HomeMy Public PortalAbout19831003 48 REGULAR COUNCIL MEETING, October 3, 1983 The Regular Council Meeting was called to order at 7:30 P.M. with Order to Mayor Hartsfield presiding. 8 Order • Prayer was offered by Mayor Hartsfield. Prayer The following Council Members were present: ROLL CALL Present: Borgmeyer, Davis, Gordon, Haake, Halsey, Hequembourg, Lock, Roark and Viessman. Absent: Kliegel. • A quorum was declared present. Three public hearings were held as follows: Public • Hearings r: Rezoning of Southgate Subdivision from RS-2 (single family) to PUD Rezoning y? ate • (Planned Unit Development) . No persons present spoke in favor or South 9 opposition to the rezoning request. Rezoning Lots 32 through 38 of Schotthill Woods Subdivision from RD Rezoning (duplex) to RS-2 (single family). No persons present spoke in favor or Schotthill in opposition to the rezoning request. Woods Ordinance relating to exceptions to yard requirements. No persons Yard present spoke in favor or in opposition to the changes in the ordinance Requirements as proposed. '.a Mr. Dwight Reed was present to accept a Key to the City for his service Key to City on the Park Board. Dwight It( • fr Mr. Joe Wilson was present to speak about the boxing club. Mr. Wilson Boxing explained how and when the club with established., and stated that he is Club disturbed about rumors associated with the facilities used by the club. Councilman Rork stated he felt Jefferson City could only support one boxing club arad , since there is already it club established, Mr. Wilson s club should consider merging. The next item of business was the Consent Agenda, which included Consent Council Minutes of 9-19•-83, 9-26--F33 and 9-28-83, as well as the following Agenda • bids: 403 Sodium Chloride, Public Works 404 Carpet , Fire Station #1 405 Overhead Door Replacement, Fire Dept. 406 Electrical improvement, Fire Dept. 409 Street Sign Materials, Public Works CANCELLED 401 Litter Receptacles, Planning & Code/Street Div. 407 Plumbing Improvements, Fire Dept. ( HELD OVER 408 Furniture, Central Maintenance & Municipal Court Mayor Hartsfield stated that he would like to remove Bid 405 for discussion before the Consent Agenda is approved. A motion was made by Councilman Hequembourg, seconded by Councilman Roark, to approve the Consent Agenda as presented, excluding Bid 405. The motion was { approved. jMayor Hartsfield asked Gary Hamburg to explain Bid 405. Councilman Hequcmbourg moved to accept the bid and award it to } ; the low bidder. The motion died for lack of second Councilman `y' Borgmeyer moved that Bid 405 be rebid, the motion was seconded by :? `i Council Member Lock, and approved. tY? t LL'' Minutes Mayor Hartsfield stated that the following minutes have been received •, Received & and filed in the City Clerk's office: Board of Adjustment, 9-13-83, and Filed Airport Commission, 9-20-83. .; Park Board Mayor Hartsfield stated that a proposed agreement between the Park Agreement Board and the City has been drafted, and will be sent to the Councilmen shortly for their review. Members of the Park Board will be present at the October 13 meeting. Firefighters 1 Mayor Hartsfield stated that he had received a list of demands from the yS . Agreement ,1 Firefighters Union. He has denied their request to be heard before the b whole Council and has instructed Mr. Hamburg to meet with them and ; report the meetings to the Council. - : Rules In a meeting of the Rules Committee immediately prior to the Council ::, Committee Meeting, it was decided that the City Clerk should keep a file of names and addresses of persons interested in serving, on the different boards and commissions of the City. Councilmen are asked to contact the City ` Clerk if they have any suggestions for the file. .. Transit Mayor Hartsfield stated that he has refused to sign the Resolution Resolution passed at the last meeting pertaining to the application for a grant for the Transit Division. Ile stated that he felt the deficit was already too large in that department and since the grant would be for the purpose of adding to their fleet, would make the deficit la rger. i. '. Bill 83-133 was read first and second time by title and ordered distributed to members of the Council. f LAGERS Mayor Hartsfield stated that the Council needed to make a decision refund regarding the LAGERS refund issue. Councilman Borgmeyer sta ted that the LAGERS system was begun ass a retirement system and he did not feel a refund should be given. Councilman llequcmbourg moved that the Council support the employees in their efforts to get legislation changed to allow the refund as long acs they City would receive t he money back from LAGERS in the future. Mayor Hartsfield stated that, since a clear majority of the residents were opposed the name change at this time is a dead issue. The next item on the agenda was New Business. New Business Councilman Roark ' stated that the owners of the Madison Cafe has Use of requested permission to use the parking garage across the street from Parking their business to hold an auction to sell part of their restaurant Garage for equipment. Councilman Borgmeyer felt that to allow this would be to set Auction a precedent. Councilman Hequembourg stated that if the Council received more such requests that each one would be decided on an individual basis and would not necessarily set a precedent. Marty Brose stated that the owners of the Madison Cafe understand that they will be responsible for obtaining proper insurance prior to the auction. Councilman Hequembourg moved to allow the owners of the Madison Cafe to rent the parking garage for a fee of $50, the motion was seconded by Councilman Roark, and. approved by the following roll-call vote: Aye: Gordon, Halsey, Hequembourg, Roark and Viessman. Nay: Borgmeyer, Davis, Haake and Lock. Councilman Halsey brought to the attention of the Council an incident Employee involving a citizen of the City and a City employee, whereby the I.D. employee entered upon the citizen's property without identifying himself or explaining his business there. He stated that the citizen complained about such behavior and requested that the Council furnish their employees with some kind of identification and instructions regarding using the 1.D. Mr. Hamburg stated that he would investigate the incident mentioned by Mr. Halsey. Councilman Gordon moved that a committee be appointed to work with Mr. Committe Brose in studying the deficit in the transit budget, the motion was to Work seconded by Councilman Hequembourg and approved. with D.O. Councilman Borgmeyer asked Mike Bates about the work being done on S. Dual on Country Club. lie stated that citizens were complaining about the dust S. Country being generated and that the City should consider spraying water each Club project morning until the work is done to, help alleviate the problem. Mr. Bates stated that the work is presently being delayed until utility companies complete their work there. There being no further business, Councilman Gordon moved to adjourn to Adjournment Executive Session, the motion was seconded by Councilman Hequembourg, and approved by the following vote: Aye: Borgmeyer, Davis, Gordon, Haake, Halsey, Hequembourg, Executive Lock, Roark and Viessman.
