Councilman Ilorgmoyer made the motion that such recommendations .,, be accepted and Capitol City Ford, Inc. , be awarded the two bids , as net out . Motion seconded by Councilman lloquembourg and passed. i; ;I !; Approval The minutes of the Council Meeting of September lath, and the I of Councili" following minutes of Finance Committee meetings (three) were pre- Minutes & Isented: ' Finance I I Meeting of the FINANCE COMMITTEE held Monday , September 22 , 1980, ;1 Committee in the Council Chambers, with Councilman Brant presiding. Others Meetings. : present were Councilmen Borgmeyer, Uequembourg, Kliegel , Prenger, I Wade and Whitecotton. REVENUES. Mr. Wattenbarger went through the Revenue section i of the Budget and explained various items and answered questions relating to the same. CITY ATTORNEY. The matter of City Counselor was discussed ;I hand Mr. Graham stated he was hoping one could be hired now, or at ; the beginning of the new budget year, instead of waiting until •, next April. It was determined that the salary would not be changed i! in the budget at this time, we would wait until the Ordinance was � ' passed and then the salary item in the budget could be implemented or changed accordingly, after the hiring of the City Counselor. ;I !` The City Counselor should work at least twenty hours a week, out of his office in the City Hall , he could not operate out of his i, !; private law office. !j { it li I 1 JGULAJLCOUNCIL_MEETING, _0 c,t ober _6, _1980 . _ so 1 The item of $5, 000. 00 listed for Ordinance codification , Mr, Graham stated, is to bring the present codification up to date and n 0 from then on they can be kept up to date here by insertion of new I pages in a loose leaf booklet. , I Councilman Whitecotton made the motion that the City At- ; torney's budget be tentatively approved, awaiting the passage of the Ordinance regarding the City Counselor. Motion seconded by Councilman Kliegel and passed. MUNICIPAL COURT. This budget was discussed and the City At Approval torney answered questions regarding the same. Councilman White- of cotton made the motion that the Municipal Court budget be approved. Finance Motion seconded by Councilman Kliegel and passed. Minutes. CITY COLLECTOR. Mr. Stone was present and answered questions. 1 It was explained that this office would only be functioning until the middle of April , the budget was based on a six months ' period. - At this time the two Clerks would be assumed by the Finance De- ' partment and that Department was budgeted accordingly. This is according to previous action of the Council. Councilman Kliegel made the motion that the budget of the ' City Collector be approved. Motion seconded by Councilman White- II cotton and passed. CITY ASSESSOR. Mr. Neutzler was present and answered d questions. This budget has been slightly revised on the salary - 1 figures. Councilman Prenger made the motion that the revised budget be approve. Motion seconded by Councilman Whitecotton and passed. FEES , PLANNING AND CODE ENFORCEMENT DEPARTMENT. On the BOARD OF ADJUSTMENT FILING FEE, it is now $25. 00. . The schedule of cost for each request is $162. 00. After some dis- ' cussion , Councilman Whitecotton made the motion that this filing fee be changed to $75. 00. Motion seconded by Councilman Hequembourg and passed. On the REZONING FILING FEE, it is now $50. 00. The schedule of cost for each request is $205. 00. After some discussion , ICouncilman Hequembourg made the motion that this filing foe be changed to $200. 00. Councilman Wade seconded the motion . Further discussion had and Councilman Pronger made n substitute motion - that this filing foe be changed to $100.00. Councilman Kliegel seconded the motion and it passed by it 4 to 2 vote. On the SITE PLAN REVIEW, at this time there is no filing fee I established but there are costs involved. Councilman Whitecotton made the motion that this filing foe be established at $50. 00. Motion seconded by Councilman Hoquembourg and passed with 1 no vote from Councilman Borgmoyor. On the SUBDIVISION REVIEW, there is a schedule of foes with 1 a $300.00 maximum. The actual cost for each request is $111 . 00. After some discussion Councilman Hequembourg made the motion that a $100. 