Prayer was offered by Reverend Oliver Haywood, Pastor; Dunavan Chapel A.M.E. Zion Church. The following Council Members were present: •r is Present: Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen,,i Voile, and Woodman. !; is Absent: Davis. A quorum was declared present. {. Mayor Gardner introduced Steve Stacey, Leader, of Path Finders, al co-educational scouting group that was present in the meeting. PREBENTATIONB FROM GALLERY: if Mr. Bob Wedow, 126 E. Circle, addressed the Council in opposition to Bill 89--113 . Mr. Wedow stated that he was a non-smoker, but felt;L this bill wan not a "clean air act", but an anti-smoking act. Mr. Wedow stated ho felt that private businesses should be allowed to run their business the way they choose. Ms. Mary Ann Ronan, 1927 Greenberry Road, spoke to the Council in favor of Bill 89-113. Ms. Ronan stated that the bill is not dictatorial, but regulatory. Ms. Ronan stated that the Council not only has the right, but the obligation to regulate the health and welfare of the citizens. Ms. Ronan stated that the majority of citizens do not smoke and that clean air acts have work very well in Kansas City and Columbia and other places. Mr. Mark Bruenger, 4405 Village, spoke to the Council in favor ogl Bill 89-113 . Mr. Bruenger read a prepared statement urging the l Council to approve this bill. 1 Mr. Jim Booth, Missouri Restaurant Association, spoke to the Council concerning certain provisions of the bill. Mr. Booth stated the Association was not opposed to the bill, but was opposed to the designation of percentages in the bill. Mr. Booth stated that the proprietors should be allowed to set their own percentages and make provisions for their clientele. Councilman Feldman asked Mr. Booth if the Association would suppor• an amendment that allowed the restaurants to set their own percentage of smoking/non-smoking areas. Mr. Booth answered in the affirmative. Ms. Vonnieta Trickey, 1315 Kolb, spoke to the Council in favor of 161 REGULAR COUNCIL MEETING, NOVEMBER 6, 1989 Bill 89-113 . Ms. Trickey stated she was a smoker who had quit smoking for a period of time. Ms. Trickey stated that during the time she was not smoking, many smokers would light up a cigarette without asking if she minded if they smoked. Ms. Trickey stated she felt it was only courteous for smokers to ask, but not all smokers did this. Ms. Trickey stated that if there were specified areas for smokers and non-smokers, she and her friends could smoke and not offend anyone. Dr. Brian Conley, 1434 Edgevale Road, is a local Pediatrician and spoke to the Council in favor of Bill 89-113 . Dr. Conley stated that in many ways passive smoke is just as harmful as mainstream smoke. Dr. Conley stated that in his profession, he sees the effects of smoking constantly, with low birth weight infants, and children with upper respiratory and lower respiratory infections. Dr. Conley also stated that cigarettes and alcohol are considered a "gateway" drug to other drugs. Dr. Bob Harmon, 1414 Springdale, (Director, Department of Health) spoke to the Council in favor of Bill 89-113. Dr. Harmon stated that it is the responsibility of government to protect the health of non- smokers. Dr. Harmon stated that over four hundred American cities have clean air ordinances and that it is working well in these cities. Dr. Harmon stated this bill does not prohibit smoking, but restricts it. Councilman Feldman asked Dr. Harmon how firm the literature is on "sick building syndrome" . Dr. Harmon stated the literature was very firm and well established. Dr. Jack Saunders, 730 Hobbs Road, spoke to the Council concerning Bill 89-113 . Dr. Saunders stated that smoking is the leading preventable cause of heart disease. Dr. Saunders stated that government in responsible for the promotion of public health and urged the Council to support this bill. Ed Moses, 2002 Meadow Lane, spoke to the Council in favor of Bill 89-113 . Mr. Moses stated that he is an educator in Drug Education, and if we are serious about the war on drugs, we need to take on the single biggest drug, tobacco. Mr. Moses quoted several reports from the tobacco industry which show that they have been aware of the increase risk of cancer for many years. Mr. Moses stated that the single biggest killer is tobacco smoke and urged the Council to approve this bill. INFORMAL CALENDAR: Mayor Gardner announced she would like to consider the Informal Calendar at this time. Councilman Feldman stated that this bill was brought up as -,4 ' t • - d statement that this was a starting place. Councilman Feldman stated that community involvement was needed, and community involvement has been given, both pro and con. Councilman Feldman stated that many' :- people voiced their opinion this bill needed changes, and that isl exactly what the system is supposed to produce. Councilman Feldman ' ' I stated he would like to hear from the other Council members and see .. if any amendments were proposed. 