REGULAR COUNCIL MEETING, June 7, 1982
The regular Council meeting was called to order at 7 : 30 p .m. with
'Mayor Hartsfield presiding.
1Prayer was offered by Mayor Hartsfield.
Councilmen present: Blume, Borgmeyer , Davis , Gordon, Halsey,
Roll Hequembourg, Lock, Roark & Scheulen.
Call. Councilmen absent : Kliegel.
A quorum was present.
A Public Hearing was held regarding a rezoning request by Sidney E.
Public Fox, Sr. and Dorothy D. Fox to rezone land in the 2000 block of
Hearing Stadium Boulevard from RS-2 to PUD. ,
Judy Owens appeared on behalf of Mr. and Mrs. Fox, her mother
and father, in favor of the request . She explained that they are .
proposing to build condominium units not for rental units but for
saleable units . No one appeared in opposition to the request .
Next listed on the agenda was a presentation by Dr. Sugarbaker
regarding the proposed rezoning request by United HRB located on
Industrial Drive. However, Thomas Downey appeared and stated that
he represents Dr. Sugarbaker, who was not able to attend, but who
is opposed to the rezoning request.
A lady appeared before the Council and presented a petition from
Walsh residents on Walsh and Locust Streets who are objecting to the
Street $7. 50 a foot cost assessment for street improvements on the 700
IIIBlock of Walsh Street which its being done under the Small Cities
Program. She stated that the citizens in that area are in the low
to moderate income classification, with half the homeowners being
65 years of age or older and half are women, head of a household.
According to the Code of Federal Regulations , Community Development
Block Grunts , grant assistance may be used for street improvements .
They are, therefore , requesting that the Council rescind the $7 . 50
charge for thin area.
Ted Herron stated that the Regulations read "HUD will not
grant exceptions for any special assessments that will recover
the capital costs of public improvements funded in whole or in
part with block grant funds from properties owned and occupied by
low and moderage income persons . " He stated that this is a short
, street and the total amount involved in tax bills in approximately
$3,600. The area is predominately low and moderate income with
only two tenant occupied properties involved in this project.
Therefore, he suggested that the City waive any tax bill in the
small cities area which is predominately law and moderate income.
Mayor Hartsfield stated that a new Resolution will be
presented on the 21st to correct the situation.
The next item on the Agenda was the Consent Agenda. This included
Council Minutes of May 17, 1982 , and Awarding the following bids :
#212 : Fire Hose - LEO M. ELLEBRACHT CO. , Lake Saint
Agenda Louis , Missouri
#219: Sewer Hose - HANNA RUBBER COMPANY, Kansas City,
Missouri.
Upon motion by Councilman Blume, seconded by Councilman
Halsey, the Consent Agenda was approved.

Mayor Hartsfield reported that word was officially received of the Public
decertification of the Public Works Union. Works

Mayor reported that we are running into difficulty on the runway
• extension funding as the FAA is now saying they are not sure they Runway
will have the money for the project. Clyde Lear, Chairman of the Extension
.• Airport Commission, has written Senator Danforth requesting as-
sistance regarding this matter.

Shelter Mayor Hartsfield stated that the City' s contribution to the
animal shelter remains the same where the City would contribute
$50 ,000. Mr. Hamburg stated that the Humane Society is willing to
pay the amount of the claim. He also stated that this claim is the
result of changes made after discussions with the Humane Society
and the Advisory Committee. When asked why this was not covered
in the original contract , Mr. Porterfield replied that the contract
we had set forth a specific amount and any changes to be made
should have been approved and in writing, however these changes
were made orally and there is no provision in the contract for this
Mr. Porterfield stated that steps will be taken in the future to
eliminate this type of problem.

Councilman Roark stated that he has received many calls from
persons between the ages of 60-65 who are on Medicare and who can
not drive because of doctor' s orders and that is the purpose of
this bill. A discussion followed regarding the age limit for
persons who are on Medicare and if there should be an age limit.
After further discussion, Councilman Borgmeyer moved that the
language "sixty years of age and over" be deleted from the bill
4f: regarding those who are on Medicare. Motion was seconded by
Councilman Halsey and carried.

Mayor Hartsfi.eld pointed out changes which include treating
the Capitol complex as one location with $45 ,000 due the first
year, an eight percent (8%) increase each year on the Capitol
complex starting July 1, 1983 , the state not insisting on a
ceiling on their outlying buildings , distributors will be treated
as manufacturers and they will fall under the 8% escalation.

Councilman Halsey stated that he feels thin bill would give
Independents an advantage over Democrats and Republicans due to the
fact that Independents would not run in the primary election. He
also feels this could be a threat to the two party system.
Councilman Hequembourg stated he felt the last election went
fine under the ordinance presently in effect. He feels the ordi-
nance currently in force accomplishes the goals that were set out
by the Council which include allowing Independents to run and
eliminating primaries in those wards where there are only two
contestants , which in turn saves the city money.

At the request of Councilman Hequembourg, 82-11 was with-
drawn.
A Resolution was presented approving the filing of an application Resolution
with the Small Cities Community Development Block Grant Second
Year Funding. Upon motion by Councilman Halsey, seconded by
Councilman Roark, the Resolution was adopted.
A Resolution was presented creating a comprehensive neighborhood Resolution
improvement program. Upon motion by Councilman Blume , seconded
by Councilman Roark, the Resolution was adopted.
A Resolution was presented regarding eliminating private sanitary
sewer collection systems . Upon motion by Councilman Borgmeyer, Resolution"'
seconded by Councilman Blume , the Resolution was adopted.
A Resolution was presented regarding paving St. Mary' s Boulevard
approximately 600 feet west of ieisinger Road to Missouri Boule- Resolution
yard. Upon motion by Councilman Blume , seconded by Councilman
"bark , the Resolution was adopted.
The next item for discussion was a policy on the use of city buses
for a discount or at no charge to various organizations . These
requests are becoming more frequent. As the City transit system City
is operating under a deficit , Councilman Borgmeyer moved that the
City adopt a charter rate to be charged to any organization who Use
wishes to use the City's transit buses . Motion was seconded by
Councilman Blume and carried.
The next item for discussion was the quarterly newsletter which
has been published twice and distributed to the public. There
is money available in the City Administrator' s budget to run the Newsletter
paper one or two more times before November 1st . After discussion
it was agreed that the newsletter be continued until November 1st
when budget discussions begin. Councilman Scheulen suggested that
a portion of the newsletter contain procedures for citizens to
follow when they have a complaint , who they should contact to
obtain the fastest results.

The next item discussed was the issue of annexation. Mayor
Hartefield stated that if the City is serious in annexing the
three proposed areas , a lot of work will have to be done and we
will have to be more specific with the people who will be affected
by the annexation, such as what it will cost them, what they will
save and what they will gain. .
After further discussion, Mayor Hartsfield appointed the
Annexation following Councilmen to meet with the residents of those areas :
Councilmen Gordon and Hequembourg - Area I ; Councilmen Halsey and
Scheulen - Area III ; and Councilmen Borgmeyer and Blume - Area II.
Bill Nos . 82-3, 82-4 and 82-5 were held over on the Informal
Calendar.

Mayor Hartsfield reported that he met recently with ESM and the
ESM water company to work on ESM' s franchise which expires October 31,
Contract 1982. It is their goal to have a draft plan ready to present to
the Council by the first of August.
Councilman Halsey reported that he has received a number of com-
Trash plaints regarding trash being dumped on vacant lots . He requested
• that Tom Benton' s department monitor the problem.