00 minimum foe be established, with no maximum. Motion seconded by Councilman Whitecotton and passed. On the BUILDING PERMIT FEES, the proposed Fee Schedule was accepted. Councilman Wade made the motion that such schedule be Approval approved. Motion seconded by Councilman Whitecotton and passed of with 1 no vote from Councilman Borgmeyer. Finance To cover the cost of providing FIRE INSPECTION services on Minutes new construction, a fee of $0. 005 per square foot should be added to the Permit Fee. Councilman Wade made the motion that this fee be approved. Motion seconded by Councilman Hequembourg and passed.1 On DEMOLITION PERMITS , the present fee is $10.00 and it is recommended that this be raised to $20. 00. Councilman Wade made the motion that this fee be raised to $20. 00. Motion seconded by Councilman Hequembourg and passed. • On SIGN PERMITS, the existing fee is $10.00 for the first • sign and $5.00 for each additional sign on the same premises. There is also a fee of $5.00 for each transformer on a neon or fluorescent sign, which need not be changed. After working with the Finance Department it has been determined he would need an additional amount of $11 ,786. 78, and was asking that the Bill now pending before the Council be amended to include this amount for his salaries in the present Approval budget. Councilman Kliegel made the motion that such request be of approved. Motion seconded by Councilman Hequembourg and passed. Finance PLANNING AND HEALTH. The budget was considered and Mr. Benton;} Minutes I? answered questions regarding the same. After discussion, Council- man Prenger made the motion that such budget be approved. Brant , D.P.M. , Chairman , Finance Committee. . Minutes of the FINANCE COMMITTEE held Wednesday, September 24 , 1`: • 1980, in the Police Station Conference Room, with Councilman . Brant presiding. Others present were Councilmen Borgmeyer , Crader,I Gordon, Hequembourg, Kliegel , Prenger, Wade and Whitecotton. The PARK BOARD Budget was brought up and Mr. Wattenbarger . explained portions of the scone. Dr. Nail , President of the Park Board, then talked to the Council and explained the need for a multi-purpose building in the City. He said they have been planning for it for sometime and trying to save funds for that purpose. Mr. Winch, Member of the Board, stated he had been unable,' ; Ill ; to find that they wore eligible for any outside sources of funds } for this purpose. This now building would be for indoor activities:! and would include handball courts, game room, and such. They feel ., it is an essential project Cor the City. They have boon using the school systems facilities but often got squeezed out there • and have boon forced to cut down on their activities for this reason. Dr. Nail mentioned concern about their deficit at the Bank. They are not getting their money from the City for paying the bills'; . and the Dank has boon carrying them. It was decided there should be a meeting hold within the next week or two, with the Park Board, the Council, if they desire, Mayor, Gary and Darrel , to got the internal affairs worked out , and better communications between all concerned. Mention made of the $3, 000. 00 item under Category 242 in the • H Budget. This is a contribution from the City to the Chamber of I Commerce for fireworks to be used at their annual affair, and the j Mayor felt this was the best Budget in which to include the money. ijAfter some discussion, motion was made by Councilman Borgmeyer, Approval seconded by Councilman Kliegel, to delete the $3,000.00 from the i budget . The vote was tied at 4 to 4 and Chairman Brant cast the of Finance ii deciding vote not to delete the amount but to leave the amount in . Minutes the budget. It was understood that bids would be taken and there was the possibility the entire amount would not be used. Council- Onan Crader made the motion that the Park Board Budget be approved. it . Motion seconded by Councilman Whitecotton and passed. AIRPORT BUDGET. Mr. Randolph, Chairman of the Commission, 1 explained there was an amount of some five hundred thousand dollar4 in the Bank drawing interest , but it is all allotted for acquisition of land, the expansion of runways, etc. They too were having q trouble with getting their bills paid, and it was determined a it m • eeting should be set up for the Commission, the Council, if they 1 ijdesire, the Mayor, Gary and Darrell, for better communication. I; The matter of meetings and conferences and trips taken by the f' III Director was discussed and Mr. Taylor, Mr. Randolph, Dr. Miller, I 11 1 . 