1 , id Councilman Voile stated he was in favor of this bill and felt it was 1 important for Jefferson City and would benefit many citizens. , . N Councilman Voile stated it was not the purpose of this bill to stop smoking, but to merely designate the areas where it is prohibited. 4, 4 Councilman Voile stated that most of the individuals who spoke in z opposition to this bill have a direct economic interest in thirst , issue. Councilman Veil () stated he felt the bill required some 1 amendments and distributed the following proposed amendments to Bill I 89-113 : il Section 14-41 EXEMPTIONS A ' Paragraph A - Areas which are specifically designated as smoking 1 • i permitted areas as designated by the proprietor or N I: person in charge. 1 4 Paragraph B - Restaurants that seat fifty (50) or less people. • 1 Paragraph E - Places whore no more than fifty percent (50%) of thel , dollar volume of the business is the sale of alcoholic beverages (bars, taverns, and lounges) . Paragraph G - Bowling alleys, pool halls, barber shops and hair • salons. Paragraph H - Private offices with two or less employees. Councilman Feldman seconded the motion. Councilman ,v, ,. .. Mason stated that he had opposed the original bill, but that he felt the proposed amendments were a good compromise and he would support pc the amendments and the bill. Councilman Halsey stated that public buildings were not covered in ''`{ the proposed amendments. Councilman Halsey asked the Mayor what she k,, would support as far as City Hall was concerned. Mayor Gardner stated that her support or non-support would depend upon the amendments made and the vote of the Council Councilman Halsey asked if the Council passed an ordinance that included the proposed amendments if she would veto the bill or allow its passage. Mayor Gardner stated the Mayor makes the decision after the Council votes. Councilman Halsey requested a five minute recess and Councilman ,j Owens seconded his request. The Council meeting recessed at approximately 0: 30 p.m. # # # ` The Council meeting reconvened at approximately 0: 40 p.m. Councilman Mason requested a clarification on paragraph (n) of the proposed amendment which rotadt "Placon where no more than fifty. ” , . " , Councilman Mason asked ir that should read, "Places Where more than fifty. . . " Councilman Voile stated that it should read "Places where more than fifty. . . " Councilman Halsey moved to amend the amendment to further read that public buildings would be left to the discretion of the Mayor and Council. Councilman Gordon seconded the amendment. Mayor Gardner requested a roll call vote on the amendment to the amendment. The amendment was approved by the following vote: Aye: Feldman, Gordon, Haako, Halsey, Mason, Owens, Voile and Woodman. Nay: None. Abstain: Scheulen. Councilman Owens asked for a clarification of one of the amendments distributed by Councilman Voile. Councilman Owens asked if the Iperson in charge could designate smoking or non-smoking areas anywhere in the establishment. Councilman Voile state that they could designate as large a smoking area or non-smoking area as they choose. Councilman Owens asked if the owner could designate 100% as smoking. Councilman Veile stated no, the owner had to provide some area for non-smokers. Councilman Owens questioned how this would be enforced. I 1 ',I Councilman Haake moved to further amend Bill 89-113 to prohibit the ' 1 sale of tobacco products on any premise controlled by this = ordinance. Councilman Owens seconded the motion. Councilman Haake ..' ; i= I stated ho thought the Council should take a look at the monies , .1-:- received from the cigarette tax before they took a final vote on , ' I this bill. Councilman Owens reviewed for the Council the amount of =' r ' monies brought into the City from the cigarette tax, the sales tax . . and the transportation sales tax. Councilman Owens stated this ' -- 0;1 would be quite a large bite out of. the City budget. , e II, Councilman Feldman stated that this bill, was not a ban on smokinq, III but that it would allow non-smokers the right not to breath second- 1 hand smoke. Councilman Feldman stated that everybody would be , allowed to smoke who want to smoke, and that every proprietor will " I have the right to designate as large a smoking area as they choose. !, I : I Councilman Voile called for the question and it was seconded by 1, Councilman Mason. The call was approved and the amendment offered H by Councilman Haake was defeated by the following vote: * ili Aye: Haake, Owens. Nay: Feldman, Gordon, Halsey, Mason, Voile and Woodman. , I Abstain: Scheulen. 