Kevin Gormley, St . Peters Church. s ; `Councilmen present : Blume , Borgmeyer, Davis , Gordon, Halsey, '! Roll Hequembourg, Kliegel, Lock, Roark and Scheulen?Councilman absent : None. A quorum was present . ti, I i' ; A public hearing was held regarding a reeoning request by Frank E. 1 and Mary M. Zemp to rezone 5. 57 acres of land located at the inter- 1 Public section of Tanner Bridge Road and Goodall Lane from RS-2 (single Hearing. family) to RA-1 (multiple dwelling) . Patrick Baumhoer, attorney representing the Zemppa , appeared 1 before the Council in support of the request. Theyt:beideve the , property lies in an area appropriate for multiple dwellings . There '' : is currently multi-family zoning across Tanner Bridge Road from ;;thin property and there is multi-family zoning 200 feet to the �' ' south and east of the property. He stated that the Armory property !( :would act as a buffer between any multi-family dwellings built and ` any single family residences on the same side . Those appearing in opposition to the regoning request were ,. :John Clardy, 528 Aurora Avenue, Lorraine Eveler, 1720 Tanner Bridge! ;!Road, Bernard Meyerpeter, 1218 Tanner Bridge Road, C.M. Oliver, 172 ' ;!Tanner Bridge Road and Fred Bode , 723 Peachtree Drive . Upon re- (' 'Iquent , a show of hands showed thirty two persons present in op-- j' :position to the request. Some reasons for the opposition were ,increase in traffic, parking and devaluation of their property. ,' They feel the property should remain zoned for aingie family I h iresidences. Two petitions were also presented to the Clerk in 'opposition to the request . ;' ; A public hearing was held regarding a recommended change to the off street parking requirements for, Churches and Temples . The Public !'existing ordinance requires that a church or temple provide one 1 Hearing. off-street parking space for each four seats in the main auditorium. This requirement wan felt to be excessive in arena whore land for Ooff-street parking is difficult to obtain and where municipal ;;parking loth are within a reasonable walking distance . Mr. Lyle McLaughlin, of the First Baptist Church, appeared I rand voiced the support of this bill on behalf of the Church. No ! one appeared in opposition to the change. I: !;James Finch, Jr. and B. Mike Bates stated that this bid was for repair to the damaged line at the airport and will involve a substantial amount of dewatering. Due to the fact that the river is elevated and no work can be done at this time, Bid 241 was pulled off the award list . Three contractors picked up the specs but only one bid was returned. They are examining that bid and hope to have a recommendation at the next meetin . After further discussion, upon motion by Councilman Schoulen and seconded, the Consent Agenda, with Bid 241 being deleted, was ' approved. Minutes of the Planning and Zoning Commission meeting held August 12, 1982 , Park Board meeting held August 17 , 1982 , Board of Ad- justment meeting held August 10, 1982, Airport meeting held August Minutes 17, 1982 , and Electrical Board meeting held August 2b, 1982, were Received received and are on file in the City Clerk' s Office. Mayor Hartafield recOmmendedi RJ.ckoMotris be reappointed to nerve on the Board of Adjustment. Upon motion by Councilman Hequembourg Appointment seconded by Councilman Roark, the appointment was confirmed. Mayor Hartafield recommended Marvin Gillock be reappointed to serve on the Park Board. Upon motion by Councilman Borgmeyer Appointment seconded by Councilman Blume, the appointment was confirmed. Mayor Hartafield recommended Jim McIntosh be appointed to serve on the Bark Board replacing Morrow Mason. Upon motion by Councilman Appointment Blume,seconded by Councituman Scheulen, the appointment was con- firmed. { 325 REGULAR COUNCIL::•'MEETING, September 7 , 1982 Mayor Hartsfield stated that he had received a call from Bill Coleman, who is with the Veterans Council. Council was advised some time ago of the Veteran Council' s desire to place a memorial `> plaque at the new City Hall. This plaque will be a memorial to Memorial the Korean and Viet Nam Veterans and would be placed on the wall plaque at between City Hall and the Police Station. II new City hey would like to request that the wall between the City Hall l Hall y and Police Station be changed from dark brick to light brick, at 'their expense, in order that the plaque will be more noticeable. Council questioned if the plaque which is now at