JU9 .},i ry,,, :, REGULAR COUNCIL MEETING, MARCH 3, 1986 4 j -b A Regular Council Meeting was called to order at 7 : 30 P.M. with r , ' , i President Pro Tom Craig Davis presiding. `-:;' {r Prayer was offered by Rev. Spencer Roberts , Pastor of the Second s Baptist Church of Jefferson City. E' The following Council Members were present : r Present : I3orgmeyer, Davis , Gordon, Haake, Halsey, Huffman, Nelson, Voile, Viessman and Woodman Absent : None. A quorum was declared present . The first item of business was a presentation from both Memorial 7 '; Community Hospital and Charles E. Still Hospital regarding their " -, respective proposals for an employee assistance program. ' - Ms . Ann Lock, Director of Health Promotion at Memorial Community -' :` _ Hospital, distributed printed informational materials and y reviewed Memorial 's proposed scope of work. ~{ Mr. Jim Cox, Administrator. of Charles E. Still Hospital, distributed a printed brief and presented Still 's proposed services for an EAP. ;}: ifs At the conclusion of both presentations , Councilman Halsey made $a3 note of the fact that letters from both Chief Rennick and Marty Broso, Director of Transportation, had been referred to the t >> Council recommending the use Memorial ' s service . He directed '> `x Allen Garner, Acting City Administrator, that in the future '' no Department Directors wore to make such recommendations to thcr ;r. Motion for approval was made by Councilman llaake, seconded by Councilman Halsey, and pasted. Councilman Halsey moved that bids 750 through 759 be approved (excluding bid 746 pending further discussion ) , motion seconded by Councilman Viessman, and approved. Councilman Davis stated that the following minutes have been received and are on file in the City Clerk' s office: Police Personnel Board, 1-8-86, 2-6-86 and 2-8-86; Thomas Jefferson Library Board, 2-18-86; Park Board Management Report 1-86; Park Board Minutes 1-28-86; Planning & Zoning Commission, 2-13-86 . Councilman Davis referred the Council to the letter from Mayor Hartsfield to the Council nominating the following persons for the position of communications operator at the police department; August Dudenhoeffer and Peggy Platt. Bill 85-205 was read first and second time by title and ordered distributed to members of the Council. Bill 85-206 , sponsored by Councilman Halsey, entitled: >; AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AMENDING CHAPTER 16 OF THE CITY CODE TO ALLOW THE CITY TO PERMIT REFUND OF LICENSE FEES CHARGED TO BUSINESSES PAYING LICENSE FEES BASED ON GROSS RECEIPTS . Councilman Halsey asked Mr. Garner to also provide figures as to how much the City has paid in the past for holidays already established. The next item of business was pending bills . Bill 85-200, sponsored by Councilman Haake, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING ' I SCHEDULE H OF SECTION 18-401 OF THE CITY CODE BY ESTABLISHING A YIELD INTERSECTION AT WILLIAMS STREET AND BECK STREET. Councilman Halsey requested that Bill 85-202 be withdrawn to allow for rebids . Bill 85-203, sponsored by Councilman Halsey, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT FOR EXTENSION OF . . 402 REGULAR COUNCIL MEETING, MARCH 3 , 1986 CONTRACT WITH JAMES BRIEDWELL, D/B/A BRIEDWELL LANDSCAPING, FOR LANDSCAPE MAINTENANCE AND REPLACEMENT WORK. Bill 85-203 was read third time by title, placed on final passage, and passed by the following vote as Ordinance No. 10597 : • Aye: Borgmeyer, Davis , Gordon, Haake, Halsey, Huffman, Nelson, Veile, Viessman and Woodman • Nay: None. • Bill 85-204 , sponsored by Councilman Gordon, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , PROVIDING A SCHEDULE OF MINIMUM FINES FOR VIOLATIONS OF CERTAIN CITY CODE PROVISIONS. Discussion occurred regarding the source of the recommended minimum fines and whether some of the fines were too high. • Councilman Haake felt some were too high, and Allen Garner stated that the fines were suggested by the police department . Bill 85-204 was read third time by title, placed on final • passage, and passed by the following vote as Ordinance No. 10598: .4� Aye: Borgmeyer, Davis , Gordon, Halsey, Huffman, • Nelson, Voile, Viessman and Woodman Nay: