Nsixtivirlomr---Call to The regular meeting was called to order at 7:30 P.M. with Mayor " Order Hartsfield presiding. Prayer was offered by Rev. Joseph E. Blair, pastor of the Second Christian Church of Jefferson City. Roll Call Council Members present: Borgmeyer, Davis, Gordon, Haake, Halsey, Hequembourg, Kliegel, Lock, Roark and Viessman. Council Members absent: None. A quorum was declared present. Unveiling of Mayor Hartsfield unveiled the City Seal which had been specially City Beal mounted on wood for the Council Chambers. Mrs. Rebecca Kurtz, who designed the seal was present for the unveiling, along with Mr. Leo Haslag who was responsible for mounting it on wood. Solid Waste Mr. Paul Muldowney, Vice-President of Marketing for Laidlaw Waste Discussion Systems, Chicago, Illinois, was present to answer questions and discuss the possibility of a "mandatory" trash, pick-up for Jefferson City. Mr. Muldowney stated that 99% of the cities serviced by his company were on a mandatory-type system, and that such an arrangement is preferable to his company due to the savings in time and money. Councilman Davis asked for cost information from any other comparable-sized cities. Mr. Muldowney stated that two cities in Texas were operating on a mandatory system at approximately $6.25 per month per customer, and that it was strictly "curbside" service. Councilman Halsey asked if it would be possible for an institutionalized customer (such as Lincoln University) to use its own dump trucks to transport its garbage directly to the dumpsite. Mr. Muldowney stated that he would personally research the possibility and call Mr. Halsey within the next day or two to discuss it with him. Council Member Lock asked questions pertaining to special pick-up arrangements for handicapped customers, limits placed on customers as to amount, types of garbage, etc. After Mr. Muldowney answered these questions, M . Lock stated that she felt the mandatory system would be beneficial to the environment of Jefferson City to prevent trash burning and tittering. After further discussion, the Council consensus was that the public has indicated that it does not want the present system to change. Councilman Uorgmeyer moved that the system be left as it presently is, the motion was seconded by Councilman Hequembourg and approved. Consent The next item of business was the Consent Agenda, which included Agenda minutes of the Council meeting of June 6, 1983, the Administrator's Report, Finance Report , and awarding of the following bids: 345 - Furniture, Fire Department 352 - Office Space & Cages, Planning & Code 353 - Improvements, Southwest Blvd. at Stadium, Public Works 354 - Storm Drains, Lark & Grant, Public Works 355 - Ferric Chloride, Public Works 356 - Lime, Public Works 357 - Descaling Compound, Public Works 358 - Ammunition, Police Dept. 363 - Improvement, South Country Club Dr. , Public Works HELD OVER 359 - Car Wash Detergent, Transit/Central Maintenance Councilman Roark moved to approve the Consent Agenda as presented, the motion was seconded by Councilman Halsey, and approved. Mayor Hartsfield stated that the ordinance was incomplete, and Mr. Benton stated that the bid had not yet been awarded. Councilman Halsey stated that he asked for suspension of the rules because he had been requested by the staff to do so, but did not know that the material was incomplete and therefore wished to withdraw his request for suspension of the rules. Nay: None. Informal The next item of business was the Informal Calendar. Calendar Pertaining to Bill 83-8, the Election Ordinance, Councilman Hequembourg stated that the Elections Committee had researched the methods by which an Independent Candidate may run for City election. To be placed on 1 the ballot for Council Member, an Independent candidate must obtain a petition bearing the signatures of 4% of the registered voters in the candidate's ward who voted in the last City General Election, or a minimum of 65 signatures. To qualify as a candidate for a city-wide office, the Independent candidate must obtain a petition bearing 4% of the registered voters in the last City General Election of the City, or a minimum of 300 signatures. Councilman Hequembourg moved that this be incorporated in the election ordinance, the motion was seconded by Councilman Gordon, and approved. Lyndel Porterfield was directed to so amend the ordinance for approval at the next Council meeting. Resolution: The next item of business was Resolutions. IIThe following Resolutions were presented to the Council for their approval: RS83-7 Recognition of Richard Dorr for donated law books RS83-8 Street Light/Castle Street R583-9 Street Light/Holiday Drive RS83-10 Park Board Grunt RS83-11 Resolution to Pave Hogan Drive R583--12 Street Light/Swifts Highway Discussion of Councilman Hequembourg requested that Resolution R583-11 be held over paving Hogan for further consideration as there were citizens opposed to the paving. Drive Councilman Borgmeyer stated that this matter had been "held up" long enough and that if enough citizens were in favor of the paving the Council should approve it without further delay. Councilman Halsey moved that all resolutions, excluding RS83-11 , be approved as presented, the motion was seconded by Council Member Lock, and approved. Councilman Borgmeyer moved that Resolution RS83-11 be approved, the motion was seconded by Councilman Davis, and approved. Outside Assist Gary Hamburg requested that the Council consider approval of outside in finance assistance in the Finance Department until a new Finance Director is Dept. established. He stated that an estimate of the cost would be obtained if the Council so directed him to proceed. The Council agreed that Mr. Hamburg should proceed with obtaining estimates and present them at the next Council meeting. Rezoning Mayor Hartsfield directed the Council's attention to the memorandum Memorandum regarding the rezoning ordinance from Mr. Benton's office. He stated that any Council Member who had opinions or questions regarding the memorandum should contact Mr. Benton with their ideas. .4 448. Mayor Hartsfield stated that requests had been made for benches at the Benches Seminary Building for handicapped senior citizens, and asked the at Council for discussion as to funding for them. Councilman Borgmeyer Seminary stated that the Lions Club would possibly fund the benches if asked. Bldg. Mayor Hartsfield stated that he would contact the Lions Club and report back to the Council. Councilman Borgmeyer requested that Mr. Halsey call a meeting of the Finance Finance Committee in the next few weeks to consider storm drainage Committee problems in the City. Councilman Borgmeyer moved that a resolution be drafted pertaining to Intervention • the City's intervention in future utility rate increase cases. The motion in Utility was seconded by Councilman Haake and approved. Cases Councilman Gordon stated that the proprietor of Miracle Water Refining Street Light had reported vandalism and requested a street light at that location. Request • Mike Bates stated he would investigate and report to Mr. Gordon. There being no further business, Mayor Hartsfield stated that the Adjournment Council would adjourn, upon approval by the Council, to Executive Session to discuss matters of legal action/cause of action. He stated that the Council would also discuss personnel matters, and to comply with the Open Meetings Law, he stated the reason that the personnel matters did not appear on the agenda was that members of the Council had (in the past 24 hours) requested an opportunity to discuss the matter of the vacant Controller's position. Councilman Roark moved that the Council adjourn to Executive Session to discuss legal action/cause of action and personnel matters, the motion was seconded by Councilman Gordon, and approved by the following vote: Aye: Borgmeyer, Davis, Gordon, Haake, Halsey, Hequembourg, Executive Kliegel, Lock, Roark and Viesbman.
