REGULAR COUNCIL MEETING, AUGUST 21, 1989
A Regular Council Meeting of August 21, 1989, was called to order at
; 7:30 P.M. with Mayor Louise Gardner presiding.
Prayer was offered by Councilman Jim Woodman.
The following Council Members were present:
Present: Davis, Feldman, Gordon, Haake, Halsey, Mason, Owens,
Scheulen, Veile, and Woodman.
Absent: None.
A quorum was declared present.
PRESENTATIONS FROM GALLERY:
Mayor Louise Gardner presented a proclamation to Mr. David Franta
proclaiming September 24 , 1989, through September 30, 1989, to be
' National United Way Week.
Mr. John Hequembourg, 3000 Country Club Drive, introduced other
members of the audience who were wishing to address the Council
concerning Bill 89-53 . Mr. Hequembourg informed the Council that
this bill was a combined effort on the part of many different Boards,
Commission and Committees of the city. Mr. Hequombourq said he would
sum up the remarks of the individuals at the close of their
presentation.
Mr. Sam Cook, Central Trust Dank, urged passage of the sign
ordinance, stating sign proliferation soon becomes sign clutter.
Mr. Cook said it was the desire of the many members of the Boards,
Committees and Commissions to beautify our City and the result of
their efforts was Bill 89-53 .
Ms. Betty Jo DeLong, informed the Council she had been one of the
first members of the Environmental Quality Commission and that one
of their first projects had been billboards. Ms. DeLong stated it
was important that we remember that we are the Capital City and have
an obligation to keep our City beautiful for the many visitors who
visit our City.
Mr. Bill Beck, 1610 Greenberry Road, addressed the Council as a
member of the Environmental Quality Commission. Mr. Beck stated that
the Commission had endorsed Bill 89-53 at their meeting of July 27,
1989, and recommended that Section 3-5 and 3-6 be adopted as written.
Mr. Dave Lankford, 1911 W. Main, informed the Council that he had
served on the Committee that first drafted this bill and urged its
passage and approval.
Mr. Hequembourg informed the Council that this was not just an
ordinance dealing with billboards, but with all types of signs. Mr.

Hequembourg stated this was a combined effort between the Housin
Authority and the City of Jefferson. Mr. Hequembourg informed th
Council that there had been many compromises on all sides and urge
the passage and approval of this bill.
Councilman Scheulen asked Mr. Hequembourg if anyone involved in th s 1
outdoor sign industry had been notified of these meetings. Mr.;
Hequembourg stated the meetings had been advertised and posted, but
that no special interest groups were specifically invited to
participate.
After further discussion, Mr. Charles Callison, 403 Castle Drive,;
read a statement to the Council urging them to approve this bill . 1
Mr. Callison informed the Council he is a retired conservationist!
and that the City of Jefferson is a very scenic and picturesque city'
and urged the Council to keep it that way by passing this bill .
Mr. Bill Todd, Katy Jane 's Gallery & Gift, 122 High Street, addressed'
the Council in opposition to Bill 89-53. Mr. Todd stated he had aI
sandwich sign to advertise his business and that when he had the sign
designed, he purposefully had one that would blond in with the;
historical style of the downtown area. Mr. Todd stated that while;
the City used the argument of liability as a reason to prohibit;
sandwich signs, it would be his insurance company that would be,
assessed the liability, not the City. 1
CONSENT AGENDA:
The Consent Agenda consisted of the following items:
a) Council Minutes of 08/07/89
b) Monthly Financial Statement - July 1
c) Approve payment of $23, 060 to Energy Masters Corporation ante
terminate contract authorized by ordinance 11209 it
Councilman Haake asked why the City was wishing to terminate the'
contract with Energy Masters Corporation. City Administrator Dave
Johnston stated that the Corporation had proposed the contract rung
for longer than the City had desired. Mr. Johnston stated that th
City had received sufficient benefit to proceed on its own and coul•I
terminate the contract at this time. Councilman Feldman move•'
approval of the Consent Agenda. Councilman Haake seconded the motiol
and it was approved.

