REGULAR COUNCIL MEETING, NOVEMBER 3, 1986
A Regular Council Meeting was called to order at 7: 30 P.M. wit
Mayor George Hartsfield presiding. Roll Call
Prayer was offered by Councilman Halsey.
The following Council Members were present:
Present: Barnicle, Borgmeyer, Davis, Gordon, Haake, Halsey
Nelson, Scheulen, Veile and Woodman.
Absent: None.
A quorum was declared present.
Presentations from the Gallery: Mr. Wayne Weider, Mr. John Wegma.Presentetions
and Ms. Barbara Swanson had requested to address the Council From Gallery
regarding Bill 86-133 which prohibited parking on a portion o :
Clark Avenue. Before the Council Meeting, these individuals ha.,
met with Councilman Tony Barnicle and had come to an agreemen �parking on
concerning the parking and Councilman Barnicle would bi clark Avenue
representing these individuals at this time.
Councilman Barnicle stated that the reason the parking was bein.
changed was for the safety of the children, yet the propose,
ordinance was making it inconvenient for the residents in tha
area, also. Councilman Barnicle proposed to amend the bill t'
prohibit parking during certain times as had been done previousl !
at Belair School.
Councilman Haake stated that he had not problem with amending th ,
bill. The Traffic Safety Commission had not been aware that them;
was any conflict with prohibiting parking in this area, but woul.
be willing to amend the bill. It was decided to place Bill 86-13
on the Informal Calendar when it came up for vote later on th!
Agenda.
Mr. Mr. Riley spoke for Midwest Block in place of Mr. R.L. Veit ,
Mr. Riley stated that Midwest Block had requested permits to buillMi(NCt+t mock
a cement silo to house the cement used in making the blocks. Thi '
silo would help alleviate some of the dust problem. Midwest Bloc
had also requested a permit to construct a kiln, which would hel«
alleviate having to run the evening and weekend shifts. Mr. Rile'
stated that there had been no response from the City on these
permits, and stated he could see no reason for the City to den
these permits as they were well within the rules and regulation;
set forth by the City. He stated that Midwest Block would like ti
see these permits granted and the City out of the lawsuit.
Mr. Thomas Vetter spoke representing the residents for the Midwes!
Block area. Mr. Vetter stated that the City has ordinance'
regarding noise, dust, smoke, etc. , and asked that the City uphol!
those ordinances in dealing with Midwest Block and not allow the'
to expand. I
Mayor Hartsfield asked Mr. Allen Garner, City Counselor what th
status of the lawsuit with Midwest Block was. Mr. Garner state!
that the lawsuit was still in the discovery phase. The City ha;
sought other avenues of settlement other than litigation, but ha
been unsuccessful in reaching a satisfactory agreement.
Consent Agenda: Councilman Nelson moved approval of the Consent Consent Agenda
Agenda which included the Council Minutes of 10/20/86; Renewal of
the contract with River City Florist & Greenhouse; Renewal of
lease agreement with Thompson Brothers for property at airport;
Renewal of contract with Green Electric, Inc. , on same terms with
5% increase in fees; and renewal of maintenance contract with
Longview Cemetery with $250 increase in fees; and the approval of
the following bids:

Councilman Haake seconded the motion and it was approved.
Mayor Hartsfield stated the following minutes and been received
and were on file in the City Clerk's office: Parks & Recreation
Commission 9/30/86; Planning & Zoning Commission 10/9/86; Board
of Adjustment 10/14/86; Animal Rescue Advisory Commission
10/22/86; Senior Citizens Advisory Commission 10/28/86.
Mayor Hartsfield stated that he had been requested by the
Council to see if the State of Missouri could assist in
operating the airport tower. The Mayor stated he had spoken
with John Pelzer, Commissioner of Administration, from the
' civilian side of airport operations and with a Col. Beam who is
responsible for the army flight operations of the National
Guard. Neither one felt they could take any active part as
their present budgets did not have funds. The Mayor stated that
the Guard did show some interest and that he felt we should stay
with the idea for future years.

Resolutions:
RS86-27 regarding the installation of hydrants by Capital City
Water Company at various locations. Councilman Haake moved
approval of this resolution, Councilman Halsey seconded and it
was approved.
RS86-28 regarding the installation of street lights on Hutton
Lane. Councilman Halsey moved approval of this resolution,
Councilman Scheulen seconded and it was approved.
Unfinished Business:
Mayor Hartsfield stated that RS86-26 regarding the Incentive Pay
Plan for Department Heads had been placed on hold at the last
Council Meeting to give the Councilmen time to discuss their
questions with Mr. Johnston. Councilman Borgmeyer moved
approval of this resolution, Councilman Halsey seconded and it
was approved with one dissenting vote cast by Councilman Voile.
Councilman Gordon moved approval of the Executive Session
Minutes, Councilman Halsey seconded and it was approved.
Mayor Hartsfield requested that Allen Garner, City Counselor,
and/or Mr. Tom Banton, Director of Planning & Code Enforcement,
apprise the Council of the status of the request for permits
from Midwest Block. Mr. Garner stated that he had been informed
that Midwest Block was going to ask for those permits, but had
not yet aeen any formal requests. Mr. Benton stated that ho had
informed that Midwest Block wanted to construct these buildings,
but as yet had not seen any plans submitted by Midwest Block.
Before the Council Meeting, Mr. Lewis E. Morris of 111 E.
Atchison had distributed a letter outlining several concerns he
had about some work being done in his area. Mayor Hartsfield
requested Mike Bates, Director of Public Works, and the two
Councilmen from Mr. Morris' Ward meet with him after the Council
Meeting.
There being no further business, Councilman Gordon moved the
meeting be adjourned. Councilman Halsey seconded and it was
approved.
