Prayer offered by Mayor Hartsfield. 3; Councilmen present : Borgmeyer, Brant, Crader, Gordon , Halsey, Hequembourg, Kliegel , Prenger, Wade and Whitecotton. Councilmen absent : None. A quorum was declared present. The Consent Agenda, including approval of Council Minutes of February 16, 1981, approval of Public Works Committee Minutes of Consent meeting of February 26 , 1981, and the following bids, which were Agenda received and opened on February 24, 1981 : { 1. Councilman l3orgmoyer made the motion tadium that $1.00, 000. 00 be appropriated from Revenue Sharing Funds to Blvd. take care of this item, and the balance could be used for addition ,1 Central curb and guttering. Motion seconded by Councilman Kl.iegol but failed to pass. It was the consensus that Mr. hates would proceed with the project and as soon as he has exact figures on all projoc - an Ordinance will be drafted to take care of the deficit. Councilman Hequembourg made the motion that the Consent Agenda be approved, including the Stadium Boulevard Central Projec . ; Approval. motion seconded by Councilman Prenger and passed. Minutes of the Planning and Zoning Commission meeting of February 18, 1981, Environmental Quality Commission of February 19, 1981 , Minutes Memorial Airport Meeting of February 17, 1981 , and Parking and Filed. Traffic Commission meeting of February 12, 1981 , were received and filed. Application for rezoning by Curtis Ray, Betty R. , Janice K. , and Jack D. Gilliam, for property located on the northwest corner of Nlanning Dix Road and Industrial Avenue, from RS-3 to C-1 , was referred to and the Planning and Zoning Commission. Toning Statement from County Clerk Stan Diemler, cost of Special Election held in the Fifth Ward, November 4, 1980, in the amount of $1 ,783.64, was received. Councilman Hequembourg made the motion 1lection that such bill be paid. Motion seconded by Councilman Whitecotton Costs and passed. 11/4/80 , 59 REGULAR COUNCIL MEETING, March 2 , 1981 , Councilman Whitecotton referred to the Parking and Traffic Minutes - he had requested a crosswalk at the corner of Jackson and Capitol ` Parking , and Avenue. Councilman Whitecotton stated he had never requested a ,; Traffic crosswalk in the City - some time ago he had asked for a stop sign Minutes. ' at that corner. Marty Brose stated probably it should have been a stop sign and he would check into the matter. Mayor Hartsfield stated that since there were residents of the Sunset Lake Area present , if it was agreeable, they would like to take up Bill No. 199 referring to parking in that area. There was Bill no objection and Bill No. 199, introduced by Councilman Wade was 199 brought to the floor: Parking "An Ordinance of the City of Jefferson , Missouri , amending the Sunset Code of the City of Jefferson, 1978 , by amending Section 23-79, Lake. relating to parking prohibited at all times at designated locations by adding new roadways to subparagraph (a) , streets and highways. " Bill No. 199 read first and second time by title, and on request of Councilman Wade , the rules were suspended, the Bill read the third time by title , placed on final passage and was passed by the following vote as Ordinance No. 9585 : Councilmen voting Aye: Borgmeyer, Brant , Crader, Gordon, Halsey, Hequembourg, Kliegel , Prenger, Wade and Whitecotton. Councilmen voting Nay: None. Mayor Hartsfield introduced Bert Rozycki and Don Costalos, repre- sentatives of Deloitte Haskins & Sells , consultants on our computer needs, who explained their report and answered questions. Mr. Computer. Rozycki explained that what they have done in the first phase is define the requirements that the vendors need to satisfy and to identify how the City could utilize computer automation. If we have your acceptance of this report and the continuance of the project , we will then proceed with detailed specifications and evaluate the proposals. Mr. Costales explained they had talked with Department Heads several times and then arrived at five successful candidates for automation. We also contacted candidates for services for tentat:i.ve estimates of costs and from these esti- mated it range from eighty to one hundred and fifty thousand dollars for acquisition of hardware by the City . We wore unable to deter- ' mine the cost of service bureaus. We also contacted suppliers of time-sharing services and they have a floor of approximately two thousand dollars por month for services. We do not anticipate a specialized individual need be added to the staff with full.