The regular Council meeting was called to order at 7:30 p.m. with ,. Mayor Hartsfield presiding. Prayer was offered by Rev. Larry Emerson, Pastor of the First r:. Church of the Nazarene. <At_; ROLL CALL Councilmen present: Blume, Borgmeyer, Davis, Halsey, Kliegel, Lock, Roark and Scheulen. ICouncilmen absent: Gordon and Hequembourg. A quorum was present. 4 The first item of business were presentations from the gallery. Mr. Ralph Scott, District Manager of Missouri Power & Light Company, IMP&L Presents gave a presentation regarding the installation of underground wiring ' tiara in the downtown area. Mr. Scott distributed copies of MP&L s '' "Downtown Electric Underground System Study -- 1982" to members of 7'`. the Council. The study updates the boundaries of the underground system through the year 2000. Missouri Power & Light plans to do k.rt away with all overhead lines and poles and install underground < wiring in the downtown area. Eastward expansion will begin in ',, 1983. Mr. Scott also stated that one particular area in the downtown :;°`: . area posed a problem as there was no space for underground wiring and that an alternate plan would have to be developed for those buildings in that area. ;; Price Waterhoun The next presentation was made by Mr. Harold Straka who is a Presentation partner in the firm of Price Waterhouse of St. Louts, Missouri. Mr. ; 'r Straka presented criteria to the Council in support of using Price `. Waterhouse to audit the City records. � '. Both firm representatives stated that only in the ease of discovery of fraud or embe••r.•r.ie:nsent would they Council be approached for an additional fee claim. Therefore, the fees quoted on the bid sheets were said to be "fixed" bids. Public Hearing The next item of business was a public hearing on the creation of to Special Bun. Special Business District. . District `„. Mayor Hartsfield asked Lyn Porterfield, City Counselor, to outline the statutory requirements for the establishment of a "special business district", and to also explain the two tax levies involved. Mr. Porterfield explained that the tax levies would be: (1 ) an additional 50¢ per hundred dollar assessed valuation of property within the district and (2) a 50% increase in business license fees above any presently existing license fees. Mr. Porterfield then explained the steps required by state statute to create the business district: (1) A petition signed by one or more business person within the district must be filed with the City; (2) a • resolution must be passed declaring the intention to establish a business district, and (3) announce and hold a public hearing. The specific requirements regarding continuances of hearings, amending boundaries, etc. (located in the 1978 Revised Statutes of Missouri, Sections 71.790 through 71.808) were also explained. Mr. Dick Preston from the Department of Planning and Zoning distributed a memo from James Uffrnann (Director of the Finance Depart- ment) addressed to Thomas Benton (Director of Planning and Zoning) to members of the Council. The memo presented a breakdown of taxes projected to be received if a business district is established. Mr. Preston then explained the boundaries on the map of the proposed district and the procedures used by Planning and Zoning in notifying • • ...a.—. : r . i rt p , -. . He also ,.. =f explained which of the properties within the boundaries would be f n affected. ..,if Mrs. Mary Ann Caplinger spoke on behalf of the ad hoc committee responsible for initiating interest in the special business district. She explained work that had been done in the past eighteen months up to the point of the hearing. Mrs. Caplinger then introduced Mr. Ed Gabler, Executive Director of the Special Business District of Columbia, Missouri. Mr. Gabler explained how the Columbia district was established, how much revenue was being brought in and how the revenue was being used to benefit the district. -.k Mayor Hartsfield asked for proponents of the business district to address their statements. The following citizens made statements in support of the district: Mr. Vogel, Mr. Joe Thomas, Mr. Bill Case _° and Mr. Bo Fraser. Opponents of the special business district were asked to give their opinions next. Those citizens opposing the district were: Mr. Jim .iFj. Galliher, Mr. Brook, Mr. Gundelfinger, Mr. Dale Amick and Mr. John Zaddi. `` rCouncilman Borgmeyer asked for clarification from Mr. Porterfield as to who would be qualified to vote on the district. Mr. Porterfield • ;.i stated that only those qualified voters who reside inside the district i; could vote. It was the general consensus of both the Council and the .i.: citizens that a poll should be taken to see how many affected persons in the district would vote. The hearing was then continued to the December 6, 1982 regular Council meeting. Monument After discussion, it was decided to postpone voting on the contract for the City audit until the December 6 meeting rather than at the . special meeting on November 22. Mayor iartsfield reminded the Council members that a representative of TCI would be present at the special meeting on November 22 to discuss the status of work being done by TCI towards upgrading their system. Mr. Marty Brose, Director of Transportation, explained the method for choosing Booker to do the work and also answered questions by the Councilmen regarding the amount of bids submitted. The next item of business was the bills on the Informal Calendar. 82-83 Bill 8243, introduced by Councilman Scheulen, entitled: Solid Waste AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING 360 ORDINANCE NO 8320 AND SECTION 26-63 OF THE CITY CODE, AND ENACTING ONE NEW CHAPTER REGULATING THE COLLECTION, REMOVAL AND DISPOSAL OF SOLID WASTE, AND PROVIDING A PENALTY. ?~' Bill 82-83 was removed from the Informal Calendar for discussion. Councilman Scheulen requested that Bill 82-83 be withdrawn. Councilman Halsey requestesd that Bill 82-105 be held over on the Informal Calendar. After a motion was made and seconded, the Resolution was pole adopted. The next item of discussion was unfinished business. Mike Bates, Director of the Department of Public Works, stated that Fence/Truman part of the fence at the corner of McCarty and Broadway had been Building removed by the construction company building the Truman Office Building. He stated that more fence would be taken down within a few days to further enhance the visibility for traffic at that intersection. The next item for discussion was new business. The following members of the Jefferson City Fire Department were Firefighters Apresent to speak in behalf of further changes to the Firefighters' Agreement greement : Lonnie Brandt , Allan K reter and Jerry Turner. Mr. Brandt stated that there were two arens of disagreement with the new agreement: ( 1 ) Extra compensation should be given for step-up work work done by a person who is asked to "step up" into a higher position in the absence of another worker and perform those duties on a temporary basis) , and (2) an increase to $l,.50 per day for meal allowances. After discussion, a motion was made and seconded to disallow the additional changes of the original draft . A motion was made and seconded to act on the draft as originally drawn up at the December 6, 1982 Council meeting. The motion was approved. Upon motion and second, the meeting was adjourned to executive Executive ii session to discuss matters of litigation, by the following vote: Session Aye: Blume, Borgmeyer, Davis, Halsey, Kliegel, Lock and Scheulen. Nay: None. Councilman Roark left the Council chambers for this vote.
