HomeMy Public PortalAboutResolution 74-584 PCRESOLUTION NO. 74 -584 PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING TENTATIVE TRACT MAP NO. 29602 THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. That the Planning Commission does hereby find, determine and declare as follows: (a) That the owners of certain real property located in the City of Temple City, County of Los Angeles, State of California, located at 10034 and 10040 East Olive Street, on the south side of East Olive Street, and 5204 North Baldwin Avenue through 5312 North Baldwin Avenue, on the east side of North Baldwin Avenue, and 10017 through 10031 East Green Street, on the north side of East Green Street, and approximately the westerly half of 5311 through 5325 North Zadell Avenue, on the west side of North Zadell Avenue . in said City, more particularly described as: Lots 1, 2, 3, 4, 5, the southerly 70 feet of Lots 8 and 9, and the westerly 170 feet of Lots 12, 13, 14 and 15, Tract No. 10558, Book 178, pp. 4 and 5, and Parcels 20, 21, 22, 23, 24, 25 and 26, Portion of Lot No. 45, E. J. Baldwin °s Addition No. 1 to Santa Anita Colony Book 52, page 60. of Maps in the Office of the County Recorder, County of Los Angeles, State of California have heretofore filed an application for approval of Tentative Tract Map No. 29602; and (b) That the Planning Commission conducted a hearing on such application, that said hearing was duly closed; and (c) That based upon the evidence adduced at said hearing, the Planning Commission files and applicable staff reports, and each member of the Commission being familiar with the proposed site, said Commission determines that Tentative Tract Map No. 29602 should be approved. SECTION 2. That the Tentative Tract Map hereinabove described be and the same is hereby approved subject to the following conditions: 1. That approval of this tract shall expire eighteen (18) months after the date of approval by the City Council . of the City of Temple City; and PLANNING: 2� That this division of land shall be subject to approval'of Final RPD (Residential Planned Development) zone (12.85 units per acre); and ••. Resolution No. 74 -584 PC 3. That a separate subdivision map shall be filed prior to or concurrently with the condominium map on the remainder of Lots 8, 9, 12, 13 and 14, Tract No. 10558, shown on Exhibit "A -1" as Lots 2, 3, 4, 5 and 6, that are being divided off by this subdivision.. 4. That 25 feet from centerline of Green Street shall be dedicated where required for right -of -way purposes; and 5. That approximately 340 lineal feet of Portland Cement concrete curb and gutter shall be constructed on Green Street, approximately 15 ft. north of centerline of Green Street; and 6. That approximately 4,850 sq. ft. of 2 inch asphalt concrete pavement on 4 inch crushed aggregate base shall be constructed on the north half of Green Street; and 7. That 967 sq. ft. of P.C,C. driveway apron shall be removed and 107 lineal ft. of P.C.C. curb and gutter along Baldwin Avenue shall be constructed to close the driveway openings; and 8. That the two entrances to the subject property . shall be constructed as a standard street intersection with concrete cross gutters as required by the City. 9. That a 6 -foot wide sidewalk on Baldwin Avenue and a 5 -foot wide sidewalk on Green Street, adjacent to curb, shall be constructed; that curb, gutter, pavement and side- walk shall be provided along Olive Street, and a 5 -foot sidewalk constructed on the west side of Zadell Avenue in accordance with City standards. 10. That 17 Crepe Myrtle trees shall be planted, behind sidewalk, along Baldwin Avenue in accordance with City requirements; and 11. That 10 suitable trees shall be planted, behind sidewalk, along Green Street; and 12. That two (2) 7,000 lumen steel electroliers shall . be provided on. Green Street, and, that a letter shall be sub- mitted requesting that the subject property be annexed to Zone A, Temple City Municipal Lighting District, providing energy and maintenance for street light for one year; and 13. That a left-turn pocket shall be constructed on the median on Baldwin Avenue at Howland Drive to include approximately 120 lineal feet of P.C.C. curb and gutter (Type B2 per Los Angeles County Road Department standard plan 28 -01) and 720 square feet of 4 inch asphalt concrete pavement on 4 inch crushed aggregate base with a stop sign- at the exit driveway opposite Howland Drive; and Resolution No. 74 -584 PC 14. That cash, bond or time certificate shall be sub- mitted to the City in sufficient amount to guarantee comple- tion of the required public works improvements; and 15. That the southerly driveway on Baldwin Avenue shall be limited to right -turn only and that a stop sign shall be placed on this exit driveway; and 16. That vehicular access rights from abutting lots directly to Baldwin Avenue and Green Street shall be dedicated except for the two driveway openings on Baldwin Avenue; and 17. That, in this condominium, owners of the units of air space shall hold an undivided interest in the common areas which shall, in turn, provide the necessary access and utility easements for the units, and that note shall be placed on the final neap to this effect; and 18. That a method for the continual maintenance of the common areas shall be provided in the covenants, conditions and restrictions, and that the Planning Commission shall be provided with a copy of the document prior to filing of the final map; and 19. That, prior to recordation, a letter agreement shall be filed with the Planning Commission agreeing to provide an adequate lighting system along interior streets and all walk. ways to be constructed within the common areas; and 20. That construction rights over the common lots shall be dedicated to the City of Temple City to prohibit the con- struction of additional residential structures within these areas and that building pad areas shall be shown on final tract map; and 21. That adequate driveway width (28 -36 feet in width) . shall be provided throughout the proposed development. 