I, Mike Riley spoke to the Council on behalf of the Jefferson City OLibrary Board. They are requesting the Council authorize them to p , Library 11 establish a checking account to be used for the twelve checks Board. He stated the State Auditor' s :! ! Office came to the them and requested to audit them. The Board I agreed to the audit but only on the condition that there would be II no charge. They feel the $1, 400 is an excessive charge for the audit and thinks the City may have been overcharged by the auditor.li , . After discussion, Councilman Halsey moved the City Administrato be authorized to write the State Auditor requesting reimbursement of the $1,400 and he was further instructed to prepare a resolu- tion simplifying the investment procedure. I , 174 REGULAR COUNCIL MEETING.,_ OCTOBER 5, 1981 A Public hearing was held regarding a Rezoning Request from 'r } Stephen Bradford for property in the 1200 Block of Chestnut St. Public from RA-2 to M-3. Seth Evans, Architect for Mr. Bradford, appeare• Hearing. and presented a drawing of the proposed development. The project would be built in three phases and would consist of a warehouse, • an office commercial building over the warehouse and an office commercial project. Each phase will have to come before the Council and the Planning & Zoning Commission for approval. Mr. Evans stated that the City of Jefferson and Lincoln University are surrounding property owners and both have indicated they would • have no objection to the rezoning request. Richard Brownlee, 1016 Fairmont Court, Ralph Duggins, 1101 Vineyard Square, Harold McDowell, 1010 Leslie Boulevard, and Phil Gardner, 1014 Leslie Boulevard, appeared in opposition to the request. After discussion, it was suggested that the Councilmen in that ward, Tom Benton, and the residents of the neighborhood meet y;> and discuss the situation before the Council meeting on October z 19th. Ay A Public Hearing was held on a Rezoning Request from Bill Chiles Public for property at 108 East Franklin from RS-4 to C-2. Mr. Chiles Hearing. appeared to answer any questions. No one appeared in opposition to the request. A Public Hearing was hold regarding amendments to the Zoning Ordinance. Mr. Jackson, of the Planning & Zoning Commission Public appeared. The Commission recommends to the Council that the !tearing. ordinance prepared by staff and the Commission be approved and adopted. No one appeared in opposition to the amendments. yip A letter was received from the Labors I.nter.nati.onal indicating they no longer, represent the majority of the public works employee0 Labors and are requesting decertification as of December 2 , 1981. Phis Tntnatl. letter, was referred to the City Administrator and City Counselor for their action. A letter was received from the Park Board regarding a home for the caretaker in Hough Park. The house there is in very bad Park Board condition and they can purchase a mobile home and place it on Housing the property for a cost of one-third leas than buying a new home. Tiw$t. However, this would be in conflict with the zoning ordinance and they would like the Council to amend the ordinance to allow them to place the mobile home on the property. Several Councilmen voiced disapproval of placing a mobile home on the property. Mayor Hartsfield will request someone from the Park Board be present on October 19th to discuss this matter. Tom Utterback, City Counselor, has issued an opinion regarding the banking and investment policy of the City. He stated it is Banking unlawful for the city to bid their checking account but they can and In- bid investments. It was suggested that the Resolution be rewritte vestment* • to be a policy of bidding investments. Mayor Hartsfield reported that the City of Leichester, England Sister has accepted our invitation to become a Sister City. This request was opposed by Councilman Borgmeyer. Therefore, the bill will be taken up on October 19th. " Councilman Hequembourg introduced a substitute bill for the Council's consideration. The amendments contained in the sub- stitute bill are as follows : a) Section 14-12 (a) . The sentence "However, a candidate for City office shall not be required to designate any affiliation, 4 membership, or status" is deleted from the bill pending. b) Reference in title to non-partisan is deleted. c) New intent and purpose clause conforming the city election laws to the Comprehensive Election Act of 1977, Chapter 115 RSMo and to enact certain other provisions dealing with areas left to the discretion of the city by said Act. d) 14.6 (d) has been deleted, which was the definition of non-partisan. e) 14. 12, Nomination of Candidates is the new title as oppose. to non-partisan nomination of candidates. f) 14-12 (b) . The language "the candidate's political, non- partisan, or independent designation, if any" was added. The words "if any" were then deleted from the sentence. i' 8 raf. Number of signatures needed for a petition of a candidate has been changed to 25 for City Councilman and 125 for Mayor and Treasurer with 25 signatures from each ward for Mayor and Treasurer. yf h) 14. 17. The sentence "should the candidate designate a membership in a political party, or a non-partisan or independent status, the designation shall appear, in an unabbreviated form, next to the candidate's name" was added. Mayor Hartsfield pointed out that the changes basically do two things: 1) anyone seeking to have their name on the ballot must have a designation and 2) lowers the nominating petition number of signatures. Councilman Hequembourg stated the substitute bill would also: 1) allow state employees, who are permanent citizens of Jefferson City, to participate in city government, and, 2) would do away with the expense of a primary election unless there are four candidates. Willard Refine, Chairman of the Cole County Democratic Central Committee, appeared. After reading the amendments contained in the substitute bill, he commended Councilman Hequembourg for improving the bill. However, he felt there were still problems. He feels the ordinances dealing with elections should be rewritten to delete the outdated language. He also feels there would be a problem with political tricks where more than one person would file under one party label to confuse the voters and would prevent a statutory political committee from being involved in the electio process. Also, because of no primary election, we could have minority elected candidates. He also has a problem with the in-- ability of the party committee to appoint new candidates if a candidate dies or withdraws. After further discussion, Councilman Hequembourg moved that the substituted bill be accepted. Motion seconded by Councilman Prenger and panned. After voting to accept the substitute bill, Councilman Brant requested that the nubnt.itute bill be placed on the Informal 1 Calendar. Mayor requested Mr. Utterback have a revised draft of the remainder of the elect.ion code prior to the next: Council meeting. A representative of. the Capitol. Young Democrats Annoci.ration was also present. He too commended the Council t:or postponing a rushed judgment on Bill. 8158 and stated that their organization also has problems with thin Bill , one of which would be a ballot which might not be authorized in the State of Missouri. Bill 81-59, introduced by Councilman forc,Imeyer, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , REPEALING SECTION 81-59 6 , CONTAINED IN ARTICLE II, OF ORDINANCE NO. 9509 , RELATING TO Vicious KEEPING OF DOGS, CATS AND OTHER DOMESTIC ANIMALS AND ENACTING A Animal. NEW SECTION 6 , ARTICLE II, RELATING TO THE SAME SUBJECT MATTER. " Councilman Borgmeyor requested this bill be placed on the Informal Calendar. Bill 81-60, introduced by Councilman Scheulen, entitled: 81-60 AN ORDINANCE PROHIBITING PARKING IN THE REQUIRED FRONT OR REAR Parking YARDS EXCEPT UPON PARKING AREAS AS ALLOWED BY THE ZONING CODE OF THE CITY OF JEFFERSON. Mike Bates appeared to seek a decision from the Council on the route alignment on North Ten Mile Drive. North Councilman Wade moved that we accept Alternate B, which would Ten improve the existing roadway on the east and west ends, however, Mile from Scott Station Road to Dix Nursery it would be relocated to Drive. the south at a cost of $1,466,916.
