REGULAR COUNCIL MEETING, APRIL 20 , 1982 - OUTGOING COUNCIL
The regular Council meeting was called to order at 7 :30 p.m. with
Mayor Hartsfield presiding. =Y;
' Prayer was offered by Mayor Hartsfield.
Councilmen present : Blume, Borgmeyer, Brant , Gordon, Halsey,
Roll Hequembourg, Kliegel, Prenger, Scheulen
Call and Wade.
Councilmen absent : None.
A quorum was present .
Public A Public Hearing was held regarding a rezoning request submitted
Hearing ( by Curtis and Ruth Basnett to rezone Lot 48 of Jones Subdivision
from RD (Duplex) to C2 (general commercial) . No one appeared
in favor of or in opposition to the request .
1 Bo Fraser, President of the Chamber of Commerce , appeared before
Cher the Council to give a brief report of the activities of the
Chamber of Commerce Committees and to thank the Council for their
cooperation in working with the Chamber.
r The next item on the agenda was the Consent Agenda. This included
Consent the Council Minutes of April 5 , 1982 , Administrator' s Report ,
Agenda ' Monthly Financial Report and awarding of the following bids :

Bid numbers 195 and 202 were taken off the Consent Agenda for
E further discussion .
Councilman Blume moved that the Consent Agenda be approved,
with the deletion of Bids 195 and 202. Motion was seconded by
Councilman Gordon and carried.
Bid 195, addition to Parking Garage , was then discussed. This
Bid 195 1` bid is for the ground floor and 1st level. Mayor Hartsfield point:.d
Parking ! out a difference of approximately $1, 300 between the low bid by
Garage ; H & 0 Construction, of St. Louis , Missouri, and the next low bid
by Prost Builders of Jefferson City, Missouri.
It was noted that Prost Builders are involved in Minority
Business Enterprise while H & 0 Construction is not. Councilman
Hequembourg requested that Council be provided with a list of the
minority businesses which are used by Prost Builders .

After further discussion, Councilman Scheulen moved that the
bid be awarded to Prost Builders , of Jefferson City, Missouri.
Motion was seconded by Councilman Blume and carried.
On Bid 202 , Gasoline and Diesel Fuel , a question was raised
if the specifications were set up to where an award must be for Bid 202
all items or if they could be broken down and awarded to different Fuel
bidders. Mr. Uffmann stated that most bids are structured so that
a bid item could be awarded to separate vendors . Mr. Hamburg
stated that Public Works and Purchasing figured the difference to
be gained by splitting up fuel bids was $400 .00 based upon usage
and that it would be easier to deal with one vendor given that
small arount of money. This is the basis for the recommendation
to go with one vendor.
Councilman Borgmeyer then moved that Bid 202 be awarded to
Jefferson City Oil Company, Jefferson City, Mi.;. ouri. Motion was
seconded by Councilman Gordon and carries.

Minutes of a special meeting of the Parking and Traffic Commission Minutes
held on April 1, 1932 , were received and are on file in the City Received
Clerk' s Office.
Mayor Hartsfield presented members of the Council with his Annual
Report.
At this time Councilman Blume requested that Bill 81-152 be re-
moved from the Informal Calendar for disposition.
Councilman Scheulen explained that he had requested Mr.
Blume bring this bill up out of order as there is another bill
before the Council thin evening which will amend or possibly 81-152
attempt to amend the general regulatory cable television ordi.-

Bill. 81--152 , introduced by Councilman Blume , entitled :
"AN ORDINANCE GRANTING A NON-EXCLUSIVE FRANCHISE TO CENTRAL
TELECOMMUNICATIONS , INC. TO CONSTRUCT" AND OPERATE A CABLE TELE-
VISION SYSTEM IN THE CITY OF JEFFERSON, MISSOURI , AND SETTING
FORTH CONDITIONS ACCOMPANYING THE GRANTING OF THE FRANCHISE. "
Bill 81-152 read third time by title, placed on final passage
and was passed by the following vote :
Aye : Blume, Brant , Gordon, Halsey, Hequembourg, Scheulen
and Wade .
Nay: Borgmeyer, Kliegel , and Prenger.
Mayor Hartafield then announced that he had vetoed the bill
with the following veto message :
"This bill is vetoed. There exists no justification for
this award at the exclusion of the continuance of the
current serving cable television company. "
Councilman Brant then asked if Council could vote to override
the veto at this time. Mr. Porterfield, City Counselor, stated
that after a veto has taken place and the reasons have been
entered upon the journal, the Council can proceed at its conve-
y nience to consider the question in the following form: "Shall the
bill pass the objections of the Mayor thereto and nothwithstand-
ing?" Councilman Hequembourg then moved that Council reconsider
the question, shall the bill pass the objections of the Mayor
thereto nothwithstanding? Motion was seconded by Councilman Blume.
A roll call vote was then taken to override the veto and
failed with the following vote :
Aye: Blume, Brant, Hequembourg, and Wade .
Nay: Borgmeyer, Gordon, Halsey, Kliegel, Prenger and
Scheulen.

