HomeMy Public PortalAbout19840820 .180 REGULAR COUNCIL MEETING, August 20, 1984 A Regular Council Meeting was called to order at 7: 30 P.M. with Mayor Hartsfield presiding. Prayer was offered by Councilman Borgmeyer. The following Council Members were present : Present : Borgmeyer, Davis , Gordon, Haake, Halsey, Hequembourg, Huffman, Kliegel and Nelson. Absent: Viessman. Mayor Hartsfield stated that if there were no objections he would like to receive the audit report at this time so Mr. Evers would not have to wait until it comes up on the agenda. The Council asked Mr. Evers to give an overview of the audit instead of going over every page in detail. After Mr. Evers ' report, Councilman Haake stated that he wished to make a motion that an ordinance be prepared authorizing Lege and Evers to prepare the City's next audit. Councilman Halsey stated that he felt staff acted without consideration of the Council in sending out RFP's . He felt the same thing had occurred with the Binder Lake road paving bill and that the Council found out about the error in the bill after it had been acted on instead of before. Mayor Hartsfield stated that if the Council had not suspended the rules and voted on it in one meeting the error may have been caught. Also, that the supplemental appropriation bills will be scrutinized more closely now that the gross receipts revenues have been cut . Mayor Hartsfield stated that I2FP's have already been sent to auditing firms, and that if Logo and Evora are interested in the audit they should submit their bid; he also stated that Mr. Haako's motion was out of order because the subject matter included does not appear on the agenda. Councilman Davis asked Mr. Porterfield's opinion on the matter, to which he replied that according to the Sunshine Law, Mr. liaake 's motion is out of order and cannot be acted upon unless it first appears on the agenda. Councilman Davis then moved that no interviews of auditing firms be performed before the next matter is settled with the Lage & Evers contract agreement, seconded by Councilman Halsey, and approved. The next item of busines was the Consent Agenda, which included Council Minutes of August 6, 1984 . Councilman Haake moved the Consent Agenda be approved as presented, seconded by Councilman Kliegel, and approved. Mayor Hartsfield announced that the following minutes have been Y 9 received and are on file in the City Clerk's Office: Planning & Zoning Commission, 8-9-84 ; City Cemetery Board, 8-13-84 ; Parking & Traffic Commission, 8-9-84 ; Airport Commission, 7-24-84 ; Liquor Control Board, 8-6-84; and Police Personnel Board, 8-14-84 . The next item of business was the introduction of bills . Councilman Halsey stated that he has questions regarding the steps involved in preparing and approving an ordinance before its presentation to the Council, and would like to meet with Mr. Hamburg, Mr. Cox and Mr. Porterfield to have his questions answered. He felt too many errors were being made ' in the information that is being submitted to the Council and the staff should review the material more carefully. Mayor Hartsfieid stated that he feels the staff does not make an inordinante :_ number of errors and that there has been no indication either in open session or closed session that the Council is unhappy with % the 'performance of the staff . Nay: None. The next item of business was a Public Works Report on the Grays Creek Storm Water Drainage problems . Mike Bates recommended that the Council proceed with a storm water project immediately or as soon as possible. The project would cost $50,000 and suggested that the contract stipulate that the City would not be billed until after November 1. Councilman Hequembourg moved that Public Works proceed with the project with the understanding that the bid documents stipulate that no payment will be made until November 1, the motion was seconded by Councilman Gordon, and approved. ' 1 186 Councilman Nelson moved that the Council, in open session, verify that it has waived its attorney-client privilege with respect to TCI Cablevision Inc. v. City of Jefferson, Missouri, Case No. 51-4054-CV-C-W only, and that it has authorized a letter to be sent to its attorneys expressing the waiver, the motion was seconded by Councilman Davis, and approved by the following vote: Aye: Borgmeyer, Davis, Gordon, Haake, Halsey, Hequembourg, Huffman, Kliegel, and Nelson. Nay: None. There being no further business, Councilman Hequembourg moved that the Council be adjourned to Executive Session for the purpose of discussing litigation, the motion was seconded by Councilman Halsey, and approved by the following vote: Aye: Borgmeyer, Davis, Gordon, Haake, Halsey, Hequembourg, Huffman, Kliegel, and Nelson.
