REGULAR COUNCIL MEETING, JUNE 5, 1989
A Regular Council Meeting of June 5, 1989, was called to order at
7 : 30 P.M. with Mayor Louise Gardner presiding.
Prayer was offered by Mayor Louise Gardner.
The following Council Members were present:
Present: Feldman, Gordon, Haake, Halsey, Mason, Owens,
Scheulen, Veile, and Woodman.
Absent: Davis.
A quorum was declared present.
Mayor Gardner announced that Resolution 89-7 and 89-8 would be
considered at this time. Mayor Gardner introduced Sgt. Ed Raidel
with the 35th Rear Area Command, a Non-Commissioned Officer; and
Captain Ken MacNevin, Public Affairs Officer for the National
Guard, a former Non-Commissioned Officer. Mayor Gardner read
Resolution 89-7 honoring Non-Commissioned Officer. Councilman
Voile moved approval, Councilman Haake seconded the motion and it
was approved.
Mayor Gardner read R89-8 honoring Chief Petty Officer Marion
"Mick" Hersey. Councilman Hoak° moved approval , Councilman Owens %
seconded the motion and it was approved.
PUBLIC HEARING:
A public hearing was held to discuss the following:
a) Rezoning of land located behind 3724 W. Truman Blvd. from
RS-1 (Single Family) to C-4 (Planned Commercial)
There was no one present to speak either for or against the
proposed rezoning.
A public hearing was held to discuss the following:
b) Rezoning of Lots 20 through 34 inclusive, Lot 36 and
Tract C of Mall Ridge Addition from RS-1 (Single Family)
to RA-2 (Multi Family)
There was no one present to speak either for or against the
rezoning.
A public hearing was held to discuss the following:
c) Rezoning of land adjacent to and southeast of Scholastic,
Inc. from RS-1 (Single Family) to M-1 (Light Industrial)

The public hearings concluded at approximately 7:45 p.m.

Councilman Voile expressed his view of Bid 2000 being awarded to II
k a government entity when a local business was so close to the
lowest bid. Councilman Voile stated he felt the bid should be
awarded to the local business. Councilman Mason stated his ,
agreement with Councilman Voile and moved to approve the Consent
Agenda with the exception of Bid 2000. Councilman Haake seconded
the motion and it was approved.
Councilman Voile moved to amend Bid 2000 to accept the bid of Check
Office Equipment for the amount of $5, 405. 00. Councilman Halsey
seconded the motion and it was approved. After further discussion,
Councilman Haake moved to approve Bid 2000 as amended. Councilman
Voile seconded the motion and it was approved with Councilman Owens
casting the only dissenting vote.

Mayor Gardner reminded the Council of the Jefferson City Area
Chamber of Commerce Quarterly Economic Development Report meeting
with City Council Members and Cole County Commissioners on
Thursday, June 29, at 7:30 a.m. at the Ramada Inn.

Mayor Gardner requested a work session of the Council to discuss
several items of housekeeping. After some discussion, Mayor
Gardner requested Councilman Scheulen and Councilman Haake to make
the arrangements for the work session.

Director Mike Bates stated that this work needed to be completed
before the West Main Street Project could be finished and a delay
in passage of this bill could delay construction on that project.
There was no objection to the suspension of the rules and Bill 89-
37 was read third time by title, placed on final passage, and
passed by the following vote as Ordinance No. 11239.

what the emergency was for the suspension of the rules. Public
Works Director Mike Bates stated there was not an emergency but
that the individuals requesting this has vacation had been delayed
several months in trying to obtain a dead no they could proceed
with construction. Mr. Bates stated he felt it would be
expeditious and fair to suspend the rules and pass this bill .

