HomeMy Public PortalAbout19890619 63 REGULAR COUNCIL MEETING, JUNE 19, 1989 A Regular Council Meeting of June 19, 1989, was called to order at 7:30 P.M. with President Pro Tempore Darrel Gordon presiding. Prayer was offered by Reverend Jack Sullivan, Jr. , Pastor, Second Christian Church. The following Council Members were present: Present: Feldman, Gordon, Haake, Mason, Owens, Scheulen, Veile, and Woodman. Absent: Davis, Halsey. A quorum was declared present. PRESENTATIONS PROM GALLERY: Ms. Carol Blaney, Vice President of Historic Jefferson City, read a resolution supporting the efforts of the Council in promoting the historic aspects of the downtown area. Ms. Blaney reviewed some comments made in the study that had been conducted in the downtown area and encouraged the Council to continue working for the historic preservation of Jefferson City. CONSENT AGENDA: The Consent Agenda consisted of the following items: a) Council Minutes of 06/05/89 b) City Financial Statement for May c) Awarding of following bids: 1099 - Transit Bus Air Conditioning; DOT 1100 - 1989 Curb and Gutter, Phase I ; Public Works d) Approval of amendment to Engineering Contract for odor control e) Approval of renewal of maintenance with Towner Communications Systems for maintenance of City's telecommunications systems f) Appointment to Jefferson City Police Department Probationary Police Officer - Michael Wagers Councilman Mason moved approval of the Consent Agenda. After some discussion, City Counselor Allen Garner stated all appointments were made by the Mayor with the approval of City Council. Mr. Garner stated these two appointments held some specific requirements and that was why they had been referred to in this manner. Councilman Voile questioned if this ordinance would allow billboards to be put up in the area along the highway. Planning and Code Director Tom Benton answered in the affirmative. Councilman Voile stated he thought there had been an increase in the billboards that have been erected and felt the Council should take stops to limit this type of activity. Councilman Voile was reminded that the Council has no authority at this time as Cedar City is still in existence until July 1, 1989. Councilman Voile stated he was aware of this, but felt something needed to be done to prohibit more billboards being erected after July 1. After much discussion, Councilman Voile moved to amend this bill to amend the zoning map so that a strip from the existing City limits of Jefferson City for a distance of 300 feet west of highway right-of-way, north to within 400 feet south to Cedar City Drive be changed to RC, Rural Conservation. Councilman Owens seconded the motion. After further discussion as to what this amendment would do and whether or not any f businesses or homes were involved, the amendment was approved. RESOLUTIONS: RS89-10 authorizes the City to continue in the agreement to purchase property from Missouri Surplus Property. Councilman Mason moved approval of this Resolution. Councilman Haake seconded the motion and it was approved. UNFINISHED BU8INE88: City Administrator Dave Johnston reviewed the response written by ' the City to the County Commissioner regarding the Non-Gray's Creek facilities of the RSD. Mr. Johnston explained the City's position and indicated the three facilities the City might possibly be interested in. After some discussion, Councilman Mason moved to approve the response written by the City. Councilman Woodman seconded the motion and it was approved. NEW BUSINESS: Councilman Feldman informed the Council that the Cable Quality Commission was seeking direction from the Council as to whether or not they should proceed with plans to begin broadcasting the City Council meetings. Councilman Feldman informed the Council he was in ,. favor of proceeding in this direction, stating that this had been a proposal for the Public Access Channel since its inception and moved to direct the Cable Quality Commission to begin preparations for broadcasting the City Council meetings. Councilman Mason seconded the motion. Councilman Scheulen stated his concern about the broadcasting of the Council meetings saying he felt the Council should investigate the pros and cons of televising the meetings before passing this motion. Councilman Feldman stated that the Council could begin televising the meetings, but terminate this process if it became necessary. Councilman Veile stated he felt ' ; there might be some negative aspects to televising the Council ' meetings, but that the positives far outweighed the negatives, and felt this should be pursued. After further discussion, Councilman Feldman amended his motion to add that the meetings must be broadcast in their entirety and not be edited. Councilman Mason seconded