1 Councilman Voile stated he felt the bill was very reasonable and I urged approval of the bill. Councilman Haake stated that education ) would do a lot more than legislation and he was opposed to this bill , I for this reason. , I 1 Councilman Feldman stated that the governmental process had worked I very well. The initial bill was not acceptable to the majority of the people of Jefferson City and the majority of the Council . Mayor Gardner announced that she has had a problem getting -, ," individuals to serve as they do not wish to be scrutinized as othere -- have in the past. Councilman Halsey stated that Mr. g t*N Vo Vogel was rt serving on a board and when he called Mr. Vogel he was �^�x g g was told he was y 1 going off of that Board on Friday and going on the Housing Authority te , -"' Board. Councilman Halsey stated that he felt that Mr. Mitchell 's expertise was in the area of law enforcement and that he would !u . better serve on this board. Councilman Halsey also stated that the ,,,.-:1 requirement that you be a resident of the City for five years; x Councilman Halsey stated Mr. Mitchell passed this requirement by 4 `- }'` three months and five days. Councilman Halsey stated his opposition =t his to Mr. Mitchell on the Housing Authority due to his lack of Ft4r. longevity and community involvement. REGULAR COUNCIL MEETING, NOVEMBER 6, 1989 Veile stated he and his family had visited the Park this past weekend and it was a very good example of how the sales tax money is being spent. Councilman Voile informed the Council that there had been quite a bit of discussion at the last Parks & Recreation Commission concerning resident/non-resident fees. Colincilman Veile stated that the Commission had discussed a number of options, including B> discounts for city residents as opposed to increased fees for non- residents, ; f. but felt this issue needed more study. Councilman Voile :. moved that Mayor Gardner appoint a city-wide committee to look into the matter, to study its feasibility, and to make a recommendation to the Council. Councilman Gordon seconded the motion and it was approved. City Administrator Dave Johnston informed the Council that the annual LAGERS Conference was scheduled for the 16th and 17th of November at the Lodge of the Four Seasons. Mr. Johnston stated that he would be attending that Thursday session, but was unable to stay for Friday. Mr. Johnston asked if anyone on the Council was interested in being the Employer representative to this meeting. There were no Council persons able to attend the meeting at thin time. Councilman Feldman addressed the issue of the telephone request for support for federal legislation for phone companies to enter into cable television. Councilman Feldman stated that the only industry that can compete with the monies spent by the cable companies is the phone companion. Councilman Feldman moved the Council support House Bill 2437 and Senate Bill 1060 . Councilman Halsey seconded the motion and it was approved. Councilman Feldman stated he had been privileged to be at Fort Leonardwood with the Lincoln University Ranger team when they took first place in the competition. Councilman Feldman stated he wanted to honor the Ranger Team at the next Council meeting with a resolution and requested a Key to the City be presented to the team. Councilman Mason stated he wished to support this resolution. Councilman Gordon stated he had attended the ceremonies for the opening of the new track at Lincoln University and had been presented with a certificate thanking the City for their participation in the project. Councilman Gordon requested this certificate be displayed in City Hall. Mayor Gardner requested Council direction concerning the Council meetings in December and January. The first Council meeting in January is presently scheduled for Monday, January 1. After some discussion Councilman Haake moved to reschedule the Council meetings for December to one meeting to be held Monday, December 11. Councilman Halsey seconded the motion and it was approved. Councilman Veile moved to reschedule the Council meetings in January to Monday, January 8 and Monday, January 22.