Councilman Voile informed the Council that he had major concerns
with this bill. Councilman Voile stated he felt this bill was very
restrictive and would require major revisions. Councilman Voile
stated he was inclined to vote against this bill. Councilman
Feldman asked Councilman Voile if he was interested in having
another bill introduced that would nuporcedo this bill . councilman
Voile stated he did not feel this concept was workable. Councilman
Veil() stated ho felt the revenue generated from this bill would be
very nominal after all of the cost factors were deducted. After
further discussion, Councilman Hoak° stated ho felt this concept
was very good and that revenue was revenue, whether it was a large
amount or a small amount. Councilman Haake stated if the Council
felt the bill was too restrictive, it could be amended. After
further discussion, Bill 89-30 was read third time by title, placed
on final passage, and defeated by the following vote:
Aye: Gordon, Haake, Scheulen, and Woodman.
Nay: Feldman, Halsey, Mason, Owens, and Voile.
RESOLUTIONS:
Councilman Owens moved approval of RS89-5 which authorized the
filing of an application for a grant for the interceptor project.
Councilman Woodman seconded the motion and it was approved.
Councilman Haake moved approval of RS89-6 which approved the
installation of a fire hydrant by Capital City Water Company at the
intersection of Industrial and Hart. Councilman Mason seconded the
motion and it was approved.
Councilman Veils moved approval of RS89-9 which authorized
submittal of a joint emergency management operation with Cole
County. Councilman Mason seconded the motion and it was approved.

INFORMAL CALENDAR:
Bill 89-1, sponsored by Councilman Mason, entitled:

AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH PHILLIPS PIPELINE
COMPANY FOR WORK IN CONNECTION WITH THE RELOCATION AND
REIMBURSEMENT CONNECTED THEREWITH OF THE PIPELINE IN CONJUNCTION
WITH THE SEVEN HILLS ROAD PROJECT.
Councilman Mason requested this bill remain on the Informal
Calendar.

UNFINISHED BUSINESS:

Councilman Voile stated he would like to see a formal adoption of
a City flag similar to what was done for the City Seal. Councilman
• Voile stated he would like to see this become a community project.
NEW BUSINESS:
Councilman Feldman commended the City staff on the excellent study
that had boon done regarding the computer needs for the City.
Councilman Feldman stated that many hours of intense study had boon
involved and requested City Administrator Dave Johnston to write
•
letters to all the individuals who participated in thin study
thanking them for their input. Councilman Feldman encouraged the
Council to release the funds that had boon appropriated for the
computers.
After further discussion, C . ncilman Voile stated he was very
pleased with the study the Council had been presented on the
computers and moved to release the funds appropriated so that City
staff could begin the process of acquiring the needed computers.
Councilman Feldman seconded the motion and it was approved.
Public Works Director Mike Bates distributed copies of a letter
received from County Commissioner Sharon Davisson regarding
acquisition of the Non Grays Creek Regional Sewer District
facilities. City Administrator Dave Johnston reviewed the letter
and requested some direction from the Council to staff as to how
to proceed. After some discussion, Councilman Haake moved this
issued be part of the discussion at the Frog Hollow Annexation work
session, but that staff continue discussions with the County
Commissioner. Councilman Woodman seconded the motion and it was
approved.
Councilman Mason informed the Council that he had been appalled at
the number of obscenities that he had seen on bumper stickers, T
shirts, etc. Councilman Mason stated he had recently been at the

{. Mall and had encountered a young man wearing a shirt with the "F"
word written all over the front. Councilman Mason stated that
while he felt the City could not legislate morality, he felt it
needed to take a stand against such visual pollution. Councilman
Feldman moved to direct City Counselor Allen Garner to draft an
ordinance to protect the cleanliness of the visual environment as
well as the physical environment. Councilman Halsey seconded the
motion. Councilman Voile moved the motion be amended to have
Councilman Mason sponsor the bill. Councilman Gordon seconded the
motion and it was approved. After further discussion, the motion
as amended was approved.
APPROVAL OP EXECUTIVE SESSION MINUTES:
Councilman Gordon moved approval of the Executive Session Minutes
of May 15, 1989. Councilman Haake seconded the motion and it was
approved.
EXECUTIVE SESE3ION:
An there was no further business to come before the Council,
Councilman Gordon moved the Council go into Executive Session to
discuss personnel as provided for in RSMO 610. 025 (3) , and real
estate acquisition as provided for in RSMO 610.025 (1) . Councilman
Make seconded the motion and it was approved by the following roll
call vote:
Aye: Feldman, Gordon, Woke, Halsey, Mason, Owens, Schoulon,
Voile and Woodman.
