HomeMy Public PortalAboutORD 89/03ORDINANCE NO. 89 -3 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, PROVIDING FOR THE "POWERS AND DUTIES OF THE TOWN MANAGER "; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, as follows: Section 1. The Code of Ordinances of the Town are hereby amended so as to provide for the specification of the powers and duties of the Town Manager, as follows: Powers and Duties of the Town Manager. The Town Manager shall be the Chief Admini- strative Officer of the Town. He shall be responsible to the Commission for the admini- stration of all Town affairs placed in his charge by or under the Town Charter or by way of the ordinances of the Town or the direction of the Town Commission. The Town Manager shall: (a) Recommend to the Town Commission the appointment of, and when he deems it necessary for the good of the Town, the suspension or removal of all appointive administrative officials provided for by or under the Charter or by Town Commission ordinance; the Town Commission may accept or reject such recommendations and may make appointments in the absence of such recommendations. (b) Appoint, and when he deems it necessary for the good of the Town, suspend or remove, all other Town employees. He may authorize any administrative' officer who is subject to his direction and super- vision to exercise these powers with respect to subordinates in that officer's department, office or agency; (c) Direct and supervise the administration of all departments, offices and agencies of the Town except as otherwise provided by Charter or by law; (d) Attend all Town Commission meetings and he shall have the right to take part in discussion but may not vote; (e) Administer all laws, provisions of the Charter and acts of the Town Commission subject to enforcement by him or by officers subject to his supervision; (f) Prepare and submit the annual budget and capital programs to the Town Commission; (g) Submit to the Town Commission and make available to the public a complete report on the finances and administrative activities of the Town as of the end of each fiscal year; (h) Make such other reports as the Town Commission may require concerning the operations of Town departments, offices and agencies subject to his direction and supervision; (i) Keep the Town Commission fully advised as to the financial condition and future needs of the Town and make such recommendations to the Town, Commission concerning the affairs of the Town as he deems desirable; (j) Sign contracts on behalf of the Town as directed by the Town Commission; (k) Perform such other duties as are specified in the Charter or ordinances of the Town or as may be required by the Town Commission; (1) The Town Manager shall represent the Town before appointive officers of other governmental bodies except when the Town Commission shall have designated some other person to act." Section 2. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications and to this end the provisions of this Ordinance are hereby declared severable. Section 3. This Ordinance shall be codified and made a part of the official Charter of the Town of Gulf Stream, Florida. Section 4.
