REGULAR COUNCIL MEETING, October 1, 1984
Call to A Regular Council Meeting was called to order at 7 : 30 P.M. with
Order Mayor Hartsfield presiding.
Prayer Prayer was offered by by Councilman Viessman.
Roll Call The following Council Members were present :
Present : Borgmeyer, Davis , Gordon, Haake, Halsey,
Hequembourg, Huffman, Kliegel, Nelson and
Viessman.
Absent: None.

A quorum was declared present .
Public Hearing The first item of business was a public hearing regarding Council
Liquor Bill 84-101 pertaining to the sale of liquor near churches or
schools. Mr. John Marshall was present and spoke in favor of the
proposed ordinance. The following persons present spoke in
opposition to the passage of the ordinance: Dr. Arthur Mallory
and Mr. Dick Gaffney. Mayor Hartsfield then asked for those
present who were in favor of the ordinance to stand, then those
who were opposed to the ordinance to stand. There being no
further discussion on Bill 84-101, Mayor Hartsfield declared the
public hearing concluded.
Public Hearin• The next item of business was a public hearing on annexation. Mr.
Annexation Tom Riley was present and spoke in opposition to the annexation.
Mr. Dick Gaffney asked to speak, but asked that Mr. Dick Preston
first make the City's presentation regarding the annexation. Mr.
Dick Preston, City Planner, stated that the City has determined
that the land to be annexed is contiguous to the existing city
limits and that the length of the contiguous boundary common to
the existing city limit and the proposed area to be annexed is at
least fifteen percent of the length of the perimeter of the area
proposed for annexation. Mr. Preston then explained the City's
reasons for seeking to annex the area. Overhead projections were
than presented which showed a map of the area proposed for
annexation, and which showed locations of various City services
located near the area. He presented to the City Clerk, and asked
for entry on the hearing record, a memo from Mr. Mike Bates
Director of Public Works, stating the length of the perimeter
boundary, the length of contiguous-common boundary, and that the
percentage (continuous common/length of permiter) is 37 .5% . Ho
then presented the City's "Plan of Intent" which included the
following: a) A list of major services now provided by the City
such as police and fire protection, sewer service, street
service, and parks and recreation: b) the City's proposed time
schedule for including these services to the annexed area, which
would be at most three years from the effective date of
annexation: c) The level of assessment of city property and tax
rate of the property: d) Zoning of the annexed area, and e) When
the proposed annexation would become effective.
The following City staff members each made a presentation stating
the services each department provides to the City, and how those
services would be provided to the proposed annexed area: Robert
Rennick, Fire Chief; Lawrence C. Patton, Chief of Police; Bill
Lockwood, Director of Parks and Recreation; Marty Brose, Director
of Transportation; Thomas Benton, Director of Planning & Code
Enforcement, and Robert M. Bates, Director of Public Works . Mr.
Benton then asked that the entire Plan of Intent be offered as
evidence in the hearing.
Mr. Dick Gaffney then spoke from the gallery and referred to the
fact sheet which was distributed to the property owners . Mr.
Gaffney spoke in oppositionn to the annexation. Other persons in
the gallery asked questions of Mr. Preston and Mr. Benton. Mr.
Paul Pederson spoke in favor of the annexation. After further

discussion by the Council, Mayor Hartsfield asked if anyone else
in the gallery had any questions or comments . When no one

responded, he declared the public hearing concluded.

The next item of business was the Consent Agenda, which included Consent
Council Minutes of 9-17-84 and 9-26-84 , and awarding of the Agenda
following bids :

Councilman Davis moved that the Consent Agenda be approved as
presented, motion was seconded by Councilman Viessman, and
approved.
Mayor Hartsfield called for a five-minute recess at 8: 55 p.m. , Recess
after which the meeting reconvened at 9 : 00 p.m. Mayor Hartsfield
announced that he and Mr. Hamburg, along with city officials from
Columbia and Fulton had attended a meeting to discuss economic
development projects for the central Missouri area.

Business
Councilman Borgmeyer moved that the Council accept the staff 's
Bid 533 recommendation regarding Bid 533, communications equipment
Commrunications ' maintenance, the motion was seconded by Councilman Gordon, and
Equip. Bid 533 was approved as recommended by staff.
'Traffic Signal Mike Bates reported that a traffic signal could be in place at
the Industrial Drive/Jaycee Drive intersection within 30 days,
on Industrial/
J e and the cost would be between $7, 500 and $8, 500 for a temporary
installation. He stated that the money would come out of this
year' s budget from surplus funds in his department. Councilman
Gordon moved that Mr. Bates be directed to proceed with the
installation providing it does not cost more than $10, 000, the
motion was seconded by Councilman Hequembourg, and approved.

The next item on the agenda was New Business . Business

Councilman Halsey asled that the Council consider becoming personnel
involved in personnel decisions on a temporary basis . Mr. Halsey Decisions
moved that an ordinance be prepared that would involve those
positions (as included in Mr. Hamburg's memo) which are subject
to appointment, confirmation, promotion or demotion, or
dismissal, and that no salary increase or decrease be included in
the review process . The motion was seconded by Councilman Haake,
and approved by a show-of-hand vote of 8-2 .
Councilman Huffman presented a proposed resolution regarding the FOP
Fraternal Order of Police, and asked that it be placed on the Resolution
next agenda for Council approval. He explained the function of
the FOP and the degree of interest shown by local Police officers
in such an affiliation.
Councilman Halsey asked that copies of the budget work sheets be BL Jet
sent to Council members before the next budget work session. The Sessions
Council agreed on October 8 and 10 as dates of the next work
sessions .
Councilman Nelson reminded Mr. Brose that an ordinance regarding shuttle
the downtown shuttle bus service needs to be introduced at the Bus
next Council meeting.
There being no further business, Councilman Nelson moved that the Adjournment
meeting be adjourned, the motion was seconded by Councilman
Davis, and approved. Councilman Gordon moved that the Council
adjourn into Executive Session for the purpose of discussing real
estate and litigation, the motion was seconded by Councilman Executive
Nelson, and approved by the following vote: Session
