HomeMy Public PortalAbout19810119 27 REGULAR COUNCIL MEETING, January 19, 1981 Mayor Hartsfield presided. Prayer offered by Rev. Don Salisbury , Chaplain , St . Mary ' s Health Center. Councilman present : Borgmeyer, Brant , Crader, Gordon , Halsey , Hequembourg, Prenger, Wade and Whitecotton. Councilman absent : Kliegel A Public Hearing was held on the proposed revisions to the present Public Zoning Ordinance. Hearing Mr. Charles Jackson , member of the Planning and Zoning Com- Planning mission and Chair person for the revision of the Zoning Ordinance, and stated he was here in favor of the new Ordinance. There have been Zoning many months of deliberation by members of the Committee and Com-• Ordinance. mission and felt that the plan set out is very good for the City of Jefferson. He offered to answer any questions regarding the new Ordinance. { Councilman Hequembourg submitted some amendments and the Mayor suggested copies be mailed to Council Members , Planning and Zoning Members , Mr. Benton and City Attorney Graham. They can then be discussed when the Ordinance is introduced. J. Raymond Brummet was recognized and stated he really was not in opposition to the Ordinance but did want to answer a question - he cannot find anything in the Proposed Ordinance where any provision has been made for fee simple town houses. Mr. Jackson replied that type of construction could be covered in the RA District and in the Planned United Development Districts. In the new Ordinance the P.U.D. District takes the place of S Special Development Districts. Councilman Borgmeyer presented a statement from Mr. Groner, who was unable to attend the meeting tonight , but did wish to get these matters before the Council. Mr. Brummet then stated there was another thing he wished to got cleared up - whether or not a Real Estate Broker , representing a client , can testify before the Planning and Zoning Commission and present the case of his client. Ho asked for a clarification in this Ordinance. Councilman Hequembourg stated this was include• l in ono of the Amendments he had submitted. Mr. Bob Collins , representing the Jefferson City Kennel Club, stated they felt it unnecessarily restricts the hobby of breeder or dog-fancier or animal lover, when it in not necessarily a cm- ' mereIa1 operation . Phis proposal limits the number of dogs any family may have in their possession at any one time but no mention made of cats , other animals , or stray dogs. It does not regulate the unhealthy or poor breeding facilities. Mr. Collins stated he felt he was also talking for hunters and breeders in this area - a lot of people have dogs which they got to use just once or twice a year - you cannot tell when a young dog, under six months of age, is going to be a hunter or not . A representative of the Central Missouri Beagle Club was present and Libby 'Then stated it was necessary to keep the hounds long enough to determine if they were good and sometime you would need more than four to get a Champion. She stated it was not the number of dogs in the kennel - it was the way they were taken care of. No one else desired to be heard. Mayor Hartsfield stated this would conclude the Public Hearing. Public A Public Hearing was held on the possible uses of Revenue Sharing. Hearing No one appeared. Bill No. 170, introduced by Councilman Wade, entitled : "An Ordinance of the City of Jefferson, Missouri , authorizing and Bill 170. directing the Mayor and City Clerk of the City to execute a writte ' Agreement agreement on behalf of the City with Boyd Brown Stude & Cambern , Parking consulting engineers, for the design of a proposed parking facilit . " Facility. Mr. Thomas, Chairman of the Parking and Traffic Commission , explained the Bill, stated it was a public service, and very much needed at that location. Mrs. Mary Ann Caplinger, President of the Downtown Merchants Association, stated they were very much interested in preserving the downtown area; in the past few years downtowns have gone to rack and ruin throughout the country, but we have maintained our stability and we are proud of that . We need additional parking. The Mayor then returned to the Consent Agenda and requested ap- Consent proval of the Council Minutes of the Meeting of January 5, 1981 , Agenda the Administrator' s Report , and recommendations on bids previously opened. Councilman Halsey moved that such Agenda be approved. Motion seconded by Councilman Wade and passed. Mayor Hartsfield stated the TCI Cablevision Company had requested TCI to make a report tonight to the Council and he called on Mr. John Cable Hendren, who introduced Mr. Paul Alden to make such report . TV Mr. Alden stated that in