The regular Council Meeting was called to order at 7:30 P.M. with

Mayor Hartsfield presiding.
Prayer was offered by Rev. Steven Buchholz, Central United Church of
Christ.
Councilmen Present: Blume, Borgmeyer, Davis, Gordon, Halsey, Call to Order'
Hequembourg, Kliegel and Scheulen.
Councilman Absent: Lock and Roark
A quorum was present.

The first item of business was a public hearing on a rezoning Public Rearing
request involving property located at 1310 Swifts Highway. The 'ezoning Request'„
request being applied for is a change from PUD (Planned Unit
Development) with uses restricted to restaurant and lounge, to PUD
with uses restricted to restaurant, lounge and residential uses under
certain conditions. Mr. Dick Preston, City Planner, was present to
r='s explain the background of the property and the application for
rezoning. The conditions set out for the change in zoning are as
follows: (1) acquisition by property owners of a permanent easement
or deed acceptable to City Staff and providing access to Linden
Drive; (2) a plan presented for City inspection specifying number of
dwelling units reasonably placed on property, and (3) a minimum of
1.86 off-street paking spaces per dwelling unit. No persons present
spoke in favor or in opposition to the rezoning request.
The next item of business was the Consent Agenda, which included assent Agenda
Council Minutes of the Regular Meeting held February 7, 1983, the
Administrator' s Report, Finance Report, Audit Report and awarding of

Councilman Blume moved that the Consent Agenda be approved, the
motion was seconded by Councilman Gordon, and approved.
Mayor Hartsfield stated that the following minutes were received and Minutes Recd
are on file in the City Clerk's Office: Electrical Board, 2-10-83; Plan- & Filed
ping & Zoning, 2-10-83; Environmental Quality Commission, 1-20-83,
and Park Board, 1-18-83.
Mayor George Hartsfield referred the Council Members to the
memorandum from Lyndel Porterfield stating that, after further
research, he has discovered that residential dwellings would be
affected by the proposed Special Business District tax. The survey
mailing will not be sent out until the Council Members have had time
to study the memo and discuss it at the next meeting.

Work Mayor Hartsfieid stated that a Work Session will be held on February 28
Session at 7:30 at which time a feasibility study by Burns & McDonnell will be
discussed as well as items of concern to the City and the County Court.

was in the amount of $9,750, and involved the area from the ice arena
out to Missouri Boulevard.

Councilman Hequembourg asked for an explanation of the reason the City

Councilman Ill nine s;tated that he had talked wt 1k 2 msmlwrts of Atcohotictt
Anonymous (AA) to deterrmtue their views; ors the "DWI Ordinance.'' wits;
suggested to him that the Ordinance provide for the offender to be
locked up to be allowed "thinking time" for progressively longer periods
of time, depending on the number of offenses. He stated that it was felt
imposing a monetary penalty would riot be as effective and would tend
to burden the family of the offender rather than the offender himself.
Mr. Porterfield stated that research would need to be done as to the
requirement by law to provide legal counsel to persons incarcerated; it
would need to be determined what the cost would be to the City of
• providing legal counsel to indigent offenders. Councilman Blume stated
that he would like to have information from the Municipal Court and
Police Station that would help determine, by the number of such
offenders in the past, the possible expense to the City. Councilman
Scheulen requested that Bill 82-155 be held over on the Informal
Calendar.
82-145 Councilman Borgmeyer requested that Bill 82-145 be withdrawn for
reintroduction at a later date.

Resolutions The following Resolutions were presented to the Council for adoption:
RS82-35 - Street Light; RS82-36 - Street Light. Councilman Hequembourg
moved that the Resolutions be adopted, the motion was seconded by
Councilman Halsey, and approved.

The next item of business was Unfinished Business.
•
Ms. Shirley Zbinden, Manager of TCI Cablevision, was present to give a TCI
report on TCI' s progress in upgrading the cable system. Ms. Zbinden Report •
read a report which stated that the outside work of upgrading the cable
system was completed and the final balance of customers would be
hooked up by March 1. A store where converters can be obtained for the
new tier channels will be located at the Capital Mall, and newspaper
advertising will inform customers of the availability of the converters.
Trained personnel will instruct the customers on the installation of the
converters. Updated program/price sheets were distributed and Ms.
Zbinden answered questions by members of the Council regarding the
prices and programming on the list. Mr. Wade, a citizen of Jefferson
City, stated from the gallery that he would prefer Channel 5 be retained
and Channel 10 removed to provide an open slot for Channel 9.
Councilman Davis reported that a meeting has been scheduled between Solid Waste
the Solid Waste Committee and ESM. Committee
Lyndel Porterfield, City Counselor presented the Council with figures Codification
representing the savings possible by deleting portions to be printed in
the new Code book. He stated that in answer to Councilman Roark's
question at the last meeting as to whether the printing of the lists of
streets and parking changes would be included in the bid, there would
not be a reduction of the price because the City would already be over
the number of pages bid. He stated that the City could save
approximately $1,120 in initial printing costs and approximately $1,160
per year in supplemental printing costs, if the lists of streets (in
Chapter 23) were deleted. He stated that the Code book could be reduced
by leaving out (a) the street lists, (b) the verbatim state laws (most of
which are in Chapter 2, the administrative section) and are listed in
the state statutes, and (c) the zoning ordinances (subdivision, flood
control, dangerous building ordinances) . Ile recommended that the zoning
ordinances be printed in the zoning booklet and updated in it rather
than in the Code book. The consensus of the Council was to leave the
statute references in since they would not be subject to much change.
After discussion of costs of printing and number of pages in the Code
book, Councilman Blume moved that the street lints and the land use
(zoning) sections be deleted and kept updated in separate publications
elsewhere in order to reduce the Code book to 500 pages (the number of
pages included in the bid) . The motion was seconded by Councilman
Hequembourg and approved.
Upon motion by Councilman Blume and second by Councilman Adjournment
Hequembourg, the meeting was adjourned.
