HomeMy Public PortalAbout19820301 '118 REGULAR COUNCIL MEETING, March 1 , 1982 The regular Council meeting was called to order at 7 : 30 p.m. ;.. with Mayor Pro Tem Prenger presiding. Prayer was offered by Rev. Rudy Beard, 1st Presbyterian Churc} . Boll Councilmen present : Blume , Borgmeyer, Brant , Gordon, Halsey, Coll. Hequembourg, Kliegel, Scheulen & Wade . Councilmen absent : None. A quorum was present . The next item on the Agenda was the Consent Agenda. This included Consent approval of the Council Minutes of February 15 , 1982 , three re- , Agenda. zoning requests and awarding of the following bids : #171: Couplings and bushings/Public Works , WPC/ H & S UNDER- GROUND SUPPLY CO. , INC. , Kansas City, MO. #172 : 2Z ton trucks/Public Works , Street/HELD OVER #173: 3/4 ton truck/Public Works , Street/HELD OVER #175 : Mobile Radios/Parking/HELD OVER #177 : Street Marking Paint/Public Works , Street/HELD OVER #178: Carpet/Fire/HELD OVER #179 : Cleaning City Uniforms/Police , P & C, DOT/QUALITY CLEANERS , Jefferson City , MO Upon motion by Councilman Hequembourg, seconded by Councilman Halsey, the Consent Agenda was approved. Minutes of the Environmental Quality Commission dated January 28 , Minutes 1982, Planning & Zoning Commission dated February 11 , 1982 , Parking Receivsd & Traffic Commission dated February 11 , 1982 , Park Board dated February 16 , 1982 , and Electrical Board dated February 18 , 1982 , & filed. were received and are on file in the City Clerk ' s Office . Councilman Borgmeyer requested that the Public Works and Planning Meeting, held on March 1 , 1982 , prior to the Council $ Meeting also be entered as having received their minutes . In this meeting the Commit:tee approved vacating an alley located in the 400 block of Madison. They also approved placing a flag pole on Bolivar Street in front of the Corps of Engineers building to be placed on city right:-of-way with the agreement that if thin would need to be moved in the future , it would be at the Corps of Engineers expense . Councilman Scheulen stated that he did not receive a copy of the Parking and Traffic Minutes of February 11 , 1982 , and asked that he be supplied with a copy. Mayor Pro Tern Prenger announced that there would be a Special Meeting on March 2 , 1982 , at 7 :00 p.m. in the Council Chambers . The purpose of the meeting is to review the draft of the cable special television franchise ordinance. He stated he had been contacted cable by TCI who would like to televise the meeting. Several Councilman tv voiced objection to TCI televising the meeting. Nay : None . Bill 81-136, introduced by Councilman Wade , entitled: 81-136 "AN ORDINANCE OF THE CITY OF JEFFERSON , MISSOURI , CREATING A Snow SNOW ROUTE AND SNOW EMERGENCY ORDINANCE. " I]mrgency This bill would authorize the City to tow a vehicle at the owner' s expense if during a snowstorm their vehicle was unable to go and was tying up traffic , preventing road crews from clearing the roads. Councilman Kliegel expressed concern over charging people to tow their cars and moved to amend the bill to read that the City would absorb the towing fees . However, this motion died for lack of a second. Councilman Scheulen stated that perhaps this it bill would encourage citizens to purchase proper tires to be used in bad weather. Mr. Hamburg stated that this bill was prepared to be as least restrictive as possible. The City is looking to avoid a situation such as December. There would be two hours notice given that the restrictions would go into effect . Councilman Borgmeyer stated that we also have a problem with cars parking on the side streets off of Southwest Boulevard and during times of snow it is dangerous as people will park right up to the intersection. Bill 81-136 read third time by title , placed on final passag and was passed by the following vote as Ordinance No. 9751 : Aye : Blume, Borgmeyer, Brant , Halsey, Hequembourg, Scheulen and Wade. Nay: Gordon and Kliegel. Bill. 81-137, introduced by Councilman Kliegel , entitled: "AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , PROHIBITING THE I 246 • REGULAR COUNCIL MEETING, March 1, 1982 DEPOSITING OF SNOW AND ICE ONTO PUBLIC RIGHTS-OF-WAY FROM PRIVATE PARKING LOTS. " Mike Bates stated that the intent of this bill was to deal with major parking lots and not standard driveways . 