REGULAR COUNCIL MEETING, May 17, 1982
, The regular Council meeting was called to order at 7 : 30 p.m. with
; : Mayor Hartsfield presiding.
I Prayer was offered by Mayor. Hartsfield.
Roll Councilmen present : Blume, Borgmeyer, Davis , Gordon, Halsey,
Call. Hequembourg, Kliegel, Lock, Roark & Scheulen.
Councilmen absent : None.
Public A Public Hearing was held regarding a rezoning request by United
Hearing HRB General Contractors to rezone a tract of land located on the
north side of the 2100 block of Industrial Drive from RS-3 to
C-4 and M-3.
Mr. David Brydon, Attorney for United HRB , was present and
spoke to the Council on behalf of United HRB. He stated that at
the time United HRB purchased the property it was a gully. They
have since cleared the brush, placed fill on and leveled the -
property. As the tract of land is not suitable for residences ,
they would propose to place a two story office complex on the fort
end of the property and a one story warehouse on the south end
of the property. The warehouse would be a truck terminal , but not to the extent where there would be a large number of trucks coming
there on a regular basis . The warehouse would be shielded by tree: -
which would act as a buffer to residences in the area. Mr. Brydon
stated that with the planned construction, the tax base of sur-
rounding property would increase. It would also provide a boost
to the construction industry in the area.
Mr. Thomas Downey appeared on behalf of several resident
' property owners in the area in opposition to the rezoning request.
He stated that people living on Donald Drive are totally exposed
to the development and even if trees are planted as a buffer , it r:
would be yearn before they will serve their purpose . Other reason- .
' for the opposition rare : 1)) United HRB knew the property was
zoned residential when they acquired it and before money wan
expended adding fill and leveling ; 2) People in the area would be
deprived of the peaceful use and enjoyment of their property ; 3)
1 property values would decrease ; and 4) people in the area purchase(
their property with reasonable assurance that surrounding property
would remain zoned ressidential .
Others appearing in oppossitlon to the request were Ed Cole ,
212 Donald Drive ; Frieda Wagner , 2027 West Main Street ; Judge
1 Henry Egger and Dr. Julian Osman , 2407 Went Main .
The next item of bussinesss was the Consent Agenda. This included
Consent Council Minutes of May 3, 1982 , Council Minutes of May 10 , 1982 ,
Agenda Finance Report , Audit Report , Administrator' s Monthly Report , and
' awarding the following bids :

1 Minutes of the Airport Commission meeting held April 20 , 1982 , Minutes
Solid Waste Committee meeting held April 16 , 1982 , and Public sled.
Works and Planning Committee meeting held May 10 , 1982 , were
received and are on file in the City Clerk' s Office.
Mayor stated he is receiving a number of requests for use of the
transit buses by non-profit organizations who plead they cannot
afford the charter rate. He would like some direction from the
Council before he asks Mr. Hamburg to prepare a Resolution setting
forth a policy.

Councilman Davis requested that this bill be withdrawn after
having discussions with the City Counselor. He stated that the
new ordinance does reflect minor changes in the placement of the
various sections and sub-sections but does not change the intent
of the law. As it would be the duty of the City Counselor to
defend the ordinance if challenged in court , Mr. Davis will submit
the new bill and withdraw 82-16.

Councilman Scheulen stated that even though he realizes the
economic impact of awarding the contract to a local bidder , he
feels that we should not destroy the competitive low bid process .
He has had second thoughts on the basic concept of destroying the
competitive bidding process and the Minority Business participa-
tion should be checked to insure that it is not a front.
Councilman Halsey stated that he strongly supports the MBE
Resolution which was previously passed by the Council and it was
on this basis that he voted to award the contract to Prost Builder: .

Councilman Scheulen requested that this bill be withdrawn.
Resolution A Resolution was presented for paving Walsh Street . Upon motion
Walsh St. by Councilman Blume , seconded by Councilman Borgmeyer, the Resolu-
tion was adopted.
A Resolution was presented authorizing Credit Union Participation
Resolution by the City. Upon motion by Councilman Hequembourg, seconded by
Credit Union. Councilman Blume , the Resolution was adopted.
Resolution A Resolution was presented supporting the State Bond Issue. Upon
State Band motion by Councilman Hequembourg, seconded by Councilman Halsey,
Issue the Resolution was adopted.
Resolution A Resolution was presented for Street Light removal at the inter-
Street Light section of Route B and Ellis Boulevard and also at the northeast
Removal corner of Route C and Southwest Boulevard intersection. Upon
motion by Councilman Borgmeyer , seconded by Councilman Blume ,
the Resolution was adopted. ,
Amtract Councilman Blume stated that he has received numerous complaints
Complaint regarding the Amtract train whistling excessively as it passes
through Jefferson City. It was decided that a verbal complaint
III would be registered and if that produced no results , then a
written complaint would be registered with the Public Service
Commission.

Councilman Halsey requested that Mike Bates contact the appropriate
official regarding the dangerous weed situation on the Highway 50- Weed
Dix Road exit. Complaints

Councilman Gordon also requested that the Highway Department be
contacted regarding various other intersections which are hazardou:
because of weeds not being cut.
