REGULAR COUNCIL MEETING, JULY 17, 1989
. �.y•' A Regular Council Meeting of July 17, 1989, was called to order at
7.30 P.M. with Mayor Louise Gardner presiding.
` Y >;'• �,! Prayer was offered by Councilman Kyle Mason.
The following Council Members were present:
Present: Feldman, Gordon, Haake, Mason, Owens, Scheulen, Veils, and
Woodman.
Absent: Davis, Halsey.
A quorum was declared present.
Mayor Gardner introduced Dr. Chris Straub, the new Superintendent of
Schools for the Jefferson City School system.
PUBLIC HCARING:
• The first public hearing wan to discuss Bill 89-53 - Sign Ordinance.
Mayor Gardner announced that both sides would have thirty minutes to
express their• views.
Ms. Janette Dolan of Price Outdoor Media addressed the Council in
oppouition to the sign ordinance. Mu. Dolan stated her company had
a largo number of the u.ignu in the area across the river ( formerly
known an Cedar City) and thin wan a very lucrative side of her
business. Ms. Dolan stated that acquiring the permits for thin area
had been a very lengthy process and had been done before the bid
letting by the State. Ms. Dolan informed the Council that there were
eleven outdoor companies doing business in Jefferson City and four
of those were based in the City. Mss. Dolan informed the Council she
would like an opportunity to sit down with the Council and the
Commission and discuss this ordinance.
Councilman Voile asked Mo. Dolan to explain the term she had used
"bid letting" . Ms. Dolan stated that the state had upgraded the
status of the highway area around the bridge. The new status would
mean that billboards could be placed only every 400 feet, not every
100 feet. Ms. Dolan stated she had obtained all of the permits for
this area before the upgrading. Ms. Dolan stated she had only
obtained eight extra boards in this area, as she had lost some with
the expansion of the bridge. Councilman Scheulen asked if Ms. Dolan
had not obtained the permits when she did, if should would have had
to placed them every 400 feet. Ms. Dolan answered in the
affirmative. I

Councilman Veile also asked Ms. Dolan if there were any Missouri
cases pending challenging this type of ordinance. Ms. Dolan stated
that none had been tried, but there were cases filed in St. Louis.'

Councilman Feldman stated that he felt billboards was an area that
needed to be regulated as the public had no control over what they .
had to see on a billboard. Councilman Feldman stated that the # v
'r- billboards by the bridge are going to be the first thing that

visitors to the city see and that will be their impression of

4 Ms. Dolan stated they were very particular about what was placed on
their billboards and very particular about type of billboards they 1 (t
constructed. Ms. Dolan stated they were also concerned with the 1

impression the public has of Jefferson City. II

Councilman Owens stated she would like to meet with Ms. Dolan and i
others to discuss this bill . i

Councilman Voile asked Ms. Dolan if she felt the market for this type 1,1

of media had been saturated in Jefferson City. Ms. Dolan stated she I
felt it had and that she was not interested in obtaining new signs, ,
but in replacing those that were lost. li
Tom Denton, Director of Planning & Code Enforcement, stated he would
like to correct a couple of incorrect statements made by Ms. Dolan.
. Mr. Denton stated that according to the County Assessor's Office,

there are only rive firms in the Jefferson City area and that the
office in st. Lollit; that is in charge of issuing all nign permits has

Mr. Nick Luetkemeyer the ownet of Luetkemeyer Sign' addressed tho
Council to speak against the sign ordinance. Mr. Leutkomeyer stated
he owns his own bunineus and that they subcontract for all companies

and that outdoor signs provides a substantial amount of their ,
business. Mr. Luetkomoyer stated that regulation is needed and he
would like the opportunity to meet with the Council and discuss this
ordinance. ■
Mr. Lawrence Dietzel , Jr. addressed the Council to speak against
• ,
the sign ordinance. Mr. Dietzel stated he felt it was very important
1 for visitors to the City to be able to able to locate restaurants and
I hotels and the billboards provided this information. Mr. Dietzel ;
stated there did need to be some regulation and that he would like
to see a full time inspector in the aignage industry. 1

Councilman Mason moved approval of the Consent Agenda. Councilman
Scheulen seconded the motion. Councilman Owens moved the Minutes of
the July 3 Council meeting be amended to reflect that Councilman
Davis was absent. The Consent Agenda was approved as amended.

