A quorum was declared present. 1' i ..—: ' Presentation ' Mayor Hartsfield presented a key to the City to Stan Pealer, who I :, Key to the ' has recently been elected National Commander of the D.A.V. Mr. 1 , City. Pealer responded with thanks to the Mayor and Council and citizens . , :.:-c-: • • , Receipt of Mayor Hartsfield then received a check in the amount of $ 79 ,021 . 00 Check for from Mr. T. H. Mayberry, a federal check in payment of fifty per =s- s Transit cent of the loss occasioned in the operation of our Transit System, . System. which is the first such payment received by the City. This re- presents the period November 6 , 1978 , to October 31 , 1979 . These ' funds are administered by the Missouri Highway and Transportation 1 Department. Mr. Mayberry complimented the City on the Senior . ,.. Citizen Pass , which is sold for $1 . 00 , and stated he hoped it , ' would be an example for other cities around the country. 1 , *- Opening of ' The following bid was received for the gates and operators at - , bids . Later In the meeting they reported back and recommended the acceptance of the bid of Loethen Oil Company , Inc. Councilman Whitecotton made the motion that we accept the ' if bid of Loethen Oil Co. , Inc. , in the amount of $9 ,841 . 50. Motion seconded by Councilman Cruder and passed. Public 1: Mayor Hartsfield then called for the Public Hearing on Cable Tele- hearing - 1, vision. Cable Tele- il Mr. John Hendren Attorney for TCI Cablevision, and Mr. Bob vision. 11 Collett, Manager of the local office, presented their position • I and agreed to answer any questions from the Council or citizens . v Councilman Prenger presented a petition , with approximately • 1 ninety-five signatures , mostly residents of the High Rise, re- . questing that Channels 2 , 8 and 10 remain as they are now. They also feel that the reception should be improved before the in- ' crease is requested and granted. , City Attorney Graham questioned Mr. Collett , regarding in- _ formation about the mid-ban channel availability. He responded 11 that the Company plans to have a mid-ban head-in, here within q sixty days , running a test on the System to see what can be carried • IF Mr. Graham also inquired as to whether or not there would be 11, any opposition to a Consultant , which the City might hire, coming ri in to investigate the service. Mr. Collett stated he would have II to have permission from the Denver Office but could get it by phone if he knew the name of the party who would make such in- • 1 vestigation. I . , II . Regular Council Meeting,_ September 2 1980 ( Mr. Bill Meyer and Mr. Mark Reed made inquiries and discussed service. Dr. Andrew Giuliani complained lained about the service.p III Juanita Muck objected to the removal of Channel 9. Rael Amos made inquiries and referred to the pre-empting after programs had been advertised. He also inquired about payments made to the TCI Company and Mr. Collett stated they received no payments from the Companies ; but in turn they were paying the Companies to carry the channels , for certain ones. Mr. Collett stated that about seventy per cent of the homes in Jefferson City subscribed to Cable Television. Mr. Amos felt that the Television Company was not meeting all require- ments of the original contract and if they could not furnish the service as desired, we should consider asking for other bids when , lltheir present contract expires . Mr. Russell Rinklin discussed the matter of programming - certain programs are advertised and then pre-empted for other local : programs. At times he has made telephone calls about the matter and sometimes they would be cleared up and advertised programs re- " ' turned to the network, but they had determined that the System is a low-budget operation. He suggested we leave the contract as it now { is until the expiration date and then get the benefit of all good services that arc available. Mayor Hartsfield reminded the Council that the present Franchise ! with TCI Cablevision expires in April of 1981 , and concluded the ; Public Hearing on the matter, which can be discussed further at the 'I ' next Council Meeting on the 15th of September, 1980 . S Mayor Hartsfield then called on Ron Forck who had requested a few Presentation ; minutes to present protests from the First Ward. to reconsider ., Mr. Forck stated he was a resident of the First Ward and was McCarty St . 4 Olere tonight with a group of people from that Ward who had come to Clark Ave . fl a lack of representation that the citizens of the First Bills . !i Ward had been receiving from the Council , which was quite evident at the last meeting when the Council chose to ignore petitions with approximately sixteen hundred signatures , some six hundred from the }} First Ward, and voted in favor of four Bills which affected the ! McCarty Street project . 'I' ale re asking that the Council reconsider your stand on these four Bills in light of the six hundred residents poi* the First Ward , in what they have asked you to do. Mayor Hartsfield thanked him for h i s presentation and the residents of the First Ward for their appearance. Mayor Hartsfield presented the minutes of the Council Meeting of !Approval of August 18th. Councilman Cruder moved such Minutes be approved. minutes. Motion seconded by Councilman Wade and passed. The minutes of the Board of Adjustment , Park Board , Environmental Minutes Quality Commission, Airport Commission, Annexation Committee and filed. Census and Redistricting Committee , were received and filed. Mayor Hartsfield then introduced Mr. Fred Lafser, Director of Missouri Department of Natural Resources , to give a report and update on the Missouri River Commission and may want a little support from the 1 Council. 