Budget Mayor Hartsfield presented the proposed budget for the 1982 Fiscal

A petition for voluntary annexation was received from Mrs. Hugo
Petition J. Schott and Elizabeth Ann Schott Fischer regarding the right-of-
for way for the Eastland Drive Extension from Route 50 East to Bald
Voluntary Hill Road, containing approximately 127 acres. Mayor Hartsfield
Annexation : stated that if we are going to build Eastland South and part of
the outer beltway, this property should be in the city. Tom
Benton was instructed to begin the procedures to annex this land
into the City.
A Resolution passed by the Police Personnel Board on August 20 ,
Resolution 1981, regarding educational incentives to members of the police
from department, was presented to the Council. This Resolution was
Police referred to Gary Hamburg, City Administrator, for his recommended
Personnel policy for Council's consideration.

It was noted that we failed to have a public hearing on this
bill as required. However, Mr. Benton stated that a Public Hearin(
has been scheduled for October 5th. Mr. Denton further stated
that the Planning & Zoning Commission has some disagreement with
the wording of this bill. Councilman Blume was absent and unable
to place this bill on the Informal Calendar. Councilman Scheulen
agreed to co-sponsor the bill and the bill was then placed on the
Informal Calendar.

TCI Council approved and adopted a Resolution extending the TCI Cable
Resolution 1 TV Franchise to and including January 21, 1982.
Banking & I A Resolution was presented for the City's banking and investment
Investment I� policy. Mayor Hartsfield requested this Resolution be carried
Resoluticn. , over two weeks and requested that Mr. Utterback review the
1 Resolution to insure it is in conformance with State Statutes.

The next item of discussion was the Walsh Street liability claims.
Mr. Bates stated that at the time the sanitary sewer was
Walsh repaired in May, city crews found material at the head of the pipe
which was debris washed down from upstream. Those materials were
Street. not completely obstructing the pipe. To open the pipe, digging
was begun at the lower end and approximately thirty feet of pipe
was replaced. He stated that initially the only problem they were
dealing with was the sanitary sewer. At that point there was no
problem with the storm drainage system and it was impossible at
that time to say that it would or would not create a problem.
Mr. Utterback stated that the only way to have guaranteed
that no future problems would have existed in that particular
area would have been to replace the whole project.
Silo stated that the sewers are old in this area, and are sub-
standard according to todays codes and the key think is even if
there wan damage to the storm sower resulting from vibration, that
doe not mean that it was negligence and does not mean the City
is legally liable.
He furtther, pointed out that in any si tuation like this the
City has three choices : repair an best they can; replace the
whole section that is old; or it can do nothing.
In response to Ms. Uirstler' n :statement that. City crews
responded on a tardy basis, Mr. Utterback pointed out that City
employees in the street and sewer departments combined worked a
total of 131 1/2 hours of overtime that weekend on this and other
similar problems.
Mr. Taylor and Ms. Dist:ler appeared before the Council and
reiterated their claims.
After further discussion, Councilman forgmeyer moved that
the Council concur with the findings of the City Counselor and
Public Works Director and deny payment to Mr. Taylor, Ms. tastier
and also deny payment to Mr. Kopp on his claim on St. Mary's
Boulevard. Motion was seconded by Councilman Prenger and passed
with one opposing vote.
Motion was made and seconded that the Council adjourn into
Executive Session.
