A Regular Council Meeting of December 11, 1989 , was called to order
at 7: 30 P.M. with Mayor Louise Gardner presiding.
Prayer was offered by Reverend Clifford Willis (resident) Pastor;
Sugar Creek Baptist Church (Columbia) .
s ' Following the invocation, City Administrator Dave Johnston led those
present in the pledge of allegiance.
The following Council Members were present:
Present: Feldman, Gordon, Haake, Halsey, Mason, Scheulen, and
Woodman.
Absent: Davis, Owens, and Voile.
A quorum was declared present.
PUBLIC HEARING:
The first public hearing was to consider rezoning of certain lots on
Eastland Drive, Wooded Lane, Timber Road , Chickadee Road, Nuthatch
Drive and Shagbark Road from RA-2 (Multiple Family) to RS-2 (Single
Family Residential) . There was no ono }present to speak ei.thnr tor
or against the rezoning.
The second public hearing was to consider rezoning of .47 acre tract
behind ( 02 Bla.i.r. Drive from RA-2 (Multiple Family) to P1)1) ( Planned
Unit Development) . There was no one present to speak either for or
against the rezoning.
The third public hearing was to consider rezoning ng of 1. 9 acre tract
situated 250 feet north of Missouri. Boulevard, lying immediate east
of and adjacent to the northerly extension of. Blair Drive l'rotn RA-
2 (Multiple Family) to C-2 (General. Commercial ) . There wan no one
present to speak either for or against: the rezoning.
The public hearings concluded at approximately 7 : 35 p.m.
': PRESENTATIONS PROM GALLERY:
The first presentation from the Gallery was a special presentation 1
of a Key to the City presented to Mayor Gardner by the "Mayor of
!; Emerald City" . Mayor Gardner presented three representatives from
+ ACTPAC with a proclamation. ACTPAC is currently performing "The
Wizard of Oz" .

Mayor Gardner presented Mr. Jim Whaley with a Key to the City in
appreciation for all of his work on the Traffic Safety Commission. I

Whaley's involvement in this Commission is in 1971 when it was the,
Parking & Traffic Commission. Mayor Gardner thanked Mr. Whaley for
his dedication to this City and for the many years he has volunteered
his service.

Mr. James Riner addressed the Council concerning the increasing,
number of businesses that are being conducted in homes without
obtaining a conditional use permit. Mr. River stated that the city
zoning ordinance required conditional use permits for this type of
activity in a residential area. Mr. Riner stated that many times,
once the business has grown to such an extent to be a problem in the
neighborhood, it has been in operation for many years and the City
has a difficult time trying to enforce the code at this time. Mr.
River stated he felt the Council needed to carefully consider this
issue and decide how they need to proceed in the interpretation of
the code.
Councilman Scheulen asked Mr. River why he considered it a problem
if someone was using their home only to receive calls and schedule,
appointments. Mr. Riner stated that the business would probably grow.
in size and scope and could produce problems. Councilman Scheulen
questioned how the applying for a conditional use permit would help
solve the problem. Mr. River stated that it would notify the
neighbors that this typo of activity was being conducted in their
neighborhood and would give them a chance to express their views and
concerns at the outset. Mr. finer stated he was not necessarily for
or against conditional use permits for this type of activity, but
felt that this requirement should bo enforced to give the residents
an opportunity to know what is happening in their neighborhood.
Councilman Halsey asked Mr. River if he felt this type of activity
would take away from the neighborhood. Mr. Riner stated he felt it
depended on the type of business being conducted.

Mayor Gardner presented Navy Chief Petty Officer Hersey with a
certificate for Advanced Honorary Sea Cadet. Mayor Gardner presented:
Officer Hersey with a Key to the City in honor of all of his efforts;
on the Submarine Committee.

Mr. Linn Steele, 8th District Commander of the American Legion, and'
i Mr. Ron Schollmeyer of the Roscoe Enloe Post #5, State of Missouri,'!
presented Mayor Gardner with a certification of appreciation for heiil
active participation in their efforts to restore pride in the flag.

At this time, Mayor Gardner requested the Council consider Resolution'
89-23 which had been held over from the November 20 Council meeting.

Rangers for their accomplishments. Councilman Haake moved approval !?
of RS89-23 . Councilman Halsey seconded the motion and it was !i

Mayor Gardner Distributed copies of the Resolution to those present
and congratulated them on their achievements.