22. That label and dimension on the private driveways shall be shown on the plot plan; and 23. That, prior to recordation, a letter agreement shall be submitted to the Planning Commission agreeing that access to the condominium project shall not be permitted from Olive Street and Zadell Avenue; and 24. That the corner cut -off at the northeast corner of Baldwin and Green Street shall be constructed in accordance with City standards. .25. That all electrical and telephone utilities shall abe placed and maintained underground; and 2.6. That a detailed landscaping plan shall be sub- mitted to the City for approval; and Resolution No. 74 -584 PC 27. That a masonry or decorative perimeter wall shall, be erected and maintained along the interior property lines; and ROAD DEPARTMENT: 28. That easements shall not be granted or recorded within rights -of -way proposed to be deeded or dedicated for public streets, until after the tract is recorded, unless such easements are subordinated to the road easement by cer- tification on the title sheet of the final map; and that the Road Department's requirements regarding street and drainage improvements and easements for street drainage or slopes shall be complied with; and CITY ENGINEER - DESIGN DIVISION: 29. That drainage plans and necessary support documents to comply with the following requirements shall be approved prior to filing of a final map; (a) Eliminate the sheet overflow and ponding or elevate the floors of the buildings with no openings in the foundation walls to at least 12 inches above the finished pad grade. (b) .Provide for contributory drainage from a joining properties; and CITY ENGINEER - .SANITATION DIVISION: 30. That approval of this land division is contingent upon the installation and dedication of local main lines sewers and separate house laterals to serve each building in the land division; easements are tentatively required, . subject to review by the City Engineer to determine the final locations and requirements, and the subdivider shall consult the Sanitation Division of the Department of City Engineer to determine the sewer design requirements; and CITY ENGINEER - WATERWORKS AND UTILITIES DIVISION: 31. That water mains shall be of sufficient size to accommodate the total domestic and fire flows required for the land division; domestic flows required shall be deter- mined by the City Engineer, and fire flows required shall be determined by the Fire Chief and the City of Temple City; and That, at the time . the final land division map is sub- mitted for checking, plans and specifications for the water . system facilities shall be submitted to the City Engineer for checking and approval and shall comply to the City Engineer's standards; and Resolution No. 74 -584 PC That approval for filing of this land division shall be contingent upon approval of plans and specifications mentioned above. If the water system facilities are not installed prior to the filing of this land division, the subdivider shall also submit a Labor and Materials Bond in addition to either: (a) An Agreement and a Faithful Performance Bond in the amount estimated by the City Engineer guaranteeing the installation of the water system, or (b) An Agreement and other evidence satisfactory to the City Engineer, indicating that the subdivider has entered into a contract with the serving water utility to construct the water system as required, and has deposited with such water utility security guaranteeing payment for the installation of the water system. There shall also be filed with this Division a statement from the water purveyor indicating that the proposed water mains and any other required facilities will be operated by the purveyor and that under normal operating conditions the system will meet the requirements for the land division. The Fire Chief requests new fire hydrants at the following locations: 1. North side of Green Street, 350 ft. east of Baldwin Avenue centerline; 2. East side of Baldwin Avenue, 325 ft. north and 625 ft. north of Green Street centerline; 3. West side of.Zadell Avenue at the south line of Lot 6. In addition two private on -site hydrants are required on Lot 1. All hydrants to meet requirements of the Fire Chief as per letter dated April 3, 1974, for exact location, fire flows and sizes; and A fee for checking water system plans, the amount depen- dent on the length of pipe involved, is to be paid to the City; and CITY ENGINEER - BUILDING AND SAFETY DIVISION: 32. That, prior to filing of final map, a soil engineer's report shall be submitted on the expansive properties of soils as such soils are defined by Building Code Section 2903 (d) on all building sites in the proposed subdivision; and CITY FIRE CHIEF: 33. The water mains, fire hydrants, and fire flows shall . be provided as determined by the Fire Chief and approved by the City for all land shown on the map to be recorded; and FLOQD CONTROL DISTRICT: 34. That the subdivider shall obtain a report from the City Engineer regarding the flood hazards from this area; and " Resolution No, 74 -584 PC HEALTH DEPARTMENT: 35. That, as a condition of approval, sanitary sewers . shall be installed and used as a method of sewage disposal; that the owner's statement indicate that domestic water will be supplied by California-American Water Company; and that a legal entity shall be established to assume responsibility to maintain jointly owned facilities in a clean and sanitary manner at all times; and OTHER REQU`I.REMENTS 36. That all applicable City regulations shall be com- plied with. SECTION 3. The Secretary shall certify to the adoption of this Resolution. .
