REGULAR COUNCIL MEETING, NOVEMBER 7, 1988
A Regular Council Meeting of November 7, 1988, was called to order -;,;,.
at 7:30 P.M. with Mayor Louise Gardner presiding.
-r Prayer was offered by Reverend Spencer Roberts, Second Baptist
Church.
The following Council Members were present:
Present: Feldman, Gordon, Haake, Halsey, Mason, Scheulen, .
Voile, and Woodman.
Absent: Davis and Owens.
A quorum was declared present.
Mayor Gardner introduced Mr. Lynn Barnickol and Mr. Mike Stelzieni,
leaders of Boy Scout Troop 2 from the Presbyterian Church.
PUBLIC SEARING:
a) Rezoning of property in Section 9, from RU, Rural to M-1,
Light Industrial. There was no one present to speak either for or
against this issue.
b) Rezoning of property at 600 Ellis Blvd. , from RS-2, Single
Family Residential to C-O Office Commercial. Councilman Scheulen
informed the Council of his intention to request a suspension of
the rules later in the meeting for this bill and suggested if any
of the Council had any questions, the parties desiring this
rezoning could answer them at this time. There was no one present
who wished to speak either for or against this issue.
c) Rezoning 17 acres north of Williamsburg Way from PUD, Planned
Unit Development to RS-1, Single Family Residential. There was no
one present to speak either for or against this issue.
The Public Hearings concluded at approximately 7: 35 p.m.

Councilman Haake moved approval of the Consent Agenda. Councilman
Gordon seconded the motion and it was approved.

ANNOUNCEMENTS BY MAYOR:
Mayor Gardner announced her intention to make the following
appointments to Boards and Commissions after approval from Council:
Library Board - Elizabeth A. Wilson to replace John McGhee who
resigned. Term to expire June, 1990.
Cable Quality Commission - Dr. Dan Bradbury to replace Kevin Kelly
who resigned. Term to expire June, 1990.
Mayor Gardner also announced the need for a Council work session
on Frog Hollow. The Mayor suggested November 15 for this session.
Councilman Haake requested they wait until later in the meeting tol
make a final decision.

Councilman Feldman expressed his appreciation to the Cable Qualit
Commission and to Dan Diedriech for their efforts in puttin•
together this contract. Councilman Feldman stated there had bee

Feldman state he felt it was an excellent contract and urged th.

Councilman Haake stated he did not object to the contract wit
Lincoln University, but felt that a work session should b:
` scheduled for the Council to review this contract and the

expenditure for equipment.
Councilman Feldman stated that he respected Councilman Haake' :
opinion and under most conditions would agree, but that this has
been extensively studied by the experts in the field and they all
agree that the equipment is the most flexible equipment available.
Councilman Feldman stated that he felt any further delays cowl•
have serious consequences to the contract.
Councilman Halsey stated that Lincoln University had been asked to
a submit a proposal based on specific timetables and that any delay
Iin the passage of this bill could change the schedule. Councilman
Halsey stated he believed it was important to keep Lincoln
University on schedule and to proceed with the contract.
Councilman Haake reiterated his statement that he has no objection
to Lincoln University and no objection to the proposal, but felt
thn Council needed to evaluate the equipment that is to be
purchased and the options opened to the Council if the Public ..
Access channel does not work as anticipated.
Councilman Scheulen stated he was in favor of the proposal, but
agreed that a work session was in order.
After further discussion, Mayor Gardner stated that she agreed that
the Mayor and Council should take a closer look at this proposal ■
and that a work session would have been in order. Mayor Gardner
then called for the vote and Bill 88-102 was read third time by

RESOLUTIONS:
Councilman Haake moved approval of RS88-17 regarding the assumption
of federal interest in two 1984 GMC buses. Councilman Mason
seconded the motion and it was approved.
Councilman Scheulen moved approval of RS88-18 regarding the intent
to adopt the BOCA National Electric Code/1987. Councilman Veile
seconded and it was approved.
City Administrator Dave Johnston requested the Council delay action
on RS88-19 until after the Executive Session.
UNPINIBHED MINIM:
City Administrator Dave Johnston reviewed the recommendations
contained in his report on the Animal Shelter distributed in the
Council packets. The recommendations included:
a. Hours of operation will be 10:00 a.m. - 4:30 p.m. , Monday
4 through Friday, and from 10:00 a.m. - 12:00 noon on Saturday.