81-137 Councilman Scheulen stated there would be instances where Depositing persons would deposit snow on the right-of-way but over the curb Snow off line. While this does not create a sight obstruction or be a Driveways hazzard they would be in violation of this ordinance. He then moved that the bill be amended with language requiring that the snow deposited be a sight problem or hazzard before a person could be ticketed. Motion was seconded by Councilman Gordon. However, Mr. Porterfield stated that it would be the City' s responsibility to prove that a sight problem or hazzard existed if challenged. After further discussion, Councilman Scheulen withdrew his motion and the bill was placed on the Informal Calendar. Mr. Porterfield was then instructed to reword the bill. Bill 81-138 , introduced by Councilman Blume , entitled: "AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELATING TO 81-138 URBAN REDEVELOPMENT THROUGH PRIVATE CAPITAL INVESTMENT. " Urban Councilman Scheulen moved that Section 37-30 , relating to a Redevelop- financial report being provided to the City, be amended by melt. requiring'Ithel corporation to provide a certified audit by a certified public accountant. Motion seconded by Councilman Wade and carried. Bill 81-138 read third time by title , placed on final passage and was passed by the following vote as Ordinance No. 9752 : Aye : Blume , Borgmeyer, Brant, Gordon, Halsey , Hequembourg, Kliegel, Scheulen and Wade. Nay: None. A Resolution was presented authorizing filing for an Environmental Resolution Protection Agency grant . Upon motion by Councilman Wade , seconded EPA Grant. by Councilman Blume, the Resolution was adopted. A Resolution wan presented requesting that a fire hydrant now {{ located in the 800 block of Swiftu Highway remain at that locations. Resolution Thin pertains to a hydrant that has been rented by the Trinity Fir* Hydrrant Lutheran Church. They have learned that they no longer need the hydrant to protect insurance rates and no longer wish to pay rent on the hydrant , however, they would like for the hydrant to remain there. Capital City Water Company would like to remove the hydrant for salvage or to be used at another location. After discussion, the Council voted to retain the hydrant at its present location. Next on the agenda was the status of the Gundelfinger property. Mr. Porterfield stated that he had contacted Mr. Gundelfinger Qmdelfinger and he has expressed a desire to cooperate with the City and has Property► said he would authorize a gentleman in the City to be his contact for emergency situations. He is not interested in selling the property at this time and he is interested in developing the property. He also stated that he would be willing to dicusss the possibility of converting the property to a mini-park. 2-47 REGULAR COUNCIL MEETING, March 1, 1982 , r - i--A :A. at -1114. r.w 4 ° cry r_N —/— _ ► ` 4 on the agenda was a discussion on the final plans for the Riley Lot Parking Structure. Marty Brose stated that the final plans are complete , however, Mr. Verslues was not able to attend the meeting. Mr. Brose stated that the base bid project , which Riley is the ground floor and first floor, is $321 ,500, with a total Lot project cost of $743,500. However, only the ground floor and Parking one level will be built at this time. Structure The ground level would be accessed off of Capitol Avenue and contain approximately 48 spaces , plus storage space. The first deck would be accessed off of Commercial Street and would contain 53 spaces. Mr. Brose estimated that construction could begin in May and'.be completed within seven months . Upon motion by Councilman Scheulen, seconded by Councilman Blume, Mr. Brose was authorized to solicit bids for the project. Councilman Borgmeyer suggested that the Council should review Utility taxes being charged on their utility bills and requested that he teem. be provided figures of all utility taxes for the years 1980 and 1981. Councilman Halsey mentioned an article which appeared in the Recognizing March 1 issue of the evening paper wherein Kenneth Wildhaber, Jr. Clams and James Wildhaber took action which led to the capture of a person commiting a crime in the City. He moved that the Council pass a Resolution at the next Council meeting recognizing the brave actions of these two citizens . Motion was seconded by Councilman Brant and carried. Councilman Hequembourg moved that the Council authorize the placement of information to the taxpayers regarding the cable Gable TV television issue in the newspaper and radio stations . Councilman Brant stated that the City would ask the newspaper for equal space in fairness to the public in order that they might obtain the City's side of the issue. However, if this can not be ac- complished, the City will have to pay for the apace. Motion seconded by Councilman Blume and passed with Councilmen Kliegol and Borgmeyer objecting.