--time data processing responsibilities. We will look for a system that can be run by the users who will receive training to do this. We are not looking for a system that would require a full-Lime sophisticated staff member. There will be a continuing cost for maintenance and supplies, which we cannot estimate until we hoar from the vendors . After further discussion , Councilman Hequembourg made the motion that Mr. Hamburg notify Deloitto Haskins & Sells to proceed with Phase B of the contract . " Mayor liartsfield stated he had talked with Mr. Daniels, current Director of Public Safety for the State of Missouri , and Mr. Daniels' attitude was that they did not intend to formally request us to return the funds, they cannot legally request such refund, - the matching question has been answered but he is un- happy about the way it was done - technically, the Grant is in compliance with a 50-50 match, he will be responsible for auditing the Grant when it is closed out. He is strong in his opinion that III it is an inappropriate use of the Funds - it should be used more for programming and not for building or building restoration. E( 1) and insert the following: "( 1) Parking lots are divided into Light , Medium, and Heavy Classifications. Parking areas for single family through and including four family dwellings generally are permitted to :si use the standards of the Light Classification. Parking areas which do not meet the criteria for the Light Classification and are to be used primarily for the parking of automobiles are permitted to use the standards of the Medium Classifi- cation, provided however, the Heavy Classification standards be required on those parts of the parking area which may be subject to frequent heavy truck traffic. Such heavy truck traffic areas may include, but not necessarily be limited to, trash disposal areas, shipping and receiving areas, and drives leading to such areas. However, a final decision on the need for Light , Medium or Heavy Clas- :r sification standards will be made by the Director of Planninv at the time an application for a Building Permit is filed. (a) Light Classification Standards. Parking lots and their entrance and exit driveways shall be surfaced either with concrete not less than four (4" ) inches in thickness or with bituminous surface of not less than two (2" ) inches in depth on top of a compacted crushed stone bass not less than four (4") inches in depth, or with any surface adjudged by the Commission to be equal or superior to either of these types. (b) Medium Classification Standards. Parking lots and their entrance and exit driveways shall be surfaced either with concrete not less than five ( 5" ) inches in thickness or with bituminous surface of not less than three ( 3") inches in depth on top of a compacted crushed stone base not less than four (4") inches in depth, or with any surface adjudged by the Commission to be equal or superi• to either of these types. (c) Heavy Classification Standards. Parking lots and their entrance and exit driveways shall be surfaced either with concrete not less than six (6") inches in thickness or with bituminous surface of not less than fie-. (5" ) inches in depth on top of a compacted crushed stone bas not less than four (4") inches in depth, or with any surface adjudged by the Commission to be equal or superior to either of these types. ( 5) Section 10. C. ( 3) ( f) . Change the words "Board of Adjustment" to "Planning and Zoning Commission" . And add the following sentence : "The favorable vote of a majority of the Planning and Zoning Commission shall be required to reverse the decision of the Director of Planning. Final appeal shall be to the City Council , and it shall require a majority vote of the City Council to over ride the Planning and Zoning Com- mission. " (0) Delete present ( d) and ( o) of Section 10. 0( 3) and insert the following in their place , and add ( f) and (g) , all of which shall read as follows : "(d) The typewritten names, addresses and phone numbers of all owners and/or their attorney and/or their designated re- presentative. (a) The signatures of all owners and/or their attorney and/ or their designated representatives. (f) Designated representative or representatives shall pre- sent proper power of attorney signed by all owners and notarized showing authorization to act on behalf of all owners. (g) This provision shall not be construed to permit the unauthorized practice of law. " (7) Delete present ( 7) of Section 1O.G and insert the following: "The recommendations and reports of the Commission , made pursuant to Paragraph G, are hereby declared to be final, and not subject to petition or motion for rehearing or reconsid- eration by the Commission. Successive applications or petitions for any changes referred to in Paragraph G, made by the same person, firm or corporation, or in their behalf, on the same or substantially the same set of facts and cir- cumstances, previously determined by the Commission, shall not be reheard by the Commission except that a new applicatio shall be considered for rehearing at a subsequent meeting and, if approved by a majority vote of the entire Commission , 65 REGULAR COUNCIL MEETING, March 2 . 1981 then such application shall be reheard at the next regular Commission meeting. The Commission shall rehear successive requests to rezone the same property at any regular meeting if there has been a material change in facts or circumstances " ! (8) Amendment Eight - to delete Section 10.G (8) DEFEATED. I (8) Since Amendment Eight was defeated, Councilman Brant made Zoning the motion that Section 10.G (8) be amended ( in the third 0rdinanc line) by changing the words "eighteen months" to "thirty months" , and such motion, after being seconded by Councilman Whitecotton, passed. (9) Amend Section 10 B. ( 1) by deleting the words "In the resi- dential Districts" and capitalizing the "W" succeeding these words. Amend Section 10 B. ( 3) by deleting the present sub-section and inserting the following: "( 3) Discontinuance of Non-Conforming Uses.