b. Supervision of the Animal Rescue Officer will be rep
assigned to Jackie Johnson and the officers will be working out of
the Animal Shelter itself.
c. One officer will be assigned the Shelter operation•,
during the week on a permanent basis and the other two will coves
the patrol and outside operations.
d. Animal Shelter calls will once again be received at th
Shelter, not at City Hall.
e. The original euthanasia policy suggested by Dr. Sherri
Russel be implemented.
f. Continue investigating the possibility of contracting th ,
Animal Shelter operation to either Heart of Missouri Humane Societi
or to Cole County.
Councilman Mason thanked Mr. Johnston for his report, but state.;
he did not feel it went far enough. Councilman Mason questions«
the reason for not opening until 10:00 a.m. and was informed this
allowed them time to get the cages cleaned and the animals read
for the public. Councilman Mason suggested that possibly an Anima
Control Officer should accompany the veterinarian and allow th
Supervisor to be free to run the operations of the Shelter '
Councilman Mason stated he had some suggestions he would like Mr !
Johnston to investigate and report back to him and the other
members of the Council if they so desired. Councilman Maso1
suggested the Animal Shelter be transferred to the supervision o ,
the Police Department. Councilman Mason stated he did not fee
this would result in any conflict as this would not make the :
Police Officer, but the calls could be dispatched throug
communications. Councilman Mason further asked that th
possibility of some type of rank structure be implemented so ther '
was some distinct designation between supervisor and subordinate !
Councilman Mason asked about the possibility of having the vet com ;
in the morning when the Shelter wan closed as opposed to coming it
the afternoon when it appeared to disrupt the operation.
Councilman Feldman stated he agreed with Councilman Mason' ,
statements and wondered if even these changes would be a fina
solution of if further action would be needed.
Councilman Halsey stated he did not agree with Mr. Johnston'
report. Councilman Halsey stated he had hoped to receive a report
that would have options A, B and C for the Council to choose
Councilman Halsey stated he was disappointed in the report!
Councilman Halsey stated he felt there were serious problems tha '
were not going to be resolved in the present form. Councilmai
Halsey reiterated he felt there was a need for plan Al B and C �
because what is happening at the present time is not working !
Councilman Halsey stated this report offers nothing at all in term;
of a solution to a problem that has been going on for severa
years. Councilman Halsey reiterated his disappointment in th
report.
Councilman Voile informed the Council he stood in support of Mr
Johnston and his report. Councilman Veile stated he felt the
Council had made it perfectly clear that they were unhappy with th
problems at the Shelter. Councilman Veile stated the Council hire»
these individuals to do a job and they were expected to do thai
job. Councilman Voile stated that if the problems continue t»
exist, possible personnel changes would be considered.
Councilman Veile moved the Council support the report submitted b
the City Administrator. Councilman Scheulen seconded the motion
Councilman Mason stated he agreed with most of the comment
Councilman Veile had made, but stated he would like to see th

specific recommendations he had made investigated before the
Council accepted the report.
Councilman Feldman stated he agreed with the comments made byl
Councilman Voile but stated that the motion did not include an
dates for the resolution of these problems before personnel change
would be made. Councilman Feldman stated he felt there needed t•
be a clear statement made that the Council meant business and di.
not intend to hear about this problem any more.
Councilman Scheulen stated he felt this issue had become a
political issue that had been highly publicized. Councilma
Scheulen stated he felt it was a personnel problem and it was th.
City Administrator's job to handle personnel. Councilman Scheule
said he had not received any complaints from the public regardin.

Councilman Halsey asked Mr. Johnston what evaluating tool was goin•
to be used to determine the progress at the Animal Shelter. Mr.
Johnston stated he would be meeting weekly with the employees o
the Shelter. Mr. Johnston stated he did not see this report at th
final report and would be happy to respond to Councilman Mason'
suggestions.

chastised. Councilman Woodman stated he had had no complaints fro
the public regarding the Animal Shelter.
As there were no further comments, Mayor Gardner requested a rol
call vote on the motion. The vote was as follows:
Aye: Haake, Scheulen, Voile and Woodman.
Nay: Feldman, Gordon, Halsey, and Mason.
Mayor Gardner voted to accept the report, breaking the tie vote.

City Counselor Allen Garner reviewed for the Council what ha
y transpired with the Public Service Commission in the Capital Cit
Water Company rate case and asked the Council if they wished to b !
a participant in that case. councilman Haake moved to direct staf .1
to intervene in rate case. Councilman Woodman seconded the motion(
and it was approved.
After some discussion on the scheduling of a work session to study~
the Frog Hollow annexation, it was suggested that the Council wait
until after the holidays to schedule the work session. This delay
would enable staff to obtain the maps and other information thgi
Council needs to fully study the issue. 1
As there was no further business to come before the Council,
Councilman Haake moved the Council go into Executive Session to
discuss real estate as provided for in RSMO 610.025 (2) . Councilman
Gordon seconded the motion and it was approved by the following
roll call vote:
Aye: Feldman, Gordon, Haake, Halsey, Mason, Scheulen, Veils
and Woodman.
Nay: None.
At approximately 9:50 p.m. the Council reconvened in open session.
Mayor Gardner announced a dinner honoring Marilyn Hamacher as
Employee of the Year was being held on Thursday, November 10 at the
Capital Plaza Hotel. The Council were invited to attend.

Counci1man Haake moved approval of RB88-19 authorizing application
for an infrastructure loan/grant. Councilman Mason seconded the
motion and it was approved.
There being no further business, Councilman Halsey moved to
adjourn. Councilman Gordon seconded the motion and it was
approvad.