Mayor Gardner announced the following minutes/reports had bee
received and were on file in the office of the City Clerk.

' Monthly Reports
ANNOUNCEMENTS BY MAYOR:
Mayor Gardner announced her intention to appoint the following to
various boards and commissions:
Transportation Commission - J. Kent Lowry, term to expire 1990
Planning & Zoning Commission - Karen Keeney, term to expire 1991
Mayor Gardner announced the City had obtained bids to change the area
that had housed the pictures of the Clark family into display cases.
The Mayor stated these cases would be available to display
memorabilia for the City.
Mayor Gardner announced that representatives of the I.S.O. are going
to be in Jefferson City for the next three to four weeks to review
our fire protection and water company facilities. The fire hydrants
will be tested for capacity and pressure in September. The residents
and water users should be aware that the water may become cloudy or
discolored durinr, testing.
Mayor Gardner announced the Chamber of Commerce will give a quarterly
report to thc Council on September 13 at 7 : 30 a.m.
Mayor Gardner reminded the Council that the first meeting in
September has been changed to Tuesday, September 5, due to Labor Day.
The Mayor announced the Council would be having their photograph
taken at the September 5 Council meeting.
Mayor Gardner announced the City budget has been prepared and
reviewed by the Mayor. Mayor Gardner announced the budget will be
distributed to the Council at the September 5 Council meeting.
Councilman Scheulon, Chairman of the Finance Committee, announced
that the Council would be meeting to review the budget on September
7, September 11 and September 14.

Calendar and considered for approval at this time.
Councilman Veils stated there were a lot of good reasons for the
passage of this bill, but he did feel that there were a couple of
amendments which he would like to propose. Councilman Veile moved
that Bill 89-53 be amended as follows:
a) Delete the last sentence in Section 3-5 (9) , which reads:
This prohibition shall not apply to temporary political signs.
'' b) Amend Section 3-6 (d) (2) by changing "shall not exceed thirty-
two square feet. . . " to "shall not exceed eight square feet. . . "
c) Delete subsection (d) (3)of section 3-6.
Councilman Voile stated he did not feel that political signs should
be allowed on City right-of-way and that the size of these signs
should be limited. Councilman Gordon seconded the motion.
Councilman Halsey stated he did not feel that the Council should
limit the size of signs individuals place in their private yards.
Councilman Feldman stated he agreed with Councilman Halsey and did
not feel that political signs should be limited.
After further discussion there was a call for the question. After
A voice vote approving the calling for the question, the Council
requested a roll call vote on the amendment. The amendment was
approved by the following vote:
Aye: Davis, Gordon, Hooke, Mason, Scheulen, Voile and Woodman
Nay: Feldman, Halsey, and Owens.
Councilman Scheulen stated that this bill in its present form made
no provisions for permanent signs for such places as apartment
complexes, etc. , where name and phone number were an essential part
of the business. Councilman Scheulen moved to amend Bill 89-53 by
amending Section 3-12 (b) (4) (d) to read as follows:
d. Certain on-premise signs. On-premise signs in residential
districts may be permitted by the Board when the Board grants
a Conditional Use Permit for a commercial or industrial use. .
On-premise signs in multi-family residential districts may be
permitted by the Board when plans and specifications are
t submitted and approved by the Board. Procedures to be
!, following and the authority of the Board with respect to such
21 signs shall be as specified in Section 32-80 (h) (4) a. 3 . of
�� the Jefferson City Code of Laws. No Board of Adjustment
filing fee shall be required for applications submitted for fi
sigh approval under this sub-section d.
Councilman Mason seconded the motion. Councilman Veile questioned
if a filing fee was required by others when coming before the Board

