REGULAR COUNCIL MEETING, October 15, 1984

Call to A Regular Council Meeting was called to order at 7 : 30 P.M. with
Order Mayor Hartsfield presiding.
Raver Councilman Nelson asked Rev. Don Gundy of the First Baptist
<}}�" Church of Jefferson City to offer the opening prayer.
Roll Call The following Council Members were present :
Present: Borgmeyer, Davis, Gordon, Haake, Halsey, 1.
Hequembourg, Huffman, Nelson and Viessman.
Absent: Kliegel
A quorum was declared present.
Public The first item of business was a public hearing on rezoning three
Hearing tracts of recently annexed land situated in the southerly parts
Rezoning of Lots 12 and 13 of Iven' s Addition. No one present wished to
speak in favor of or opposition to the proposed rezoning. Mayor
Hartsfield declared the public hearing concluded.
Bill 84-101 Since several citizens present were interested in Council Bill
' Liquor Near 84-101 regarding the sale of liquor licenses near churches, Mayor
Churches
Hartsfield asked Councilman Haake if he wished to take the bill
up at this time out of order so those persons would not have to
remain at the meeting so long. Councilman Haake stated he did
wish to take the bill up at this time, and that he wants to with-
draw the bill due to its controversial nature .
Consent The next item of business was the Consent Agenda, which included
Atfcndta Council Minutes of 10-1-84 , Administrator's Report , Finando
' Report, and awarding of the following bids :

Councilman Hequembourg moved that the Consent Agenda be approved,
motion was seconded by Councilman Nelson, and approved.
Minutes Mayor Hartsfield stated that the following minutes have been

Committee, 10-1-84 ; Parking & Traffic Committee, 10-5-84 ;
Planning & Zoning Commission, 9-13-84; Plumbing Board, 9-25-84 ;
Police Personnel Board, 10-1-84 ; Liquor Control Board, 10-1-84 .
Call for Mayor Hartsfield announced that a special Council meeting will be

ordinances pertaining to the budget.

The Mayor asked if any the Council members would attend the LAGERS
LAGERS meeting at the Lake of the Ozarks in November to represent meeting
the City. Councilman Huffman stated he would attend.
Mayor Hartsfield announced the following appointments to boards Appointments
or commissions : Gordon Persinger, Board of Adjustment, full term;
Rev. Kevin Gormley, Park Board, fill the unexpired term of Judy
Dietzel. There were no objections or questions from the Council
regarding the appointments.
The next item of business was the introduction of bills . Introduction

Bill 84-129, sponsored by Councilman Nelson, entitled:

Mr. Fred Lafser, President of the Downtown Business Association,
was present to state that organization's intent to subsidize the
service if need be.
Councilman Nelson requested that the rules be suspended and Bill

past studies . He also stated problems which have arisen or could
arise if no such studies are performed.

The next item of business was the Informal Calendar. Informal -
Calendar
Councilman Hequembourg requested that Bill 84-92 be withdrawn. 84-92 Withdrawn
Councilman Haake requested that Bill 84-97 be withdrawn. 84-97 Withdrawn
Councilman Huffman requested that Bill 84-102 be removed from the 84-102
Informal Calendar for discussion and vote. Councilman Davis moved Held Over
that 84-102 be amended by requiring that at least three Council
Members ' consent to gain access to a personnel file. Councilman
Haake seconded the motion. Councilman Halsey asked that Lyn
Porterfield present an opinion regarding acceptable methods of
handling such matters, and asked Councilman Huffman to hold Bill
84-102 over on the Informal Calendar until Mr. Porterfield's
opinion can be presented to the Council for consideration.
Councilman Huffman consented to replace Bill 84-102 on the
Informal Calendar, Councilman Davis withdrew his motion, and
Councilman Haake withdrew his second to the motion.
Councilman Hequembourg requested that both Bills 84-117 and 84- 84-117 Held
118 be held over on the Informal Calendar. 84-118 Held
The next item of business was resolutions . Resolutions
RS84-24 , Fraternal Order of Police; Councilman Davis moved that RS84-24 FOP
it be approved, motion was seconded by Councilman Hequembourg,
and approved. Gary Hamburg stated that it has been requested that
the City use payroll deduction to withhold membership dues in the
FOP. Bob Cox was directed to determine if that could be done
using the City' s computer system, and present the cost of
processing at the next Council meeting.
RS84-25, Personnel Procedures ; Councilman tlaquembourg moved that RS84-25
it be approved, motion was seconded by Councilman Vieseman, and Personnel
approved.
RS04-26, Removal of Street Light; Councilman Hequembourg moved RS84-26
that it be approved, motion was seconded by Councilman Halsey, Remove Street
and approved. Light
The next item of business was unfinished business . Unfinished Bus.
Councilman Hequembourg moved that Mayor Hartsfield contact Transportation
Senators Danforth and Eagleton regarding the City' s request to Grant
purchase smaller, more cost efficient buses, and the federal
government's denial of the request on the grounds that larger
buses will have to be purchased if the City receives grant money.
The motion was seconded by Councilman Halsey, and approved.

The next item of business was new business .
Gary Hamburg requested that the Council waive the procedures Waive Consult-
normally followed when using consulting firms , as the firm lant Procedures
recommended to perform the parking study has done similar studies
for the City in the past. Councilman Nelson moved that the
procedures be waived, motion was seconded by Councilman Halsey,
and approved.
There being no further business, Councilman Hequembourg moved Adjourns=
that the meeting be adjourned, motion was seconded by Councilman
Gordon, and approved.

Executive Councilman Viessman moved that the Council go into Executive
Session Session for the purpose of discussing personnel matters, the
motion was seconded by Councilman Haake, and approved by the
following vote:
