REGULAR COUNCIL MEETING, October 17, 1983
, �:. A Regular Council Meeting was called to order at 7:30 P.M. with Mayor

Kliegel, Roark and Viessman.
Absent: Lock.
A quorum was declared present.

Presentation A presentation was made by Councilman Halsey to Mayor Hartsfield on
to Mayor behalf of the Nigerian Students in appreciation of Mr. Hartsfield's
participation in their Nigerian Independence Day celebration at Lincoln '{
University.
Speeding Mr. J . D. Caver was present to speak from the gallery regarding
Traffic on speeding traffic in the 700, 800 and 900 blocks of Jackson Street. Mr.
Jackson St. Caver related an incident in which a child was struck by a speeding
car in 1978 and various times when pets have been fatally injured. Mike
Bates stated that the traffic committee has studied this problem in the
•. past, and plan to have consultants from Kansas City in the City on
October 21 to further study the problem to determine what can be done •:
to alleviate it. Councilman Gordon moved, the motion was seconded by
,. Councilman Roark, that a letter be sent to the Municipal Judge to make
him aware that the Council is concerned about this problem and ask him
to levy fines accordingly. The motion was approved by a voice vote.

Side Mr. Charles Jackson of the Planning & Zoning Commission was present to
Yard speak regarding the introduction of 8111 83-127 pertaining to side yard
Require- requirements in the Zoning Ordinance. Mr. Jackson stated he is satisfied
rents with the 60--day requirement which is presently in effect, but felt that a
compromise could be reached between the 60-day requirement and the
• one-year requirement in the new bill. lie also felt that the change in
the side yard requirements would be discriminatory against new builders
due to the fact that homes already built were allowed side yards of less
than ten feet, while new builders were only allowed ten feet. lle feels
an average could be determined in each neighborhood and that average •
footage used as side yard requirements there.

Boy Scouts Mr. Torn Molt was present and introduced Boy Scout Troop 2 who were
in attendance to meet merit badge requirements in the area of
communications.
Consent The next item of business was the Consent Agenda, which included
Agenda Council Minutes of 10-3-83, 10-5-83, 10-13-83, the Administrator's Report,
Finance Report, and awarding of the following bids:
408 Furniture, Central Maintenance & Municipal Court
410 Wastewater Sampler, Public Works
411 Tires, Recap, Central Maintenance
412 Replacement Trees, Public Works
414 Street Sweeper

A motion was made by Councilman Halsey, seconded by Councilman
Roark, to approve the Consent Agenda as presented, the motion was ap-
proved by a voice vote.

Mayor Hartsfield stated that the following minutes have been received minutes
and are on file in the City Clerk's Office: Liquor Control Board, Redd &
9-29-83, 10-6-83 and 10-11-83; Animal Rescue Advisory Committee, Filed
£" 9-27-83, and Electrical Board, 9-22-83.
Mayor Hartsfield announced that a sale contract on the old City Hall Sale of Old
building was signed on October 17. City Hall
Councilman Davis stated he would probably be able to attend the LAGERS LAGERS
meeting to represent the City. The meeting will be held at Lake of the Meeting
Ozarks on November 17 and 18.
The next item of business was the introduction of bills. Introduction

Councilman Hequembourg moved to strike A, C and D in Section 2, and
change Section 3 from one year to six months. Councilman Gordon stated
that he felt six months was an unreasonably short period of time. Mr.
Don Roark was also present and stated his opposition to the six months
waiting period. After further discussion, Councilman Roark asked that
the bill be tabled until the differences could be further discussed and
settled. Bill 83-127 was tabled by the following vote:

The next item of business was Unfinished Business. Unfinished

.;; a' The first item of discussion pertained to the sewer fund and the sewe
{,f `t ;: rate increase. Staff have Leen working to trim down the 1984 sewe Sewer Rate
"' 4 operations budget and trim down the amount and percentage of the firs Increase ,
fr. year' s increase. The original recommended increase was 45%, and it is
, s,::.; now down to 29%, with a more modest increase each of the succeeding
.--%, four years. Mike Bates y explained more details regarding the proposed
°V-xa increases. Mr. Bates will have a revised sewer budget and revised
�'; sewer rate ordinance to present at the final budget meeting.
The next item of discussion was the Park Board Agreement which has Park Board
been distributed to Council Members for their review. Councilman! Agreement t
y ` Hequembourg suggested that a committee be appointed to study thei

;4' agreement and work on any revisions then present it to the Council, the
t- jh Council agreed that this would be satisfactory.
' Mayor Hartsfield stated that at the last budget meeting a vote was not Police Budget
taken on the Police Training Fund or the Park Board Budget. He stated
that Staff needs a vote on these to proceed with their work on th
,t budget. Councilman Kliegel moved , the motion was seconded by
Councilman Viessman, to approve the budgets. The motion was approved
by voice vote.

Councilman Borgmeyer presented reports from the Animal Control facility
on vicious dogs at various locations in the City. lie stated that this is Vici.oua
ai recurring problem and that something needs to be done, Torn Benton; Doer
;r. started that a meeting has been held regarding this problem and al
solution should be f'or'thcoming. Mayor Hart±sfi{old asked that Gaar.y�
Hamburg report on the results of these meetings for at least the nex�
three monthly reports.
Councilman hequembourg stated, regarding as letter from Hawkins, I3ryda I jel Ponalt,i,es
and Swearengen on violations by J . C. Industries in labor practices. HO
suggested that money be deducted from final payment on the jobs the
are doing for the City until these violations have been cleared. Mr.
Hamburg stated that JCI has already been notified that such action hat
been taken.
Councilman Hequembourg had a question regarding the notificatio F:sm notifictt-
requirements by ESM of their pending increase. Mayor Hartsfield state ' tions/rate
that ESM has already moved the date of their increase back to December increases
1 to comply with notification requirements.
Councilman Gordon presented two requests for street lights to the Cit Street Light
Clerk. Requests
There being no further business, Councilman Gordon to adjourn t• Executive