A usage report was presented to the Council for a two week
period as previously requested by Council. Mr. Brose reported
that one week covered when the legislature was in session and one
week covered when they were recessed. During the time the legis-
lature was in session the garage was full most of that time . When
they recessed the usage did drop some . The report showed that
revenues for this year wore down slightly from last year . Some
reasons given for this decline were for the first three months of
last year three shifts were being run at the ticket booth, whereas
this year there are two shifts , operating less hours and last
year Saturdays were manned and this year they are not .
They are proposing the first level , which exits off Commorcia
Avenue, be short term parking. They would propose that the full
' basement of the garage , which are the two split levels , be permit i
parkin .
After discussion , Bill 81-164 read third time by title ,
placed on final passage and wan passed by the following vote as

Bill 81-166 , introduced by Councilman Hequembourg, entitled:

THE MAYOR AND THE CLERK OF THE CITY OF JEFFERSON, MISSOURI , TO k`
EXECUTE A CONTRACT WITH ARCHITECTS ALLIANCE, INC. , FOR THE CON- 81-166
STRUCTION ADMINISTRATION PHASE OF A NEW CITY HALL FACILITY. " New City

A report was submitted to the Council from Tom Utterback dated
April 19, 1982 , regarding the cable television issue . Upon
Y. motion made, seconded and carried, this report was made available I�
to members of the media.
Mr. Utterback outlined changes to Bill 81-168 and 81-169 which
concern the cable television issue. 81-168
One change in Bill 81-169 is found on page 3 , section 6 . 2 ,
line 5, which sentence should now read, "The additional charge of &
$2.00 per month for the optional tier shall not be increased for 81"169
a period of two years following the conclusion of the six month I Cable
preview period. " Another change would be in section 6 . 5 wherein TV
the following sentence is added to the end of the paragraph :
"During the guaranteed rate periodrt net out in Section 6 . 2 above ,
copyright fees shall not be in addition to rates established
herein. "
To make Bill 81-168 consistent with 81-169 , page 1.1 , section
(1) , the following sentence wan added : "(Thin provision may be
limited in the franchise grant) . "
Upon motion by Councilman Kliegel , seconded by Councilman
Scheulen the amendments to 13i.11s 81-168 and 81-169 were adopted .
Councilman Brant: stated that he had met with offici.al.n last
week regar.cli.ng a franchise with TCI and it was his understanding
that certain conditions were agreed upon only to find out that
changes were since made reducing the original bill by one-half.
He questioned why the section regarding an inflationary in-
crease of up to eight percent wan changed deleting the words with
Council approval . Mr . Utterback stated that `fCl would not agree
i to that wording.
Councilman Prenger then moved that the language be amended
to read as the ordinance previously read. That language allows
up to an 8% increase annually, which shall be obtained after the
Grantee files a written request within thirty days of the an-
niversary date of the award of the franchise. The written re-
quest must substantiate the inflationary pressures and cost of
doing business . This motion was seconded by Councilman Blume and
upon a show of hands the motion failed.
Bill 81-168, introduced by Councilman Kliegel , entitled:
"AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI TO REPEAL ORDI-
NANCE NO. 9760 PROVIDING FOR THE ESTABLISHMENT AND GRANTING OF
FRANCHISES OR PRIVILEGES FOR THE CONSTRUCTION , MAINTENANCE, AND
OPERATION OF CABLE COMMUNICATION, OR CABLE TELEVISION SYSTEMS AND
FURTHER PROVIDING FOR THE CONTINUING REGULATION AND ADMINISTRATION!
OF THESE FRANCHISES AND THE ACTIVITIES RELATIVE TO THEM, AND
ENACTING IN LIEU THEREOF A NEW ORDINANCE DEALING WITH THE SAME
SUBJECT MATTER. "

TELEVISION SYSTEM IN THE CITY OF JEFFERSON, MISSOURI , AND SETTING
FORTH CONDITIONS ACCOMPANYING THE GRANTING OF THE FRANCHISE. "

and was passed by the following vote as Ordinance No. 9778 :
Aye: Borgmeyer, Gordon, Halsey, Kliegel , Prenger and

Nay: Blume, Brant, Hequembourg and Wade .
Resolution A Resolution for street lights was presented for lights at the
northeast corner of Myrtle Street and Linden Drive and between
3416 and 3434 Hobbs Lane . Upon motion made and seconded, the
Resolution was adopted.
Representatives from Peat, Marwick and Mitchell were present to
answer questions from the Council regarding the recently completed
Audit audit.
Mr. Spence stated that he felt the City was making progress .
Many of their recommendations made last year have been implemented.
Mr. Uffmann and the Finance Department were commended for doing a
fine job.
Mayor Hartsfiuld then presented keys to the City to retiring
Councilmen Brant, Prenger and Wade .

Upon motion by Councilman Blume , seconded by Councilman Gordon,
all unfinished business wan carried over to the new City Council .
Adjounimcnt Upon motion by Councilman Gordon, seconded by Councilman Blume ,
the meeting was adjourned sine die.
Municipal Judge Richard Nacy then swore in newly elected members
of the Council.

REGULAR COUNCIL MEETING, APRIL 20 , 1982 NEW COUNCIL
The regular Council meeting of the newly elected Council was called
to order at 9 : 00 p.m. with Mayor Hartsfield presiding.
Roll Councilmen present: Blume, Borgmeyer, Davis , Gordon, Halsey,
Call. Hequembourg, Kliegel , Lock, Roark & Scheulen. !
Councilmen absent : None .
A quorum was present .
Election of The first order of business was the election of the President Pro
President Tem. Upon nomination by Councilman Scheulen, seconded by Council-
Pro Tem man Borgmeyer, and approved by the Council , Councilman Halsey was
elected President Pro Tem. He was then given the oath of office
by Judge Nacy.
The next order of business was the election of a Council repre-
Election of sentative to the Planning & Zoning Commission. Upon nomination

sentative Blume was elected as Planning and Zoning representative .

REGULAR COUNCIL MEETING, APRIL 20, 1982 New Council

Resolu- A Resolution was presented lending support to the Fulton State
Reno Hospital remaining open. This is being brought before the
Council as figures were supplied showing the number of employees
State who reside in Jefferson City. Upon motion by Councilman Scheulen,
Hospital seconded by Councilman Kliegel, the Resolution was adopted.
