the National Law Enforcement Memorial in Washington, D.C.'s Judiciary Square; and WHEREAS, the Museum will tell the story of American law enforcement through high-tech interactive exhibits, comprehensive collection of artifacts, extensive resources for research, and diverse educational programming; and WHEREAS, the Museum's mission is to tell the story of American law enforcement and make it safer for those who serve; and WHEREAS, the Museum would serve not only as a memorial to law enforcement officers, but also as an important law enforcement educational purpose through programs and activities such as a clearinghouse and library for law enforcement research and information, exhibits on drug enforcement activities, law enforcement history and as a recruitment tool for law enforcement; and WHEREAS, such programs and activities that encompass the Museum's mission have been ruled to be supportive of, consistent with, and serve a law enforcement purpose. Thus the United States Department of Justice has concluded that local law enforcement agencies, such as the Village of Key Biscayne (the "Village") Police Department, as part of their support for community -based non-profit organizations, may donate funds from the United States Department of Justice Equitable Sharing Program (the "Federal Asset Sharing Program") to the Museum; and WHEREAS, the monies for the proposed expenditure to the Museum are the result of seized assets from joint investigations between the Village Police Department, federal and other local law enforcement agencies; and WHEREAS, since this expenditure is paid by funds from said seized assets, there is no cost to Village residents; and WHEREAS, pursuant to Village Charter Section 7.05, relating to grants and charitable contributions, in order for the Village to grant these funds to the Museum, all seven (7) Village Councilmembers must approve the contribution; and WHEREAS, the Village Chief of Police has recommended that this expenditure be made using Federal Asset Sharing Program funds. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That each of the recitals stated above are hereby adopted, confirmed and incorporated herein. Section 2. Expenditure Authorized; Specification of Funds. The Village Council hereby authorizes the expenditure of funds not to exceed Five Thousand Dollars ($5,000.00) from the Federal Asset Sharing Program to the Museum. Section 3. Implementation. The Village Manager is hereby authorized to take any action necessary to implement the purposes of this Resolution. 2 Section 4.
