REGULAR COUNCIL MEETING, August 15, 1983
Cull to A Regular Council Meeting was called to order at 7:30 P.M. with
Order President Pro Tern Darrel Gordon presiding.
Prayer Prayer was offered by Mr. Gordon.
Roll Cell Council Members Present: Borgmeyer, Davis, Gordon, Haake, - ..
Halsey, Hequembourg, Kliegel, Lock,
Roark and Viessman.
Council Members Absent: None
A quorum was declared present.
Hogan Drive Some citizens who are residents of Hogan Drive were present to ask the
• status of the Hogan Drive project. Mike Bates stated that the number of •
residents in favor of the project has dropped to below 50%, and that at
the present time there are not enough people in favor to proceed with
the project.
Consent The next item of business was the Consent Agenda which included

Councilman Borgmeyer asked for an explanation of Bid 384, Tom Benton
explained the various additions made to the Christy Building which were
not included in the original contract. Councilman Hequembourg asked
about Bid 388 and stated he felt the bid represented too much to spend
on a parking lot. Mike Bates explained the specifications of the parking
lot. Mr. Hequembourg requested that [aid 388 be held over until the
Council has a chance to review the plans. lie requested a summary of
the entire complex , and also information on how much of the lot will be
reserved or metered or sold parking. Councilman Hequembourg moved to
approve the Consent Agenda, excluding Bid 388, the motion was seconded
by Councilman Roark and approved.
P&Z Quorums Councilman Borgmeyer made mention of the fact that the Planning &
Zoning Commission has not had a quorum present at some of their past
meetings.
Councilman Councilman Halsey stated that he wished to reiterate that he does not

Councilman Roark asked Chief Patton if the Police Department takes

lawsuit be presented to the Council for review. Mr. Porterfield stated
that the funds were about to run out and that if the Council did not
amend the contract , he would have to inform the attorneys to proceed
work on the case at their own risk. '

RESOLUTIONS The next item of business was the adoption of Resolutions.
RS83-14 The following Resolutions were presented to the Council for. adoption:
R883-15 RS83-14, Highway and Transportation Grant; RS83-15, Street Lights; and
RS83-16 RS83-16, Arterial and Belt Roadway Policy. Councilman Roark moved to
adept the Resolutions, the motion was seconded by Councilman
Hequernbourg, and approved,
Presentation Mr. Andy Anderson was present to make a presentation from the gallery.
from Mr. Anderson discussed the City' s sewer systems and the history of its
Gallery financing by bonds, and the fact that citizens were informed at that
time their charge would be based on meters.
Unfinished The next item of business was Unfinished Business.

Mr. Ron Prenger was present to answer questions regarding his offer to
r purchase the old City Hall building. Lyn Porterfield informed the
Sale of Old 1 Council that since the building had been advertised once, the City
City Hall would not need to formally take bids again, but could request
proposals. Councilman Hequembourg stated that the building's not being
sold was costing the City money. Councilman Borgmeyer moved that the
City offer the building to Herman's for $240,000. The motion was
seconded by Councilman Roark. The motion was approved by a
show-of-hand vote of 7 to 3.
UE Merger Lyndel Porterfield stated that 20 to 25 cities have intervened thus far
in the UE merger case. He had contacted the lawfirm of Hendren and
Andrae about representing the City at a rate of $100 per hour, and
requested a special council meeting to approve an ordinance granting
the contract. Councilman Hequembourg stated that he did not feel the
City should accept the lawfirm's offer, and moved that Mr. Porterfield
obtain at least two proposals in writing before entering into a contract.
The motion was seconded by Councilman Roark and approved. Mr.

Porterfield was directed to obtain two written proposals, and Councilman
Gordon stated that a special council meeting would be called for

Monday, August 22 to consider the proposals and an ordinance.
There being no further business, Councilman Borgmeyer moved that the Adjournment
Council Meeting be adjourned, the motion was seconded by Councilman
Roark and approved.