Mayor Gardner announced she was withdrawing the nomination of Mr. .
Joel Caldwell to the Cemetery Board at this time. Councilman
Scheulen stated he had been contacted by Mr. Dan Eiken from Check
G Office Equipment stating he felt their bid on 1128 had been rejected j`
ji on a minor technicality. Councilman Scheulen stated that if this had ,
II happened, it was not appropriate. Purchasing Agent Jim Hartley i'
ri stated that Check Office had failed to comply with the bid
d specifications and that rejecting their bid was consistent with what
I, the City has done in the past and with the requirements of the ,l
specifications. After further discussion, City Administrator Dave
Johnston stated he had some concerns with the overall project and
the costs involved. Mr. Johnston recommended the Council reject all '

bids and allow staff to review the project and possibly rebid.
Councilman Scheulen moved to remove Bid 1128 from the Consent Agenda
and to approve the Consent Agenda as amended. Councilman Haake
seconded the motion and it was approved.
Councilman Halsey stated he had received a call from Mr. John
Hequembourg concerning the Mayor's appointment to the Housing
Authority Board. Mr. Hequembourg had told Councilman Halsey that he
was informed there was not sufficient Council support for his
reappointment. Councilman Halsey requested the record show that he
had not been contacted concerning the reappointment of Mr. John
Hequembourg to the Housing Authority Board.

Councilman Feldman moved to approve the bids and proposals over
$25, 000. 00. Councilman Gordon seconded the motion and it was

Mayor Gardner announced that the christening of the U.S.S. Jefferson

Mayor Gardner reminded the City Council that the next meeting was on
January 8 , 1990.

and passed by the following vote as Ordinance No. 11349 .
Aye: Gordon, Haake, Halsey, Mason, acheulon, and Woodman.
Nay: None.
Abstain: Feldman.
REBOLUTYONB:
Councilman Halsey moved to approve RS89-26 regarding support for the
submittal of an application by Youth 2000 Committee to become a
demonstration community. Councilman Mason seconded the motion and
it was approved.

Councilman Haake asked Public Works Director Mike Bates if it was
still City policy not to charge property owners for curb and gutter
work that was done on an arterial street. Mr. Bates answered in the
affirmative. Councilman Haake stated he felt this was an unfair
policy and requested Resolution 89-27 be forward to the Public Works

and Planning Committee for review and recommendation.
UNFINISHED BUSINESS:
City Administrator Dave Johnston reminded the Council that they had
been given the Convention and Visitor's Bureau budget for the coming
year at the last Council meeting and that the Council needed to
approve this budget. Councilman Gordon moved approval of the budget,
Councilman Halsey seconded the motion and it was approved.
NEW BUSINESS:
Councilman Feldman stated that he and Tom Benton from Planning and
Code Enforcement had recently been to University City and had learned
that they were not doing things all that different from the way
Jefferson City was operating, with the exception of a couple of
items. Councilman Feldman stated that the ordinances that had been
distributed in the Council packets were proposed changes in the
current code and moved to schedule a work session of the Council to
review and discuss these proposals. Councilman Iiaake seconded the
motion. Councilman Scheulen stated he felt the Council should not
consider passing any ordinances of this type until they have had
plenty of public input. Councilman Scheulen encouraged the public
to attend the work session to provide input in the planning stages
and that public hearings be conducted to allow the public a chance
to respond to any proposed ordinance changes. As there was no
• further discussion, the motion was approved. A work session will be
scheduled after the first of the year.

Councilman Halsey distributed to the Mayor and Council copies of as
map that had four different designated business districts.
Councilman Halsey stated that the City needs to do more to encourage
development in the downtown area. Councilman Halsey moved to direct
City Administrator Dave Johnston to work with the other. Department
Directors to determine the pros and cons of offering tax abatements
to possible developments in these four areas. Councilman Halsey
stated this report should be presented to the Council at the second
meeting in January. Councilman Mason seconded the motion.
Councilman Halsey stated he felt that tax abatements are sometimes
misunderstood by the public. Councilman Halsey stated that many
times more revenue is brought into the City from a tax abatement than
what is received from the developer.
Councilman Scheulen stated he had no problem with giving a tax
abatement to industry that might create jobs and generate income fog;
the City, but he did not feel that tax abatements should be given to
it
businesses that are in competition with other businesses. After
further discussion, the motion was approved.