1' Mr. Lafser had a map showing the Missouri River and the land f Missouri ladjoining, where the Missouri Pacific Railroad tracks are and the f Riverfront boat ramp which is presently in use. Commission The original charge the Council had given was to develop a Report. plan for the improvement of the Missouri riverfront in the Jefferson City area, search for funding sources , and resolve the use and operational problems at the present railroad track crossing. The Commission has met several times and decided they needed a long term plan, but also a short term plan to show the citizens some progress ;' and before any plans we would have to have public meetings to get some idea about the main interest in the community, whether it be simply in the boat access , or further with trails , picnicing, and even in commercial development. li ( I� ti iI 4 :3 S Regular Council Meeting , September 2 , 1980. is , The main problem, of course , at this time is the crossing of the railroad tracks , and there is the key question of who owns the property at the crossing. In 1820 the whole area from Riverside ,{ Park to south of the bridge was given to the State of Missouri by the federal government for the purposes of establishing a State Capitol. The records from there on could not be found but in 1890 the Railroad was given a Deed by the City, from Wears Creek towards ', ii the bridge, for the property in question. We are still researching, to see if the property was ever given to the City to give to the Railroad. The Railroad contends they own the property. The terms of the lease with the Corps were for governmental purposes and not for general public purposes and with any violations! ;( of that there is a provision that the Railroad can cancel on thirty;' days notice, which would eliminate essentially everything we do I have at this time. f The Corps has a lease on approximately one acre , where the boat ramp is located, and there is another acre or two adjacent ;; to that which is usable. The Commission feels it is now time to approach the Railroad with a proposal to purchase - we are not certain the Railroad will ' k be interested in discussing that - but from the Commission ' s stand- point we have no authority to speak for the City , so would like to know how how far the City would like to go in terms of purchase of the property. 1 Mayor Hartsfield then stated that he and Mr. Lafser would like to know how the Council felt about the matter - if the City pur- chased the land, the Conservation Commission has stated they would purchase it from the City, but would not be interested in the con- demnation proceedings and such. Mr. Ted Herron of the Housing Authority stated such property << has not yet been appraised and he thought the Housing Authority r could have it appraised as necessary to the Capitol West Project and he could have this appraisal at the September 15th meeting . Discussion was had about the St. Charles project and Mr. Lafser 111 agreed to have information about that and any other community in # ;' Missouri with such projects , for the September 15th meeting. i, Burning Mayor Hartsf eld stated he and the Councilmen had received a letter Garbage and from Mr. Bartow on West Main Street concerning burning of garbage Trash and trash, creating a nuisance - I have asked Gary Hamburg to re- j dsearch this and see if any additional Ordinance language is needed ;j r or whether the language is alright but no enforcement . They wanted to know if we would be interested ' Columbia in a dinner, which they would host , of the Chamber Board there and Invitation. the Chamber Board here and Mayors and City Councilmen of both cities. Mayor stated he had tentatively accepted and the date would be con- sidered later. Mr. Wattenbarger distributed copies of the proposed Budget . The ;! 1981 Public Hearing will be held on September 1Sth and Councilman Brant ! Budget will set his schedule for reviewing it with the Department Heads . { 1Mayor announced that the date had been set for the dedication and Dedication iopen house of the Thomas E. Councilman Prenger made the motion that we authorize Gary Hamburg to set up a panel to solicit proposals from competitive engineers on the concept of the project. Motion seconded by Councilman Wade. Councilman Borgmeyer called for a Roll Call Vote, which was as follows : Councilmen voting Aye: Hequembourg, Pronger, Wade and Whitecotton. Councilmen voting Nay: Borgmoyer, Brant, Grader and Kliegel With the tie vote the Mayor cast an "Aye" vote to pass the motion. Councilman Borgmeyer brought up the subject of closed meetings Closed with the Union on labor matters . Mayor stated that the arrange- Meetings i ment was a bit different this year - Mr. Hamburg would Chair the Labor MstterS Committee, the Committee will be the same for both the Public 1 Works Union and the Fire Department Union. The Committee will include Chief Rennick and Mike Bates , but as you know they cannot approve anything, their action will be subject to the approval of the Council. Councilman Borgmeyer made the motion to adjourn. •
