jA Public Hearing was held regarding a rezoning request by
Public 1 John Brown to rezone a tract of land containing approximately 4. 5

Hearing , acres lying on the East side of Grant Street from RS-4 to RD. Mr.
Rezoning. �) Brown appeared to answer questions concerning the request. He
is stated he planned to build five duplexes which face Grant Street
and eight off of Bluff Street.
Peggy Waggner, 101 N. Grant, representing nineteen people in
opposition to the request, appeared. She stated the traffic and
i parking were reasons for the opposition. She further stated the
i area has always been zoned single family dwellings and they would
Ilike for it to remain as single family. r.
When questioned about parking spaces for the duplexes, Mr.
Brown replied that he would have to put at least three off street
parking lots for each duplex.
Merle Rasmusson, 110 S. Grant also appeared in opposition to
the request. He stated that when he bought his property, Mr.
Brown's property was zoned single family and the single family
I zoning in the area was why he bought his property.

A Public Hearing was held regarding the City Tax Rate Levy. No
one appeared at the hearing. The total levy would be $1.20 which
the same rate as the previous year. Councilman Borgmeyer Public
questioned the drop in figures for personal property, railroad Hearing
and utility assessed valuation and the figures for merchants and Tax
manufacturers which was double. This information was unavailable Levl.
at this time, however, Mr. Uffman will check with the County and
a memo will be provided to the Council.
Mayor Hartsfield appointed Mark Towner to serve on the Appointment
Airport Commission. Councilman Borgmeyer moved that the appoint-
ment be confirmed. Motion seconded by Councilman Wade and passed.
Mayor Hartsfield appointed Dr. Nathan Cook to serve on the
Environmental Quality Commission. Councilman Wade moved that the Appointment
appointment be confirmed. Motion seconded by Councilman Blume
and passed.
Mayor Hartsfield then discussed the street overlay program.
The Committee has reviewed the program for this year and has Street
approved it with one exception, that being Hobbs Lane. The Overlay.
Council was provided additional information by Mike Bates regardin,
this. Larry Bates stated that the next step would be to advertise
for bids on the rota-mill and overlay. Councilman Borgmeyer
stated that although the Committee realized Hobbs Lane was in bad
4 shape, the majority of the Committee felt that we have never made
a policy to overlay streets that are not public thoroughfare and
which do not have curb and gutter.
Councilman Brant felt that the City should not veer from
policy. He stated the property owners were contacted last year
to pay $2. 50 a front foot to curb and gutter the street and they
refused. Why should people in parts of the City pay $7. 50 a
front foot to curb and gutter a street to got overlay when they
can see other places in the City whore the streets were overlayed
without curb and gutter. He felt the City should either stay
with current policy or the policy should be changed.
After further discussion, Councilman I3orgmayer moved that we
proceed to advertise for bids excluding Hobbs Lane and that the
residents of Hobbs Lane be contacted. Motion was seconded by
Councilman Blume and passed.

Councilman Hequembourg requested that this Bill be placed on

Councilman Hequembourg requested that this Bill be placed on

A Resolution was presented for Street Lights between 812 and Resolution
900 Rock Hill Road. Councilman Hequembourg moved that the Reso- liStreet Light

The next item on the agenda was a discussion of the preli-
minary !,
design for the Riley Lot Parking Facility. Mr. Roger ! Riley Lot
Verslues spoke and presented a drawing for the facility which is Parking
the same basic layout plan that was approved as a preliminary in Facility.
1978. The plan calls for fifty-two spaces on the ground and first
level and forty-five spaces per floor on the two upper levels, for
a total of one hundred ninety four spaces for the four levels.
The ground level would have an entrance exit off of Capitol Avenue.
The next level would have an entrance exit on Commerce Avenue or
the alley and the upper two floors would entrance and exit off of
their individual decks. There will be no access from floor to floo
inside the building.
The ground floor would remain permit parking. The first r'
level would exit off the alley and it is proposed by the Parking
and Traffic Commission to be metered parking. The other two levels
would be either short term or long term parking as decided at that
time. The attendant at the booth would handle all floors so no
additional personnel would be needed.
Three systems of building the facility were presented, however,
it wan the recommendation of Mr. Vernluen that we proceed with
System I which in peered in place concrete with the option of post
tension, depending on the final design.
The cost for the total structure would be $733,000 and we
currently have $500 , 000 in the Parking Fund. However, we will
proceed with the ground and first level at this time and proceed
with the upper levels at such time an the need arisen.
After discussion, Councilman Hequembourg moved that we pro-
coed with the recommendation of System I for detailed planning.
Motion was seconded by Councilman Blume and passed.
A statement for legal services from Harvey Tettlebaum was
presented for payment. Councilman Wade moved that the statement b Legal Fees
paid. Motion seconded by Councilman Hequembourg and passed with Statement
one opposing vote.
Edmond Taylor, of 729 Walsh Street, and Mrs. Distler, of 731
Walsh Street, spoke to the Council regarding problems they have Pile
experienced regarding damage to their property and their street. on Walsh
Mr. Taylor stated there are sink holes in the street and their Street.
basements have been flooded due to the heavy rains. Mr. Taylor
stated he felt the damage was caused by the sewage or drainage
lines corroding. He further stated that temporary repair work
was done on the street, however, there are still holes in the

Mr. Hamburg stated that Mr. Bates and Mr. Utterback, the
City Counselor, are looking into the claims of both property
owners and will provide a report to the City Council on the
situation.
Larry Bates stated it was a sanitary problem. There was a
leak which they dug down and fixed and later the storm sewer gave
way which was built out of fifty-five gallon barrels which did
hold up for a good long while. The fire department did pump it
that Saturday morning. He then stated they went in and tried to
dig down as far as they could reach on Sunday morning and more
machinery was brought in through a contractor the first part of
the week which hooked on to the existing pipe and 30-40 foot of
new pipe was put in, which has relieved the storm drainage
problem temporarily.
Mayor Hartsfield suggested that Mr. Pollock, of the Housing
Authority, and Mr. Bates view the site and requested that the
Council be provided with a full report at the August 17th meeting.

Hearing Theresa E. Slicker to rezone three tracts of land lying in the
Pezoning. 1300 block of Southwest Boulevard from RS-2 to C-0. Mr. David
Brydon appeared before the Council to answer questions regarding
the request. No one appeared in opposition to the request.