the amendment and the motion as amended was approved. Councilman Owens stated she had reviewed the City Administrator's report on the staff retreat and two items had caused her some concern. The first was that the Mayor had been in attendance at the retreat, Councilman Owens had been under the impression it was for Department Directors only. The second item was the comments made regarding the remoial of smoking in public buildings and other non- smoking programs the Department Directors felt the need to implement. Councilman Owens questioned what authority the staff had to proceed in this manner. City Administrator Dave Johnston stated this was not policy the staff was implementing, but simply a suggestion as to the direction staff thought the City needed to progress. Mr. Johnston stated the implementation of this policy would require ordinances and changes in the Personal Policy Manual, all of which would require Council approval . After further discussion, Councilman Scheulen stated he felt this was an issue the Council was going to have to deal with at some point in the future, an this was an issue which directly affected the health of citizens. After further discussion, City Administrator. Dave Johnston apologized to the Council if his report made it appear as though staff were going to begin to implement these policies without Council approval . Councilman Feldman stated he did not feel the Council could nettle the smoking issue at this meeting, however, they could give clear , direction on the first item of concern expressed by Councilman Owens. Councilman Feldman stated he felt the staff retreats were an important time for the staff to spend time brainstorming and team .. building and this should be accomplished without any elected officials being present. Councilman Feldman moved to prohibit elected officials from attending retreats for staff development. Councilman Owens seconded the motion and it was approved. Councilman Haake reviewed a letter the Council had received in their packets regarding taxi cab service in Jefferson City. Councilman Haake stated he felt it was wrong for a city the size of Jefferson City to have only two cabs working from midnight until 2 : 00 a.m. and only one from 2 :00 a.m. until 5: 00 a.m. After some discussion on possible action the Council might need to take, Councilman Veile requested Marty Brose, the Director of Transportation to meet with Mr. Landwehr the owner of the cab company and see what can be done to resolve this issue. Councilman requested Mr. Bross to report back to the Council after this meeting. II Councilman Gordon recommended the Police Department pursue the possibility of having a thirty minute program that would report the crimes that occurred in Jefferson City for that week. This could then allow the neighborhoods to be aware of any activity in their area. 73 REGULAR COUNCIL MEETING, JUNE 19, 1989 III After some discussion on the need for this type of program, Councilman Feldman moved to direct the Police Chief to meet with representatives of the Cable Quality Commission to discuss the implementation of a weekly program to report crimes committed in Jefferson City. Councilman Mason seconded the motion and it was approved. Councilman Voile questioned whether or not the Commission on Historic Preservation for the City of Jefferson was still in existence. Director of Planning and Code Enforcement Tom Benton informed the Council this Commission still existed, but they had not met for quite some time due to a lack of direction. Councilman Veile moved to direct the Mayor to contact the members of the Commission for the Historic Preservation of Jefferson City to meet at their earliest convenience, elect a new chairman and begin holding meetings again. Councilman Feldman seconded the motion and it was approved. Councilman Voile questioned an item included in the Informal Report from the City Administrator which dealt with the City Administrator's attendance at an inter-agency meeting. Councilman Voile questioned whether or not the President Pro Tempore had been invited to attend this meeting. Councilman Voile reminded the Council that they had voted approximately one year ago to have the City represented by the Mayor and President Pro Tempore at those meetings. Councilman Schoulen expressed his concern about the authority the City had to invite itself to attend a meeting of an informal group. Councilman Schoulen stated he jolt the City had exceeded its authority and if the City were really that concerned about the situation, they should form a group of their own with the name individuals. Councilman Voile stated thin group had been formed by former Mayor George Hartafiold and felt the Council should be represented by the President Pro Tempere.
