REGULAR COUNCIL MEETING, April 2, 1984
A Regular Council Meeting was called to order at 7 : 30 F.M. with Call to
Mayor Hartsfield presiding. Order
Prayer was offered by Councilman Viessman. prayer
The following Council Members were present: Roll Call
Present : Borgmeyer, Gordon, Haake, Halsey, Hequembourg,
Lock, Roark and Viessman.
Absent: Davis and Kliegel.
A quorum was declared present.
The first item of business was a presentation from the gallery Presentation
by Ms . Kathy Surface regarding Mid Missouri Council of fran Gallery:
` Governments . Ms . Surface explained the function of MMCG and asked MSG
the Council to consider becoming a part of that organization.
A presentation was also made from the gallery by Mr. Frank GRUT
Pursley regarding the Gross Receipts Utility Tax (GRUT) . Mr.
Pursley stated that he and a group of citizens with him feel the
GRUT should be abolished effective May 1. Councilman Haake
suggested the Council consider a "ceiling" on the tax; Councilman
Hequembourg stated that the Council should be careful in
considering abolishment of the tax, as it would then take a vote
of the people (because of the Hancock Amendment ) to reinstate it;
other Council members stated they agree that the tax should be
reduced but that careful consideration of the City's budget was
necessary before making any major reductions . Councilman
Borgmeyer requested that Mr. Hamburg furnish copies of the
utility tariff shoots to Council no that they can determine the
difference between residential and commercial rates .
The next item of business was the Consent Agenda, which included Consent
Council Minutes of 3-19-84 and awarding of the following bids : Agenda
473 - Civil Defense Sirens , Police Department
475 - 21/2 Ton Truck, Public Works
HELD OVER
483 - Braided Packing, Public Works
484 - Car Wash & Hand Soap, DOT, Central Maintenance
BID RENEWAL
496 - Uniforms for Fire Department
Councilman Haake moved that the Consent Agenda be approved as
presented, motion was seconded by Councilman Viessman, and
approved by voice vote.
Mayor Hartsfield stated that the following minutes have been Minutes
received and are on file in the City Clerk' s office: Animal Received
Rescue Advisory Commission, 3-20-84 ; Liquor Control Board, 3-19-
84; Thomas Jefferson Library Board, 3-20-84 ; Airport Commission,
2-21-84 ; Electrical Board, 3-15-84 ; Planning & Zoning Commission,
3-8-84 , and Senior Citizens Advisory Commission, 3-15-84 .

;,., Answering complaints regarding their telephone answering service is
v t`- Service inadequate and unacceptable. Council Member Lock stated she
has doubts as to TCI's method of ' logging' their calls because of
';4 her own personal experience with them. The Mayor stated that more
investigation will be done into these complaints .
Carmission Mayor Hartsfield recommended that if any Council member has a
Meetings question pertaining to the Housing Authority, Library Board,
etc. , Mr. Hamburg will provide information regarding that
commission 's next meeting. The Council member should plan to
attend the meeting to voice his or her questions or opinions .

Councilman Viessman requested that Bill 83-225 be placed on the
Informal Calendar due to the fact that a public hearing must be
held before this bill can be voted on, Councilman Borgmeyer
requested that builders and contractors who might be affected by
this bill receive a copy of the notice of public hearing.

III Councilman Halsey requested that Lyn Porterfield ask an attorney
from this lawfirm to attend a meeting in the near future to
answer questions and make a report on the status of the CATV
• lawsuit .

The next item of business was resolutions Resolutions
RS83-42, Street Light on Honeysuckle & Amador; RS83-43, Street 8583-42
Light on Fredricks Court: Councilman Hequembourg moved that the RS83-43
resolutions be approved, motion was seconded by Councilman Streetlights
Viessman, and approved.
RS83-44 , Discontinue payments-in-lieu of taxes by Housing RS83-44
Authority: Councilman Halsey moved that the resolution be HA Payments
approved, motion was seconded by Councilman Viessman, and in lieu of
approved. taxes
Gary Hamburg recommended that the Council authorize a one-year Bus Station
lease with the bus company, that they be charged $125 per month
rent, and that the City use the rent to make needed improvements
on the building. Mr. Ted Herron, Director of the Housing
Authority, stated that his agency feared the bus company would
not move into the new facility at a higher rate of rent as long
as the City allowed them to remain in this building at a low rate
of rent . Councilman Hequembourg stated he felt no money should be
spent on the building as he does not feel it is worth it . He
moved that the rent charged be $250 per month and that none of
the money be used on the building, and that a clause be added
which would allow a 30-day notice to be given to the bun company
to vacate the premises . Councilman Halsey offered the following
amended motion: the rent (amount be $125 per month and that one-
half that amount ho used for improvements and maintenance,
Councilman Haake seconded the time motion, and the motion was
• approved, as emended, by the following vote:

Nay: Gordon, Hequembourg and Uoark
Councilman Hequembourg withdrew his original motion.
Councilman Gordon requested that Bill 83-206 be placed on final 83-206

Council Members Halsey and Lock stated they do not approve of
this bill as there does not seem to be adequate answers to their
questions . Councilman Gordon stated he sponsored the bill because
he was called and requested to by the staff, and he does not
necessarily agree with the intent or contents of the bill. Bill
83-206 was read third time by title, placed on final passage, and
defeated by the following vote:

Nay: Borgmeyer, Gordon, Haake, Halsey, Hequembourg, Lock,
Roark and Viessman
Mayor Hartsfield stated that Gary Hamburg had received Park
correspondence from the President of the Park Board requesting Board
that any future interaction between the Director of the Parks and
Recreation Department and the City Administrator be directed only

to the Park Board members . Councilman Halsey stated that he does
not feel any president of a board or commission has the right to
specify who should or should not receive comments or concerns
from staff or citizens . He felt that persons should be allowed to
contact the Director of the Parks & Recreation Department if they
feel they need to.
Adjournment There being no further business, Councilman Gordon moved that the
meeting be adjourned, the motion was seconded by Councilman
Viessman, and approved.
