Plebe;, Plebe regular Council meeting was called to order at 7 : 30 p.m. with
Mayor Hartsfield presiding.
Prayer was offered by Major Geddis , Salvation Army.
Roll Call ;' Councilmen present : Blume, Borgmeyer, Davis, Gordon, Hequembourg,
Kleigel, Lock, and Scheulen.
Councilmen absent : Halsey and Roark.
A quorum was present .

his opinion concerning mandatory service. Mr. James also voiced
his displeasure with the attitudes of two Councilmen when he had
contacted them prior to the meeting concerning the solid waste
• issue .
Weatherby :; Bud Hemmel, Weatherby Posting Service , presented the Council with
.? Posting lcopies of a letter from his attorney , Alex Bartlett, expressing +r
Service '; Mr. Bartlett 's opinion the legality of the City terminating its
lease with Weatherby Posting Service. Mayor Hartsfield suggested

that the City' s letter of September 8 terminating the lease be
held in abeyance until Mike Bates could get a copy of the easement
Ifor the property at Christy and Flora and have Lyn Porterfield
' review it and give an opinion. Mr. Porterfield was instructed to
give his opinion at the next regularly scheduled Council meeting.

Consent !: The next item of business was the Consent Agenda which included

1 After discussion , upon motion by Councilman Borgmeyer and seconded
by Councilman Blume , the Consent Agenda wan approved.

Gross Mayor Hartsfield announced that he had received a letter from Ed
Receipts ORackers pointing out that in order to bring the gross receipts
Tax tax down to an effective yield of 7%, it would have be lowered to
}; 6. 5579 instead of the previously announced 6. 7% in the budget letter
iMayor Hartsfield stated this was his intention.

The next item of discussion was the solid waste franchise . Several Solid Waste
options and variations of service were dlacuus d and considered. Franchise
Councilman Davis made motion to form a committee to look into
mandatory service and report back to the Council within 60 days .
Councilman Gordon seconded the motion and the motion carried.
Mayor tlartafield reappointed the solid waste franchise committee
with a new chairman to be appointed at a later date . The committee 1
was charged with exploring all avenues of mandatory trash service lI
and to report to the City Council within 60 days . Gary Hamburg
and Tom Banton were assigned to help the committee in any way they #}
could.
Fred Nichols , ESM, indicated his company would be willing to honor
a contract signed upon expiration of the present contract to take
effect at a later date if good faith negotiations were under way.
Councilman Borgmeyer commended Marty Brose for the bus signs and Bus Signs
shelters made possible by a federal grant. Mr. Brose reported the & Shelters
signs and shelters were about 40% installed.
Motion was made by by Councilman Scheulen to adjourn into Executive
executive session and seconded by Councilman Blume to discuss Session
personnel matters .