the airport , would remain there or if it would be moved. (I Council aeo:. iequested they be provided a drawing or sketch l, lof the memorial. Mayor Hartsfield stated that he will ask them about the plaque at the airport and will request that they provide a ish tch for the 'Council . jl Vacant j1 Mayor Hartsfield informed the Council that the vacant house on • House on ;Miller Street is being rented for the sum of $25 .00 per month until ' . • Miller sc. such time as the new City Hall is built. This building was in bad Ishape and the people who have rented it have done some work at I1 ;their own expense to make it usable . , i • Reward A discussion was held regarding the reward ordinance which was Ordinance irecently passed by the Council. This ordinance provided for the revision 111 ayment of $500.00 upon the arrest and conviction of a person !destroying city signs . To date approximately $2,000 has been paid out in rewards. However, city staff feels that perhaps there ; should be some flexibility in the ordinance to allow for a sliding scale for monies paid out. It was the feeling of some Council I' 'membern that the fines should be increased in municipal court . It l Iiwas then pointed out that if fines are increased excessively , the ;(Judge might then suspend the imposition of sentence. i After further discussion, Councilman Halsey moved that. Council, ;j ;repeal the reward ordinance which in currently in effect pending a legal opinion from the City Counselor. He confirmed that the intent: of thin motion is to allow the City Administrator some flexible scale in the reward system, but thin is to be held off !� iluntil an opinion on the fines in received. Motion seconded by Councilman Hequembourg and carried. { - Charles E. 'The next item of discussion was the naming of the new transit/ ' Robinson Icentral maintenance facility. Councilman Halsey moved that the Mainten. new facility be named after Charles E. (Lefty) Robinson, who Facility dedicated over fifty years of volunteer service to the promotion I yof equal rights for minorities and who helped improve the quality 1 . 'Gof life in Jefferson City. Service When asked the purpose of this bill .MvunPdttarfield replied that in the past we have had an agreement with Weatherby to allow them to place advertising sign boards on city property. First , , it was allowed on city right-of-way and, secondly, a city is not `i allowed to lease its property for advertising purposes . The contract will be terminating soon and it allows for a thirty day notite.:of termination. This contract deals with three signs and li i it is not known how many signs in the city are placed on city l property. Afterifurther discussion, Councilman Halsey moved that this bill be placed on the Informal Calendar. Mr. Porterfield was then requested to prepare a written memorandum on this subject matter and Tom Benton was asked- to research other advertising 1 contracts , if any, and to provide Council with a memorandum. . Councilman Scheulen moved the Council accept i! the three items on his proposal and proposal #1 on item #4 related ; to rates. I I 330 REGULAR COUNCIL MEETING, September 7, 1982 Councilman Borgmeyer expressed his concern over lack of action Vicious regarding Isiiirrecentlryipsasedi vicious animal ordinance and cited two Dogs instances (Canale & Graves) where he felt stricter compliance with the ordinance was called for. Tom Benton stated that the first step in the administrative 1 proceds was to file a written complaint. Pemmedntninvolved in both casesHavd been notified either by telephone or in person of this 11 requirement. Mayor Hartsfield stated that if the problem of dogs at large 11 did not ease, he was recommending the Police Department and Police Reserves be used to 'mirk in conjunction with the Animal Control department by radioing locations of loose animals . Mr. Porterfield reported that an ordinance was not required tolTermination give notice of cancellation of agreement with Weatherby Posting kof lease -- Service. Councilman Hequembourg moved that notice be sent to Weatherby Weatherby Posting Service boiiueying the Council' s intention to Posting cancel the lease on the three billboards in question. Councilman Service Halsey seconded the motion and the motion carried. Mayor Hartsfield discussed two letters he had received from Citizen pit*sbnsattorn*y• representing citizens who had talked with staff Complaints from the city at least twice and not received a satisfactory re- sponse.