Councilman Mason requested Police chief Gary Kompker explain this
system to the Council . Chief Kempker informed the Council what this
system would do and how it would assist the police officers in
preparing their repot•te;. Councilman Mason moved approval of this
bid. Councilman Schoulcin seconded the motion and it was approved. a:

ANNOUNCEMENTS BY MAYOR:
Mayor Gardner announced the Council had two additional meetings this
week. The Finance Committee meeting on Tuesday, July 18, 1989 and
the Public Hearing regarding the Frog Hollow Annexation on Thursday,
July 20, 1989.
The Mayor announced she has the report of the Highlights of the
Jefferson City School District 1978-1989 in her office if the Council
would like to see this study.
Mayor Gardner announced that Jack Curtit would be replacing Bob
Altice on the Housing Authority Board of Commissioners. Mr. Altice
has moved from the City.
Mayor Gardner announced she had been in receipt of the petition on

the constitutional amendment pertaining to flag desecration. Mayor
Gardner announced that if the Council had no objection, she would
, circulate this petition to the City employees. The Council expressed
, no opposition to this petition being distributed.
Mayor Gardner announced her intent to make the following appointment ,

to Boards and Commissions:

Board of Adjustment - John Willibrand; term to expire November, 1992

Mayor Gardner also announced Councilman Davis has attended two
Council meetings this Council year and has been absent for four in
a row. Mayor Gardner expressed her regret at having to bring this -
to the Council 's attention, but stated that she has received several ,
calls from citizens in that ward who do not feel they are being
adequately represented.
Councilman Voile asked City Counselor Allen Garner what the process
for relieving a member of his office involved. Mr. Garner stated
that the Charter made some provisions for this and the Code of the
City of Jefferson made provisions and that he would give a written ,
explanation of the procedure to the Council .
Councilman Gordon requested that Allen Garner contact Councilman

Davis and see what his plans are.
Mayor Gardner stated that she apologized for having to bring this to
the Council 's attention, but she thought they ought to be aware that
she had boon receivinq phone calls.

The Mayor informed the Council she had requested the City Counselor
to write a review on the appointments of Boards, Commissions and
Committees. Councilman Mason requested that Mr. Garner summarize
his report. Mr. Garner explained to the Council the difference
between legislative committees and executive committees. After much
discussion, Councilman Scheulen moved that Allen Garner be directed
to draft an ordinance change which sets the legislative committees
in a form whereby the Council selects its own committees and chairmen
and also that an ordinance be drafted to change the Cable Quality
Commission to bring it in compliance with the Charter. Councilman
Mason seconded the motion and after further discussion, it was
approved.

Councilman Feldman moved approval RS89-12 which supports
Constitutional Amendment prohibiting the desecration of the flag.
Councilman Mason seconded the motion and it was approved.

Councilman Veile stated he would like to discuss the rate structu �p
for the Public Access Channel with Dan Diedriech. Mr. Vei is
questioned the second and third tier structure and was informed
Mr. Diedriech that this rate structure had been revised and was n•
just a single tier rate structure. Councilman Voile expressed h
concern over charging not-for-profit groups money to use the camer= .
Mr. Voile stated that some groups may not have the funds to pay t
fees required. Councilman Veile stated he hoped the Commission wou
consider not charging for some groups and organizations. Aft:
further discussion, Councilman Voile moved to table this rat
structure until further communication from the Cable Qualit
Commission is received. Councilman Iiaake seconded the motion and
was approved.

Councilman Gordon stated he wished to compliment City Counselor Allen
Garner on the excellent response he prepared in the Capital City
Water Company rate case. Councilman Gordon stated he felt some very
important questions were raised in this response and that he would
like to see the City staff stay on top of this issue.
NEW BUSINESS:
Councilman Haake requested that any discussion regarding the waiving
of CATV service to the former Cedar City area be held until the Cable
Quality Commission had had an opportunity to review the request from
TCI and respond back to the Council. Councilman Gordon stated he
would like to see more than one bid on the costs for providing
service to this area.
Councilman Mascn requested the staff to investigate to see if any
promises or insinuations of service were promised to the residents
of Cedar City at the time consolidation was being discussed.
Councilman Gordon stated that TCI provides service to Holts Summit
and maybe it would be possible to hook into the bolts Summit system
rather than Jefferson City's system.

City Counselor Allen Garner explained a request had been received
for use of the City mural and informed the Council that staff is in
the process of filing all of the paperwork to copyright the mural.
After some discussion, councilman Voile moved to allow the morning
Rotary Club to use the mural or a portion thereof on their banner.
Councilman Owens seconded the motion and it was approved.
EXECUTIVE SESSION:
An there was no further business to come before the Council,
Councilman Voile moved the Council go into Executive Session to
discuss litigation as provided for in RSMo 610.025 (1) , real estate
as provided for in RSMo 610.025 (1) and personnel as provided for in
RSMo 610. 025 (3) . Councilman Gordon seconded the motion and it was
approved by the following roll call vote:
Aye: Feldman, Gordon, Haake, Mason, Owens, Scheulen, Veile and
Woodman.
Nay: None.
ACTION TAKEN IN EXECUTIVE SESSION:

; The third purpose of executive session was to review the annual
performance of Finance Director Bobby Cox. Councilman Haake moved ''
and Councilman Woodman seconded a motion to approve the City ,i
Administrator's recommendation of a two percent meritorious increase
subject to and effective upon the completion of employee evaluations
and the submittal of timely financial monthly reports. Notion failed

on a four to four vote with council members Owen, Woodmen, Gordon and
Mason voting no and Mayor Gardner breaking the tie and voting no
Councilman Haake moved and Councilman Gordon seconded a motion not
to approve any meritorious increase and to review the performance of
the Financial Director in six months. Motion NAM approved.
