HomeMy Public PortalAbout19820816 REGULAR COUNCIL MEETING August 16, 1982 i The regular Council meeting was called to order. at 7 : 30 p .m. with _, ' ,, Mayor Hartafield presiding. ;: Prayer was offered by Rev. Rudy Beard, First Presbyterian Church. Councilmen present : Blume, Davis , Gordon, Halsey, Kliegel, Lock, ' Roll Roark and Scheulen. Call. Councilmen absent : Borgmeyer and Hequembourg. } A quorum was present. Mayor Hartafield announced that the Resolution R82-20 would be R82-20 the first item of business discussed. _ Urban Robert Hyder, legal counsel for the Housing Authority, appeare. ' Renewal I and stated that this Resolution is required by rules of HUD to j' enable the Housing Authority to close out their twenty year con- tract. By their regulations HUD is requesting the city to execute =. the resolution authorizing the termination of thiz:contract. There will be no obligation on the part of the city to pay back any monies whatsoever. The Housing Authority will continue until the land is sold and the improvements which they have planned to ! make are made. Upon motion by Councilman Halsey, seconded by Councilman Davis , Resolution No. R82-20 was adopted. Consent The next item of business was the Consent Agenda which included Agenda Council.:minutes of August 2, 1982 , Administrator' s report , finance report, audit report and awarding the following bids : #234: Descaling Compound - Public Works G. In the Council minutes of August 2nd , that 1 Resolution title also included Rdmodda and Buena Vista streets . ' Mike Bates stated that the information contained in the minutes was correct , however, the ordinance to pave will only contain Hamlin Street , with Edmonds and Buena Vista being eliminat• � I. A financial report was presented to the Council showing a nine Financial = .- '' I month history of the city's fiscal yearl The City Administrator Report. k and Department Heads were commended for controlling expenses durin: the first nine months of this fiscal year. • IThe next item for discussion was the solid waste franchise. The purpose of the discussion was to give direction to city staff in order that a final contract could be prepared for council' s ap- Solid ;';i proval. Waste. , The first item was the length of the proposed contract. The ; . proposed contract currently runs twelve years which is tied to the f the present landfill. However, some of the Council felt .; twelve years was too long to grant the contract and upon motion by , Councilman Halsey, seconded by Councilman Roark and carried, the ra:. length of thecoottract was changed to five=years . The next item of discussion was the number of weekly col- a' lections. The proposed contract currently calls for once a week :7 pickup in dxchan a for no rate increase for one year. When Naked iothat the rates would be for twice a week pickup for a delve year contract, Mr. Nichols , of ESM, stated that the price ' per bag would be $1. 16. However, this price was based on a 12 year contract and now that the length of the contract had been changed the rates wouldcbhange. I Mayor Hartsfield stated that regardless of what is done , can r; service is going to escalate and he asked if some consideration could be given to the elderly and handicapped who can not afford ° to pay rates for backdoor can service, yet are not able to get the bags to the curb . Mr. Nichols stated that perhaps something could y be worked out. to accomodate those people. After further discussion Councilman Blume moved that we retain the twice a week collection with the price to be negotiated. , Motion was seconded by Councilman Gordon and carried. :,, A discussion was then held regarding the word exclusive used �1 4 in the proposed contract . Councilman Davis naked if the word exclusive would eliminate Central Missouri Junk' a right to expand their business . Mr. Porterfield, City Counselor , replied that , the way it in written now, it is his interpretation that It would prohibit any expansion by companies such as Central Missouri Junk. which currently picks up some trash and separates the recycleable I material from other materials . The non -recycleable materials are then picked up Ey ESM. . Mayor Hartsfield pointed out that while 3 it prohibits the expansion of regular collection of commercial trash, it does not prohibit recycling. Harvey Tettlebaum appeared and stated that this question was litigated three years ago,sand at that time it became clear that it would effectively stop Central Missouri Junk from expanding their business. If you stop someone from expanding their business it puts them out of business and recycling at the source is im- possible. He pointed out that in Section 3 of the proposed contra. the City reserves the right to recover certain recycleable materials as part of its operation of an energy resource recovery facility which would put the City in direct competition with Central Missouri Junk Company. Mppor Hartsfield pointed out that if you are talking about making the recycling business inoperable that is one thing, but if you are talking about trying to grant a monoply franchise, which the City has the power to do, for collection and still have competition, that is not appropriate. You can' t control the rates , service and regulate a company and have an unregulated competitor. After further discussion Councilman Halsey requested a legal opinion from Mr. Porterfield on some of the questions raised during the discussion. Mayor Hartsfield then appointed a Council committee to meet and prepare a draft to be presented at the first meeting in September. " il Councilman Scheulen stated that after conferring with City iI Staff it was determined that the be1dway,eduld beireloeated to the north of Seven Hills Road, and due to various problems with extending city services and the costs related thereto, and since the beltway was the only reaiion for considering this area for annexation, it is their conclusion that annexation would not be necessary at this time.