11 t (1 j I 496 REGULAR COUNCIL MEETING October 6, 1980 Mrs. Garner and Mr. Munzell all spoke on the matter and stated it was essential for someone to attend these meetings and what they learned there was very helpful at the Airport . Under the Miscellaneous Category there is an amount for City Directory for the Airport. Councilman Kliegel made the motion that this amount of $147.00 for a City Directory be deleted. Motion seconded by Councilman Prenger and passed. Councilman Hequembourg made the motion that the money al- lotted in last year' s budget for Mr. Taylor's trip to Mexico City 1 for a Conference be deleted. Motion seconded by Councilman PrengeX but defeated. There was an error in Category 208 - it should have been $1,079 instead of $3,023 - this difference of $1, 944 with the $147, previously deleted would amount to $2,091 , and Mr. Randolph re- quested this amount be included in Category 202 , Lights and Heat , making the total $9,473. Councilman Kliegel made the motion that Approval this request be approved. Motion seconded by Councilman White- of cotton and passed. Finance fr Mention then made of the $500. 00 fee to the Cedar City Levy FinFinaance 1 District which had previously been overlooked in the Budget . It was determined that this amount would be allowed out of Category 202. Councilman Whitecotton made this motion , seconded by Council- ! man Crader, and passed. Motion then made by Councilman Kliegel that the Airport Budget be approved. Motion seconded by Councilman Prenger and j passed. FEES. Police Department. On police photographs the present: 1 fee is $2.00. They are recommending a change to $5. 00 per print , purchased in a set. Councilman Whitecotton made the motion that this recommended change be approved. Motion seconded by Council- man Wade and passed. FEES. Fire Department . Chief Rennick explained the fees !! they are recommending, which are as follows: $25.00 bonfires and outdoor rubbish fires 5. 00 torches for removing paint 5. 00 bowling establishments -- refinishing materials 15. 00 fireworks Councilman Whitecotton made the motion that such recommendations �� be followed and fees charged accordingly. Motion seconded by Councilman Wade and passed with ]. no vole. The Inspection Fee for State Itenta;l property was included in the Fees under Planning and Code Enforcement . For copies of reports - there is no charge now - it was recommended there be a $2. 00 charge, plus . 10 per page for any copies made over and above the report . Councilman Wade made the motion such recommendation be accepted. Motion seconded by Council- man Gordon and passed. Chief Rennick discussed charges for the rocoupling of fire hose, with gaskets and expansion rings. He understood there was no one in the City who did this type of work but Councilman ; Approval Borgmeyer disagreed. The matter is to be checked into and the of Chief will return to the Budget meeting on October 8th with furthe' Finance information. Minutes. FEES. Public Works. For curb cuts and driveway permits, the present charge is $2. 00. Mr. Bates explained the approximate cost for such permit is $15. 00 and he was recommending the fee be increased to $15. 00, and if wedging is necessary, this charge could be revised. Councilman Hequembourg made the motion that suci ( increase be approved. Motion seconded by Councilman Whitecotton and passed, with 2 no votes. On Street cuts, they were recommending that on an asphalt roadway there would be a minimum fee of $50. 00 plus . 95 per 1 square foot of excavation area. On concrete a minimum fee of $50.00, plus $1. 50. Councilman Prenger made the motion that the fees be approved as recommended. Motion seconded by Councilman ' Crader. Councilman Whitecotton then asked that the motion be amended to include that an inspection would follow up within a '. period of thirty to ninety days - this was agreeable. The motion fi c' '" . In the recommendations presented they had set up increases for all Parking Lots and also it a decrease for rates in the Parking Garage. They have now deter- ;; minted they would not ask for decrease in the Parking Garage rates,: i' only the increase in Parking lot rates. Councilman Wade made the motion that such increases be allowed. Others present were Councilmen Borgmeyer, Crader, Gordon , Kiiegel , Prengez?, t! Wade and Whitecotton. Councilman Hequembourg absent. 