Haake . The next item of business was the Informal Calendar. Councilman Haake requested that Bill 85-190 be withdrawn at this • time . The next item of business was the ratification of a rstipulation with the state Board of Mediations. Allen Garner explained the • terms of the stipulation. Councilman Nelson moved approval of the stipulation, motion wan seconded by Councilman Halsey, and approved. The next item of business was the approval of the Executive Session minutes of 2--17-86. Councilman Ilsako moved that the minutes be approved as written, motion seconded by Councilman Halsey, and approved. Councilman Veile stated he felt a change should be made in the method of informing the Council of items to be discussed in executive session as well, as the length of the executive sessions • themselves . He moved a) each item to be discussed be listed for Councilmen to review when each executive session begins, and b) that each item of discussion in executive session be limited to fifteen minutes each. The motion was seconded by Councilman : Woodman. Councilman Nelson asked Councilman Veile to amend his motion to require that the list of items be included in the Council packets . Councilman Veile stated he did not wish to so amend his motion. The motion was defeated by a show-of-hand votes. Councilman Halsey moved that "the Still Hospital proposal, which a' .:.t.'; ',',ii is at no cost to the City, and bears the same services , be recognized as an official bid, and that the Council receive it . " 1,v .,., Motion was seconded by Councilman Huffman . After discussion, Mr. Cox of Still Hospital stated that if the City would like a proposal from Still similar to the one they received from Memorial they would submit that . Councilman Halsey withdrew his motion, and offered a substitute motion to disregard the previous bids and draft a more detailed RFP for rebids . This motion was seconded by Councilman Huffman, and approved by voice vote. ii. Councilman Davis asked Mr. Garner to have the bid back to the Council in two weeks . Mr. Garner stated that it had taken six °, - months to produce the original RFP and there is no way that it - P Y : can be back before the Council in two weeks . Mr. Cox stated that perhaps Memorial and Still could work with City staff to help i - write the RFP, to which Mr. Garner stated that would be inappropriate if either Memorial or Still were to be considered . ... ', as bidders . Nanette Weber of Memorial Hospital pointed out that ' ra Memorial had responded to the Staff ' s RFP point-by-point , which .', ' they felt was sufficiently detailed in its requests , and that is how Memorial arrived at their proposal. Councilman Voile asked if f the Council could receive copies of the RFP' s to determine which r_=,-` hospital had responded more correctly. Councilman Huffman stated the Council should not delay any longer in making this decision. i `: f .= Councilman Davis reminded Mr. Huffman that the Council had just ;. voted to reject both bids and rebid and they could not vote on his motion at this time . After discussion, Mr . Davis declared a "division of the house, and that a roll-call vote would be taken on rejection of bids which was previously passed by voice vote ." Councilman Huffman moved to accept Still Hospital ' s bid, motion was :seconded by Canneliinan Viessman, and approved by the following vote : Aye: Borgmeyer, Davis, Haake, Halsey, Huffman, and Viessman. Nay: Gordon, Voile and Woodman. Abstain : Nelson Councilman Borgmeyer moved to adjourn, motion was seconded by Councilman Viessman. Councilman Viessman withdrew his second. Councilman Voile seconded the motion, and it was defeated by the following vote: Aye: Borgmeyer, Gordon, Haake, Voile, and Woodman • Nay: Davis, Halsey, Huffman, Nelson and Viessman. Councilman Veile left at this point in the meeting. Councilman Davis moved that the Council go into Executive Session, motion was seconded by Councilman Viessman, and approved by the following vote: 404 REGULAR COUNCIL MEETING, MARCH 3, 1986 - - Ayes Davis, Gordon, Haske, Halsey, Huffman, Nelson, Viessman and Woodman. Nays Borgmeyer. Absent: Veils. The meeting was adjourned into Executive Session at 9: 30 P.M. II/ 55- •
