A Regular Council Meeting was called to order at 8:00 P.M. with
Mayor Louise Gardner presiding.
Prayer was offered by Councilman Kyle Mason.
The following Council Members were present:
Present: Barnicle, Borgmeyer, Davis, Gordon, Haake, Halsey,
Mason, Scheulen, Veile and Woodman.
Absent: None.
A quorum was declared present.
PUBLIC HEARING:
The first item on the agenda was a public hearing on Bill 87-82
regarding the regulation of burning in the city limits. Mayor
Gardner announced each side would be given a total of ten ( 10)
minutes to present their arguments. Mr. Erwin Gadd, 2700 Garden
View Drive, spoke in favor of the passage of Bill 87-82. Mr.
Gadd addressed the issue of burning from an interest in public
health. Mr. Gadd informed the Council that not only does burning
create odor problems and is unsightly, but it also creates an
environment for rats, insects, flies and other health hazards.
Mr. Gadd stated he believed the city to have good trash removal
service and felt that the burning of trash should be prohibited.
Mr. J. Jerry Green, 1000 Jason Road, spoke to the Council in
opposition to Bill 87-82. Mr. Green is a local developer and
stated ho felt )Article 27-7(7) regarding the clearing of ground
did not go far enough. The article now states that you must have
the permission of the Fire Chief. Mr. Green informed the Council
that there had been times when the Fire Department had not been
able to respond in a timely manner to come and inspect the area
to be burned and this created problems for the developers and
their crows. Mr. Green also stated there could be problems with
the clearing and burning of an area at one time, as this would
make the fire too large and pose safety problems to the area
surrounding it. Mr. Green stated ho felt it would be bettor to
amend the proposed ordinance by setting a diameter for the size
of the fire and stating that fires will be monitored and
controlled.
Mr. Charles Morris, 2933 Cochiso Lane, addressed the Council in
opposition to Bill 87-82. Mr. Morris had some concerns regarding
the items of trash the current franchise holder does not pick up,
such as boxes. Mr. Morris stated the residonta would have to
burn these items, therefore, you still have people burning.
Mr. Bill Galloway, 808 Clark Avenue, addressed the Council in
regard to the financial costs of a no burn ordinance. He stated
that he and several of his neighbors are able to save money by
burning their paper trash, and if this bill is passed, he felt it
would increase the cost of the garbage bags.
City Administrator Dave Johnston stated that the company with the
trash removal franchise had promised a reduction in the cost of
the removal of trash that would be guaranteed until December,
1988.
Councilman Davis asked Fire Chief Robert Rennick just how much of
a problem the burning of trash was for the fire department.
Chief Rennick stated that they constantly receive phone calla
concerning trash being burned and the problems of smoke and odor.

Chief Rennick stated there had been incidents of citizens being
severely burned because fires had gone out of control .
Councilman Davis stated it appeared to be a Catch 22 situation,
there is a problem with burning, but if the Council doesn't do
something, more and more people will continue to burn their
trash. This will only increase the cost of trash removal for
those individuals who do not burn.

The next public hearing was in regard to the proposed 1987-88
operating budget for the City of Jefferson. There was no one
present to speak either in favor of the proposed budget or in
opposition to the proposed budget.

The Consent Agenda consisted of the following items:

Dr. William Back - Environmental Quality Commission
Councilman Borgmoyor questioned where the monies for Bid 937
regarding the cleaning of the carpets in the public buildings was
coming from. City Administrator Dave Johnston stated there was
sufficient monies on the janitorial account to cover this
expense. Councilman Hanks requested that for future bids that
would show a negative balance, that they make a note on bid as to
where the money will be coming from.
Councilman Barnicle stated he wished to protest the minutes in
regard to the way the motion regarding Midwest Block had been
handled in the September 8 Council Meeting. Councilman Barnicle
stated that according to Robert's Rules of Order and our own Code
states that a "call for the question" requires a second and a two
thirds vote before the discussion can be ended and a vote taken.
Councilman Barnicle stated this had not been done and when he
stood to question this in the September 8 meeting, he had not
I been recognized. After further comments on this breach of
procedure, Councilman Barnicle stated he would forego his right
of appeal regarding this motion.
There being no further comments or questions, Councilman Halsey
moved approval of the Consent Agenda. Councilman Woodman

Mayor Gardner announced the following minutes had been received
and were on file in the City Clerk's office: Traffic Safety
Commission 9/10/87; Planning & Zoning Commission 9/10/87; Equal
Employment Opportunity Committee 9/10/87; Public Works and
Planning Commission 9/16/87; Animal Rescue Advisory Commission
9/16/87; City Administrator and Departmental Monthly Reports.
There was some discussion regarding the minutes of the Planning
and Zoning Commission of September 10, 1987. Councilman Barnicle
stated the motion regarding Midwest Block had been placed on the
table, but it did not show that it had ever been taken off of the
table; just that they had voted on the motion. Councilman
Barnicle stated this was an illegal vote and requested an opinion
on this procedure by the City Counselor be sent back to the
Planning and Zoning Commission and the minutes corrected. Mayor
Gardner informed Councilman Barnicle these minutes were of a
Commission and could not be changed by the Council. Councilman
Barnicle asked that it be noted the motion had been placed before

the Council illegally. Mayor Gardner stated the minutes did come
to the Council before they had been approved and corrected.

Dorothy Bolden and Debbie Greeno for their hard work and
organizational efforts in the September 17, Constitutional
Bicentennial Celebration.

Councilman Woodman moved this bill be removed from the table and I
considered for adoption at this time. Councilman I3arnicle
seconded and it was approved. Councilman Haake reminded the
Council that this request for angle parking had been denied by
the Traffic Safety Commission. Councilman Haake stated the
Police Department had been present at this meeting and had spoken
against the request for safety reasons and had stated that angle
parking was very difficult to remove once it had been approved.
Councilman Woodman stated the Transportation Commission had
approved this request only as a temporary solution and only for
one side of the street.
Councilman Mason stated he had discussed the matter with the
Police Department and they were adamantly opposed to angle t
parking for safety reasons and the fact that it is very difficult
to eliminate once it has been designated.

Madison Street, the west side of the 100 block,

the northeast curb of Capitol Avenue extending to State
Street.
Mr. Brose stated this bill was being introduced to "clean up"
this schedule, and that Jefferson Street, west half, should not
have been placed on this schedule. Since Bill 87-92 had been
defeated, Madison Street should not be included in this schedule

UNFINISHED BUSINESS:
Councilman Borgmeyer stated the Public Works Committee requested
assistance from the Council regarding the proposed construction
on Seven Hills Road. Councilman Borgmeyer stated the Public
Works Department was considering narrowing the roadway from 38
feet back to back to 33 feet back to back. Thin would be a
savings of $30, 000 to $35, 000 in paving costs. Councilman
Borgmeyer stated he felt that duo to the development that is
taking place in that area that the City should not narrow the
roadway and that the extra footage would be needed in the future
for a left turn lane. It was the general concensus of the
Council to proceed with the 38 footage back to back.
APPROVAL OF EXECUTIVE SESSION MINUTES:
Councilman Halsey moved approval of the Executive Session Minutes
of September 8, 1987. Councilman Scheulen seconded and it was
approved.
EXECUTIVE SESSION:
There being no further business, Councilman Haake moved the
Council go into Executive Session. Councilman Halsey seconded
and it was approved by the following vote:
Aye: Borgmeyer, Davis, Haake, Halsey, Mason, Scheulen,
Voile and Woodman.
Nay: Barnicle and Gordon.