4 FIRE DEPARTMENT. Chief Rennick explained the budget and ,� answered questions. Mr. Wattenbarger also explained some portions of the budget . Councilman Kiiegel made the motion that the Budget , as presented, be approved. Motion seconded by Councilman White- cotton and passed. Chief Rennick mentioned that he had checked into the matter 11,l of recoupling fire hose, with gaskets and expansion rings, and learned that it could be done by Pic Supply Company. Therefore, i, the fees for this service were eliminated. POLICE DEPARTMENT. Mr. Wattenbarger went over the budget , 11 as did Chief Patton, and answered any questions. Councilman 11 Whitecotton made the motion that such budget be approved. Motion 1 Rj seconded by Councilman Wade and passed. POLICE TRAINING FUND was discussed and explained. Councilman ; • { Crader made the motion that this budget be approved. Motion seconded by Councilman Whitecotton and passed. CITY CLERK. FINANCE DEPARTMENT. Mr. Wattenbarger explained the budget , and answered questions. Category 319, Training & Education, was discussed , and Councilman Prongor made the motion that the amount of $1 ,440. 00, schooling for three persons, be stricken. Motion seconded by , li # Councilman Wade and panned. Councilman Wade made the motion that the budget , with the h above correction, be adopted. Motion seconded by Councilman } . Approval I Brant, but failed by a vote of 4 neos and 2 ayes. of !i After further discussion on the various categories, Council- Finance 11 man Prenger made the motion that the budget be approved with the Minutes. li above correction and the following corrections : Category 106-Car ,, Allowance be deleted entirely; Category 302-Dues and Publications be changed to the amount of $1,000. 00; Category 315-Meeting & I' Conferences be changed to the amount of $3,600.00. This motion seconded by Councilman Wade and passed with one no vote. i COUNCIL. The Members discussed their budget and after in- rquiries, Councilman Prenger made the motion that under Category 1 106-Car Allowance, the amount be increased $20. 00 per month, from „ $140.00 to $160.00 for each Councilman , per month. Mr. Wattenbarger explained the entire amount is shown in Capital Improvements Category. This will be used to pay off balance at the Police Station and the rest of the money actually will be used on Capital Improvements. Motion made by Councilman Whitecotton that such figures be approved. Motion seconded by Councilman Wade and passed. Meeting adjourned. Approval ( of Respectfully submitted, Thomas R. Minutes Councilman Hequembourg made the motion that the Council Minutes of September 15th and the minutes of the three meetings of the Finance Committee be approved as presented. Motion `-; seconded by Councilman Whitecotton and passed. The minutes of the Board of Adjustment and the Park Board were Minutes received and filed. Filed. A request was received from John I . Decker for rezoning property planning & at 112 East Franklin Street from RS-4 to C-2 , together with check Zoning in the amount of $50. 00. The request was turned over to the Commission. Planning and Zoning Commission. A petition for curb and guttering on Maywood Drive, between Edgewood and Tower Drive, which contained seven signatures, was referred to the Public Works Department . This is the third re- quest and the Mayor recommended that the Committee give the matter serious consideration and if it is approved it he at the old rate } since it was denied several times in the past , Mayor llartsfield stated there was a vacancy on the Census and Re- Appoint- districting Committee - Larry Butcher has moved to Florida and mrnt - needs to be replaced. He was very pleased to announce the re- Census & placement , J . Delbert Wells , as he felt he would be an excellent Redin- member. Since Mr. Butcher was a Republican .1 t was necessary to tricti.ng replace with one and Mr. Wells in a Republican from the Third Committee. Ward. Councilman Gordon moved that such appointment be confirmed. Motion seconded by Councilman Borgmayer and passed. Mayor stated that on October 20th, Chesebrough-Ponds Company will ,Changing be celebrating their 100th Anniversary, which is from 6 : 30 to time of 8:00 P.M. , and he would like to change the hour of the Council i next !