HomeMy Public PortalAbout19870803 (. ; 174 REGULAR COUNCIL MEETING, AUGUST 3, 1987 A Regular Council Meeting was called to order at 7:30 P.M. with Mayor Louise Gardner presiding. Prayer was offered by Councilman Steve Veile. The following Council Members were present: Present: Barnicle, Borgmeyer, Davis, Gordon, Haake, Halsey, Mason, Scheulen, Veile and Woodman. Absent: None. A quorum was declared present. PUBLIC HEARING: The first public hearing was regarding the rezoning of property in the proposed Mall Ridge Addition. There was no one present to speak either in favor of or in opposition to the proposed rezoning. The second public hearing was regarding the rezoning of property near Idlewood Road and State Route C. There was no one present to speak either in favor of or in opposition to the proposed rezoning. PRESENTATIONS FROM THE GALLERY: Mr. Richard Gaffney of 1220 Hoffman Drive addressed the Council regarding utormwator management and flooding problems Hoffman Subdivision has experienced in recent months. Thin area has been newly annexed into the City and the residents are asking the Council to anoint them in solving their problems. Mr. Gaffney informed the Council this flooding was not basement flooding, but first floor flooding. Mr. Gaffney stated they had met and discussed the problem with Mike Baton, Director of Public Works, but wore asking the Council's aenistanco in obtaining a speedier answer to their problems. Mr. John Norris of 1224 Hoffman Drive stated he had pictures he would like to distribute to the Council so they could see the seriousness of the problem in this area. When asked if there was flooding in the area before annexation, Mr. Norris stated there has been flooding in the past, but it is gradually getting worse. Mr. D. Wayne Jones was to address the Council, but stated he had nothing further to add to what had been said. CONSENT AGENDA: The Consent Agenda consisted of the following: a) Council Minutes of 7/20/87 b) Awarding of the following bids: 930 - Firefighter Foam, Fire Department 931 - Bridge Replacement, Jefferson Street, Public Works 932 - Asbestos Removal, Public Works 933 - Sale of Compressor, Fire Department 934 - Generator, Fire Department 935 - PVC/DIP Pipe, Public Works N. 17 o) Appointments to Boards & Commissions Anne Lock - Parks & Recreation Commission (Replace Michael Riley who resigned) Debbie Greeno - Constitution Bicentennial Ad Hoc Committee d) Appointments to Jefferson City Police Department Elizabeth (Liz) Melvin - Communications Operator Michael Dean - Probationary Police Officer Peter Fleischmann - Probationary Police Officer After some discussion, Councilman Haake moved Bid 934, involving the purchase of a generator for the Fire Department, be given to the second lowest bidder, as this bidder was from Jefferson City and the bid was only $2.00 higher than the lowest bidder who was from Springfield. Councilman Barnicle seconded the motion. After further discussion dealing with local preference and the problems that are encountered when you begin deviating from bid policy, Councilman Halsey moved to amend the motion to hold Bid 934 until the next Council Meeting. Councilman Gordon seconded the motion and after further discussion, the amendment was approved by a voice vote with Councilman Scheulen being the only dissenting vote. The Council requested clarification on how the motion now read and this was given by the City Counselor Allen Garner, stating, the motion now reads that Bid 934 will be held until the next Council meeting, at which time the Council will vote on awarding this bid to the second lowest bidder. A voice vote was taken and the motion passed with Councilman Scheulen being the only dissenting vote. Councilman Barnicle stated he had requested staff to prepare a philosophy regarding local preference. City Administrator Dave Johnston stated they had done some investigating and no other city in Missouri has a local preference policy. The ones that did have such a policy found it was not to their benefit and changed ouch policy. Mr. Johnston stated he could prepare ouch a philosophy, but it would come with his strong recommendation not to accept ouch policy. Councilman Barnicle said he would still like the Council to review such a policy. Councilman Gordon moved approval of the Consent Agenda as amended, Councilman Scheulen seconded and it was approved. MINUTES RECEIVED AND FILED: Mayor Gardner announced the following minutes had been received and were on file in the City Clerk's office: Animal Rescue 7/9/87; Planning & Zoning Commission 7/9/87; Parks & Recreation Commission 6/23/87; Senior Citizens Advisory Commission 7/28/87; Bicentennial Committee 5/27/87, 6/14/87 ANNOUNCEMENTS BY MAYOR: Mayor Gardner announced there would be a Constitution Bicentennial celebration on September 17, 1987, in front of City Hall. Councilman Halsey requested this bill be placed on the Informal Calendar. INFORMAL CALENDAR: Bill 07-36, sponsored by Councilman Schoulon, to amend the Code of the City of Jefferson by regulating the amount of noise within the city limits was withdrawn by Councilman Schoulnn. Bill 87-41, sponsored by Councilman Gordon, establishing a curfew for persons under eovontoon was removed from the Informal Calendar to be taken up for passage at this time. After come discussion regarding the enforcement of thin ordinance and the need for education of parents, bill 87--41 was road third time by title, placed on final passage, and paused by the following vote no Ordinance No. 10881. Aye: Borgmeyor, Davis, Gordon, Halnoy, Mason, Voile and Woodman. Nay: Barnicle, Henke, Schoulen. Bill 87-56, sponsored by Councilman Barnicle, regarding the i rezoning of property in the Stadium West Subdivision remained on the Informal Calendar at Councilman Barniole's request. UNFINISHED BUSINESS/NEW BUSINESS: Councilman Gordon stated he would like to have the Mayor meet with the Chamber of Commerce to discuss the Industrial Committee and see what the prospects are to have this Committee reactivated. There was some discussion concerning having the Chamber attend a meeting to discuss with the Council what their agenda is for the coming year. After further discussion, Councilman Gordon moved Mayor Gardner write to the Chamber and invite them to a special meeting to discuss their activities in economic development. Councilman Halsey requested the motion be amended to stipulate this meeting will take place before the August 24 work session. _ I 1 i. Councilman Gordon was agreeable to this and the Council approved by voice vote the amendment to the motion. Councilman Mason seconded the motion and it was approved. `° # # # Councilman Scheulen informed the Council that there had been several occasions when there were situations that were brought to the Council 's attention by individuals which the Council would then discuss in Executive Session. The concerned citizens were never informed of what action, if any, was being taken. Councilman Scheulen stated he understood the need to discuss topics in Executive Session, but felt the Council needed to find a way to keep the public informed of what actions and/or decisions were made in regard to these topics. # # # Councilman Barnicle asked City Administrator Dave Johnston if we have adopted the Administrative Code as referred to in the Charter. Mr. Johnston referred this question to the City Counselor Allen Garner who informed the Council that the City had an Administrative Code in effect at the time of adoption of the Charter. The adoption of the Charter did not change this. # # # Councilman Halsey asked what type of follow -up is being done after concerns are expressed by citizens. After some discussion, the Council was informed that the Mayor or City Administrator usually replied to these individuals, thanking them for their expression of concern and providing them any information that is available. The Council will begin receiving copies of this correspondence. APPROVAL OF EXECUTIVE SESSION MINUTES: Councilman Gordon moved approval of the Executive Session minutes an corrected. Councilman Halsey seconded and it was approved. There being no further business, the meeting wan adjourned.
