Councilman Whitecotton requested, as a Member who had voted egainst Bill 169. Bill No. 169, that such Bill be brought back for reconsideration. Contract Bill No. 169, introduced by Councilman Wade, entitled: Capps - "An Ordinance of the City of Jefferson, Missouri, authorizing the . nimal Mayor and the ''Clerk of the City to execute a contract with Shelter. Forrest Capps and Associates , relating to the design and construction of a new animal shelter facility at 917 East Miller Street. Councilman Wade made the motion that the Consent Agenda, including the minutes of the Council meeting of January 19th, and the Approval. recommendations for acceptance of bids , be approved. Motion seconded by Councilman Whitecotton and passed. The minutes of the Board of Adjustment meeting of January 13, 1981 Minutes were received and filed, filed. The application for rezoning from Adrian Enterprises , Inc. , • lanning Jefferson City, Missouri, for rezoning of Lot 11 in Block 12 of and Washington Park Addition, from RS4 to C-2, was referred to the IZoning Planning and Zoning Commission. Commission. The application of Richard J . and Louis C. Councilman Borgmeyer then made the motion that such report be made available to the Council and Department Heads by next Council Meeting. Motion seconded by f Councilman Hequembourg, Councilman Kliegel referred to the audit which will begin in ( March and stated that perhaps the Finance Department was preparing their records for that and bringing records up to date. The )Auditors have presented a list of items they want ready for them 1when they start the audit and they are working on that. In seconding the motion, Councilman Hequembourg stated he (, thought the only way we will get this information is to put a ! deadline on it. After the audit is started it will be several ' months before such information is available. • Councilman Brant stated he agreed we should have this inform- ation but we have had personnel turnovers , are short one accountant and the new Finance Director was only appointed several weeks ago, and we are short a back-up person. On the voice vote the Mayor could not determine so asked for a Roll Call vote which was as . follows and defeated the motion: Councilmen voting Aye: Borgmeyer, Gordon, Halsey, Hequembourg, Whitecotton. ; Councilmen voting Nay: Brant, Cruder, Kliegel, Prenger, Wade. j With the tie vote Mayor Hartsfield voted Nay", ' Mayor Hartsfield referred to a letter received from Dave Brydon, Liquor ; representing owners of The Tap Room. Mayor stated the Liquor Licenses ! Control Board would meet immediately following the Council meeting and discuss The Tap Room and also the business at Sunset Lake. Councilman Borgmeyer inquired of the Police Chief if it was true there was no Ordinance which would allow cars to be towed 1 away if they blocked a private drive. Chief Patton stated the car could be towed away - - we do not write tickets on private drive- ways or property unless the owner of the property makes a complainfi' llf the car is blocking the driveway and the owner cannot get in, the car can be towed away. The owner of private property where . j • tithe car is parked must sign a complaint before the car can be towed f; away from a private drive. II Councilman Bor me er stated that such an Ordinance should be drawn and he will introduce the same. Mayor stated there will be other features probably that should be covered in an Ordinance, ;1 • (" and this will be discussed at the Liquor Control Board meeting. Ii Mayor Hartsfield stated if anyone in the gallery was here in the i{ f interest of the landfill - he would comment - to his knowledge the lI City holds no option on any property. Ordinances. At this point there still is nothing going on. 36 'x Regular Council Meeting, February 2,1981 . Mayor passed out a list of a Citizens Advisory Committee, a �_ -AI , temporary special Committee, which is a Federal requirement. The members need to come from a particular type and represent different interests, and develop a transition period for transportation Citizens facilities, to comply with regulations . Councilman Whitecotton Advisory made the motion that the entire Committee be approved. Motion Committee. seconded by Councilman Crader and passed. Mayor Hartsfield referred to the Work Sessions to be held on the off-Monday nights . We would like to get a schedule, at least for the first half of the year, for the Boards to come and meet with Work the Council. You can decide which ones you want to meet with and Sessions . which ones you do not - then set up some kind of calendar. Councilman Borgmeyer inquired about the minutes of these f meetings and Mayor informed him there were none taken at last ' Monday's meeting - it was up to the Council to decide. Councilman Hequembourg agreed that such minutes should be taken and kept at these Work Sessions, and it was the general concensus of the i, Council that minutes should be kept . The Mayor so informed the I - City Clerk. Municipal -4 1 Mayor announced the Municipal League Legislative Conference will League 3 ;.; be held April 1st and 2nd at Ramada Inn - if anyone wishes to Legislative :, attend notify Gary. ! Conference. Mayor called for a status report from the two Special Sub-Commit- tees - both to look at Ordinances - one for Parking Authority and Sub- one for the Airport. Committees Councilman Prenger, referring to the Ordinance revising the Parking Parking and Traffic Authority, stated they had met once and have I and re-written some language into the Bill. It is being typed up into ! Airport . preliminary form to where we can review it and make final adjust- ments on it before we meet with the counterpart Committee and coordinate the two. We probably will have the Parking Authority j Chairman with us at our next meeting to go over the language of II the Bill. Councilman Hequembourg, the Committee on the Airport , has not 1 yet had a meeting but hoped to have one before the end of next 1; week, so we can go thru the Ordinance the first time before we f) meet with the Airport Conunission. Bill No. 178, introduced by Councilman Whitecotton, entitled : ' " An Ordinance of the City of Jefferson, Missouri, amending I, Ordinance 8356 as amended by Ordinance 8698 and Ordinance q granting a Franchise for cable television service, by changing the ! rates charged to customers as set forth in Paragraph 14, and by repealing Section 18 and enacting a new Section 18 in lieu thereof7j Bill No. 178 read first and second time by title and Council- ;i man Whitecotton requested that the rules be suspended, the Bill �: read the third time, and placed on final passage. 111Bill 178. Discussion followed. Mayor and City Attorney stated they Cable would like to see action on the Bill because the Franchise was up {. Television for renewal . We are in the final three months of the current ', Rates . Franchise, there are bids out. City Attorney Graham stated he was not sure what the motive behind the request is , but if you would I= pass this Bill you might possibly jeopardize the City's position with respect to the bids. I do not think we want to put ourselves I# in the situation of giving anyone a property right in this I Franchise, by allowing them to spend money for new equipment . 1 li do not think we can deny them the right to do whatever they want I to, in terms of upgrading the equipment, but it needs to be made abundantly clear that they do it at their own risk and the City is Ii not putting itself into a position of liability. !# Councilman Wade referred to an article in the TV Guide about ! earth satellites (August 16th to 22nd issue) . The article written by Ron Powers, a Pulitzer prize winning critic. After reading this article, this is one reason the Ordinance should be turned {! down. And he monitored q, the earth satellite and then wrote quite an article about 5 it. And his comment was that there wasn't anything of any 6 value connected with it because by the time that there was - P. 7 some mention of a particular program, then they would switch 8 you to--if it was coming from Atlanta, Georgia, then they O 9 switch you to Los Angeles. 6 10 And about the time that they switched you to 0 r 11 Los Angeles, then they were giving a news item that was not y : iz in depth, just a mention of it, then they would switch you 41 13 to New York for a sports comment and they may have mentioned a 14 a football player instead of telling why they were montionin: 1 15 him of any consequence. 16 They would switch you then to some other city. 4 17 So that is one reason why I feel like that we ought to turn Y w 18 down this particular ordinance. 19 MAYOR HARTSFIELD= Mr. Whitecotton, did you 20 request suspension of the rules or do you want to so I can 21 act on it? Is there any objection to suspension of the 22 rules? Mr. Borgmeyer. 23 COUNCILMAN l0RGMEYER: Well, I don't know if 24 I'm going to object or not, but what's the purpose of 25 introducing it and all of a sudden we're rejecting the thing 4 1 What makes any difference if we let the thing ride for two 2 weeks? 3 MR. GRAHAM: Well, I think because of the lateness 4 of the request we will have bids corning in, I think, within 5 about three weeks is the bid date. I think we ought to, 6 you know, take some action on it and not let the thing 7 just ride out. 8 I think we the city would be in a better position 0 i 9 to act one way or the other on it and dispose of the issue U 10 and not let it keep hanging. Council 21 approved the first one, and this was the second one which was 22 withdrawn. Pulliam, Dean of Administrative Affairs , Lincoln University, and Dr. Freeman, 1000 block of Lafayette Street , all appeared objecting to the speed limit being increased from 20 M.P.H. to 30 M.P.H. Chief Patton stated they would start a speed check in that vicinity in the morning. Discussion had about notification of these changes to the Council- men from the Wards in which they are located, Mayor requested Parking Marty Brose to see that an Agenda from the Parking and Traffic and meetings be sent to the Councilmen. Traffic After further discussion, Councilman Halsey made the motion Bills . that we send notices out to adjoining property in the area, notifying them of possible Ordinances which might be introduced affecting parking and traffic ordinances .