�+ meeting from 7: 30 to 8:00 P. M. on that night. There was no ob- }Council jection. Meeting. Mayor then referred to letter he had received from Jenel Corpora-4 tion regarding Cable Television. I Cable We should be able to take advantage of some inexpensive r; TV consulting assistance as we get into the Cable T.V. Franchise, which expires in April, 1981. I; ((� 1 Mayor Hartsfield stated the City Attorney had drafted a new 1 Ordinance dealing with police powers. He was referring this Public Ordinance to the Public Safety Committee for review and recom- [Safety mendation and was asking that Committee to meet with Colonel iCommittee. )Patton on the matter. Mayor stated he had written the Highway and Transportation Com- mission, at the request of the Council , regarding the •frequency nter- of accidents on the tri-level interchange. He has had a response: change. and they are doing some study work on the interchange, and upon completion of the study we will hear further. rri 1 1 .� c ,.d r; :. REGULAR COUNCIL MEETING October 6 1980 z .fax : Humane Mayor also referred to letter from the Heart of Missouri, humane ° w0.`,:,. ;4 ,Socioty Society advising that they had successfully .raised the $50,000.00 ! , Pledge pledged to the City for the Animal Shelter. i P, T z y' 'b. Salary Mayor then referred to the final report from the Salary Study , Committee which has just been furnished. They were asking that ,, Nr Studay ary , the Councilmen study this report and at the meeting on October Committee; .-20th, Dick Hanson, Chairman, will be present , along with other ! members of the Committee, and the matter can then be discussed, s ' so they can get some consensus of your opinion. F`. Mr. Fred Lafser of the Riverfront Commission then discussed the Riverfront matter of the riverfront and the Appraisal which had been made , Commission showing the property valued at $18,950. This was one of the requests made at the last Council meeting - an appraisal of the property from the existing crossing of the tracks , where the boat ramp is , down to Wear' s Creek, which is larger than the '� Corps of Engineers property presently developed. r The Council had also asked Mr. Lafser to check on other communities - how they had fared in similar circumstances. He y had found two, St . Charles and Washington . At St . Charles they have always owned the property but had to secure access from the M.K.T. Railroad and the Railroad agreed, after some deliberation , with two conditions - that the City pay the liability insurance, which amounted to $250.00 for each of three accesses , and on one of their accesses they had to build a fence for a short distance. In Washington they have a Riverfront Park, similar to the one wanted here and public access was granted by the Missouri Pacific in 1885, when the City wanted to establish a ferry opera- tion, and the public access has presided ever since. Mayor stated that he had discussed the matter with Larry Gale3; 1 of the Conservation Commission and he stated if the City was successful. in purchasing the property he would recommend to the Cotntnission t;hat: they purchase .it from the City. ; Councilman 1lequembourg made the motion that the Mayor be authorized to proceed with negotiations to secure this land, and if necessary proceed with condemnation proceedings. Motion seconded by Councilman Wade and passed. Mr . Tod Herron of the Housing Authority was present the early part of the mooting and stated that the appraisal of $18,950 was ; a well, done appraisal , The Housing Authority in willing to negotiate for that piece of property and , furthermore , the Housing Authority would be willing to try to get the purchase included in the Capitol Went Program, but he could not guarantee this could be done. The Housing Authority would be willing to take the ; chance, if the City is willing, to go ahead and make the purchase with Capitol. West funds, with the idea if HUD finally did object the City would have to reimburse the $18, 950. There is a major I risk and Mr. Herron stated he would suggest we clear it with HUD before proceeding. Then if the Council wants to proceed, we will negotiate and either purchase it with City Funds or attempt to t li purchase it with Capitol West funds.