of Adjustment. Planning & Code Enforcement Director Tom Bento
stated that there was normally a filing fee. Councilman Veile state 1
he did not feel that this should be waived. Councilman Scheule
stated he did not have a problem with requesting this fee and amends
his motion by deleting the last sentence. Councilman Mason seconded
the revised motion. After further discussion, the motion wad'
approved with Councilman Veile casting the only dissenting vote.
Councilman Haake asked the City Administrator Dave Johnston if thd'
City had given anyone from the outdoor advertising industry a chance, is
to meet with staff and respond to their concerns in this bill . Mr. .
I Johnston stated there had not been any meetings. Councilman Haake
stated he felt the City could be forcing the problem out in the
County where they would have no control over the billboards. ;
l Councilman Haake stated he would rather see them continue in the City:
with some restrictions, than to force them outside the City where
they had no control.
Councilman Owens stated the she had talked with individuals involved;
in the outdoor sign industry after the public hearing, but that she
had not been contacted by anyone in this industry for the past fele?;
weeks.
After further discussion, there was a call for the question. The
call for the question was approved by voice vote with Councilman'
Scheulon casting the only dissenting vote. Bill 09-53 wan read third'

Councilman Owens requested this bill be removed from the Informa

Councilman Owens stated she felt this was a natural process and sh
recommended the Council approve this ordinance without amendment
Councilman Veils stated that there had been a lot of input into this
bill from the neighborhood meetings and the public hearing that has,

by Councilman Feldman.
Councilman Veile stated that development in this area was coming
and that annexation would happen sooner or later that the City should
get ahead of the problem.
Councilman Haake stated that these reasons would apply to Lakewood
and Wren's Lake also.
After further discussion, a roll call vote was taken on the
amendment. The amendment was approved by the following vote:
Aye: Davis, Feldman, Gordon, Mason, Voile and Woodman.
Nay: Haake, Halsey, Owens and Scheulen.
Councilman Halsey stated he did not feel this annexation was good
for the City or for the proposed area. Councilman Halsey stated he
felt the Council should not have relied upon staff's recommendation
but obtained an outside Consultant. Councilman Halsey stated he felt
the City was piece-milling with this annexation and that we should
take care of the problems in Cedar City before annexing other areas.
Councilman schoulen requested Councilman Halsey give specific
examples of problems in Cedar City, as he has boon told there are no
problems over there. Councilman Halsey cited the need for coda
enforcement and improvements.
Councilman Owens informed the Council that some of the reasons
Councilman Halsey gave for not annexing wore some or her reasons for
annexation. Councilman Owens stated that with some of the area being
sparsely populated, it allowed the prevention of code violations and
avoided the need to correct problems in the future.
Councilman Haake called for the question. This was approved by a
voice vote. Bill 89-55 was rend third time by title, placed on final
passage, and passed as amended by the following vote an Ordinance No.
11289.
Aye: Davis, Feldman, Gordon, Haake, Mason, Owens, Scheulen, Voile
and Woodman.
Nay: Halsey.
Bill 89-70, sponsored by Councilman Feldman, entitled:
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING SECTION 5-
20, CHAPTER 5 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI,
PERTAINING TO EUTHANASIA OF ANIMALS AT THE CITY ANIMAL SHELTER.

Councilman Feldman requested this bill be removed from the Informal
Calendar and the bill that was distributed in the Council packet be
substituted for the current bill. Councilman Feldman stated that
this amendment would give the veterinarians a broader choice for the
euthanization of animals than the current bill. Councilman Feldman

stated that the Animal Rescue Advisory Commission had reviewed this
bill and were in favor of it, however, there had not been a quoru
present at their last meeting and they could not make a formal motio
to this effect. After some discussion, the question was called fo
and voice vote approved the calling for the question. The amendmen
was unanimously approved. Bill 89-70 was read third time by title,
placed on final passage, and passed as amended by the following vot-

UNFINISHED BUSINESS:
Councilman Gordon asked Mayor Gardner if she had written the letter=
to the representatives concerning possible legislation for th-
regulation of cable television. The Mayor said the letters were i
the process of being written, but she was waiting for som-
information that was to be forthcoming.

As there wan no further business to come before the Council,
Councilman Halsey moved the mooting adjourn. Councilman Gordo
seconded the motion and it was approved. The meeting adjourned a
approximately 9:49 p.m.
