HomeMy Public PortalAbout19880404 OLD COUNCIL �7 294 A Regular Council Meeting was called to order at 7:30 P.M. with Mayor Louise Gardner presiding. Prayer was offered by Reverend Spencer Roberts, Pastor of Second Baptist Church. The following Council Members were present: Present: Barnicle, Borgmeyer, Davis, Gordon, Heake, Halsey, Mason, Soheulen, Veils, and Woodman. Absent: None. A quorum was declared present. PUBLIC HEARING: Mr. Richard S. Groner of 1301 East High Street in Jefferson City spoke to the Council in favor of rezoning a portion of land in Sohotthill Woods Subdivision. Mr. Groner is requesting the zoning be changed from RS-2 (Single Family) to C-4 (Planned Commercial) . There was no one to speak in opposition to the rezoning. The Public Hearing concluded at approximately 7:35 p.m. PRESENTATIONS FROM GALLERY: Mr. Robert Williams asked to address the Council concerning problems on East Circle Drive. Mr. Williams read a letter he had written to Councilman Gordon in March requesting the City take action against the developer for various infractions of City codes. Councilman Tony Barnial° introduced the members of the Constitution Bicentennial Committee and the Mayor gave to each member a letter thanking them for all of their offorte and hard work. Mr. Emil Ortmeyer and Mr. Mike Oldelohr of Williams-Keepers, the Certified Public Accountant firm which wan contracted to perform the city audit, was present to answer questions from the Council. Mr. Ortmeyer explained the contents of the financial statement. There were no questions from the Council and this concluded Presentations from the Gallery. CONSENT AGENDA: The Consent Agenda consisted of the following items: a) Council Minutes of 03/21/88 b) Approval of the following bide: 994 - Rental of uniforms, mops, mats, etc. ; All City 1 Councilman Soheulen moved approval of the Consent Agenda. Councilman Borgmeyer seconded and it was approved. City Counselor ; . h Allen Garner stated the Cable Commission did not have thel authority to spend funds and they would be submitting a budget ! for Council approval. I. !E I ! Councilman Halsey moved to amend the minutes of the Planning & ! Zoning Commission by the deletion of the last paragraph on page four which reads: 11 Mr. Lankford requested input from the Commission ;� .+ members regarding action taken by Councilman Barnicle !! at the Council meeting of February 15, 1988. Because of Councilman Barnicle's accusations and the fact that he has not met attendance requirements which are imposed on Commission members, Chairman Lansford will I write a letter to the Mayor requesting that Mr. Barnicle be removed as the City Council ' s ;it representative to the Planning and Zoning Commission. There was general consent among the Commission members ii that this should be done. I Councilman Mason seconded the motion. Councilman Scheulen stated ' !! he did not agree with the Commission's action, but did not feel the Council could legally change the minutes. City Counselor Allen Garner stated the Council could not change the minutes, but could oxprese their disapproval of thin action to the Commission. Councilman Halsey withdraw his motion and Councilman Mason withdrew his second. ! ANNOUNCEMENTS BY MAYOR: I Mayor Gardner informed the Council they had received a copy of her veto massage in their packets and as per the Charter, there would be a roll call vote taken to override her veto. Mayor Gardner asked the Council to vote "NO" if they did not wish to override her veto and you if they did. The Council voted not to override the Mayor's veto by the following roll call vote: 1� Nay: Barnicle, Borgmeyer, Davis, Gordon, Heake, Halsey, Mason, Scheulen, Voile and Woodman. j; Aye: None. # # # 1# Mayor Gardner distributed a letter to the Council she had received from the Navy League of the United States concerning theft USS Jefferson City, SSN-759. The letter was requesting an Ad Hoc !; organizational Committee to encourage broad community support fort' • activities in association with the launching and commissioning of the USS Jefferson City. The Committee would consist of the following persons: John Blosser, USN(Ret) Steven J. Councilman Haake seconded the motion and it was approved. INFORMAL CALENDAR: Councilman Mason requested Bill 87-193 regarding the vacation of a sewer easement in Schotthill Woods Subdivision remain on the Informal Calendar. Councilman Gordon requested that Bill 87-200 regarding the proposed lodging tax remain on the Informal Calendar. Councilma Gordon then announced a work session of the City Council, representatives from the Chamber and other interested persons will be held on April 11, 1988, at 7:30 p.m. in the Conference Room at City Hall to discuss this issue. Councilman Gordo stated this work session was open to the public and encourage• all those interested to attend. UNFINISHED BUSINESS: Councilman Gordon presented the City Clerk with the original letter he had received from Mr. Robert Williams and requested it be kept on record and the allegations investigated and corrected. Councilman Gordon informed the Council that City Administrato Dave Johnston would be summarizing the meeting of the subcommittee for long range planning and mailing this summary to all the Council members. After this summary has been completed, Councilman Gordon will schedule another meeting of the subcommittee. NEW BUSINESS: Mayor Gardner announced there would be a public hearing on April 18, regarding the request for voluntary annexation in the Mall Ridge subdivision. Councilman Halsey informed the Council that after the subcommittee for long range planning had met it was decided that there needed to be some further discussion on certain problems with code enforcement and had requested this be placed on th= agenda. Councilman Halsey expressed his displeasure at the absence of the department director. Mr. Johnston informed th= Council that the Department Director was on vacation and would be returning to the office on Tuesday, April 5. 's300 Councilman Halsey went on to state he felt that Code Enforcement was the worst department in City government and that he felt ve strongly it was the most poorly managed. Councilman Hales stated it was his belief that Code Enforcement affected all othe '' departments and all five wards of the City. Councilman Raise stated he did not feel that the citizens were getting their fai . share from Code Enforcement and hopefully if this situation wa= not corrected in a couple of months, that there would be som: immediate changes with a department head. Councilman Scheulen stated he seconded everything Councilma Halsey had stated and cited other problems he had in his ward. Councilman Scheulen stated the Council should go on record a: being very supportive of the enforcement of the codes the Cit ,� has and that they would stand behind Code Enforcement in thei . efforts to keep the city cleaned up. Councilman Hooke stated he agreed with his fellow Councilmen an. wondered if there was a need for more personnel in th) department. Councilman Haake also stated he felt that all of th=� personnel in the other departments of the City could assist th.� Planning and Code Enforcement personnel with the reporting o , infractions of the code when they encounter them. Councilman Barnicle stated he wished to concur with what had bee said thus far and expressed his opinion that safety and security and use of the land were the most important items the Counci . encountered. Councilman Mason stated his desire to support and reiterate whal Councilman Haake had said regarding the possible need for more o '` better trained personnel. Councilman Mason stated he felt th= Council needed to look at the needs of the department to see who ' they might be. Councilman Halsey moved that the City Counselor and the Cit .' Administrator investigate charges that had boon made and t• report back to the Council the positive and the negatives an.' some recommendations within thirty days of tonight's meeting. Councilman Gordon seconded the motion end it was approved. EXECUTIVE SESSION: There being no further business, Councilman Haake moved t• adjourn to Executive Session. Councilman Mason seconded and i ' was approved by the following roll call vote: Aye: Barnicle, Borgmeyer, Davis, Gordon, Haake, Halsey Mason, Soheulen, Voile and Woodman. Nay: None.