October of 1980, they had appeared Report. before the Council and asked for a rate increase of forty-five cents per month to allow for the upgrading of service and instal- lation of new equipment. We withdrew this request upon your suggestion. We now have received your Proposal to Bid. Now, we are here again to request your approval for a rate increase of forty-five cents per month. If the raise is granted we would proceed with installation of the earth station and it could probably be completed within thirty days. Copy of Ordinance with the new rates was distributed and Councilman Whitecotton agr-red to sponsor and introduce the same at the next meeting. Mayor Hartsfield then asked for approval of the appointment of Mr. Appoint- Bob Pridy to the Thomas Jefferson Library Board. Councilman monts Whitecotton made the motion that such appointment be approved; Library motion seconded by Councilman Hequembourg and passed. Board III Mayor Hartsfield then asked for approval of the appointment of Airport Earl Campbell to the Airport Comnsiselon . Councilman Halsey made Commission the motion that much appointment be approved; motion seconded by Councilman Whitocotton and passed. Mr. Broso will not of be replaced in Public Works. Transpor- tation. Mayor Hartsfield nominated Jim Uffman as Finance Director, with a salary of $24, 529 , effective January 23 , 1980. Councilman Finance Hequembourg suggested we not fill the position of Comptroller at Director this time, wait and see about computer usage. Motion made by Councilman Whitecotton that such appointment be approved. Motion seconded by Councilman Crader and passed. Mayor Hartsfield mentioned several procedures which he thought we Proper had not been following properly. Procedures. A call for the question needs a two-thirds vote before dis- cussion can be ceased. A motion to adjourn should be voted on. The Mayor can vote to break the tie when the vote is 5 to 5 on a motion or on an Ordinance. Y1 Mayor Hartsfield then brought up the discussion of the Firemen ' s Agreement and asked Mr . Hamburg to explain the changes which had Firemen 's been set out in information furnished the Councilmen. Agreement . Mr. Hamburg explained the Agreement would be for a one year period, rather than for two years. Also, the City would work with the Union, during the period of this Agreement , to bring the Ordinance regarding the Firemen ' s Pension Plan up to date , and hopefully have it ready for a vote of the people by the end of this one year agreement . Councilman l3orgmeyer inquired if there was any way we could also put on the ballot the question of doing away with the Pensio Plan and putting the Department under Social Security and Lagers , the way the other City employees are covered? City Attorney Graham replied this could be done by a vote of the people if it (( was worked out through the Council. Mayor Hartsfield stated the Council would have to resolve the question of the effective date - in the past the meal al- lowance has been paid in advance - do you want the Finance De- partment to go back and deduct the meal allowance for two weeks or do you want this Agreement effective January 5th? Mr. Hamburg • . h . 33 REGULAR COUNCIL MEETING Januar 19 1981 also stated that over the past weekend some of the Firemen stepped up voluntarily, with the understanding that the Council at the last meeting had said there would be no pay for that . Councilman Hequembourg made the motion that we approve the new Agreement, with the effective date January 5, 1981. Council- man Whitecotton seconded the motion and it passed unanimously. The next matter Mayor Hartsfield brought off the Agenda was the Census Census issue. City Attorney Graham advised there would be an Issue approximate cost of five to ten thousand dollars as an estimate of the case, to be filed in the Federal District Court , Central Division, Western Missouri, and in the interim we would attempt to make a recount . Mayor stated he had written to Senator Danfort, in an attempt to get an enumeration count by District - there are about thirty-five Districts, but has not had time for a reply. • However, a total head-count would be the best evidence for Court . The Census Count would have an impact on-Grants, gasoline tax, etc The recount would have to be completed by April 1st . Councilman Hequembourg made the motion that we file suit , keep the options open, allowing us the time to go ahead and make the recount. Motion seconded by Councilman Wade and passed un- animously. Councilman Borgmeyer presented a petition about Woody 's Tavern on Woody's Sunset Lake Road, complaining about traffic problems, language, Tavern and general problems for the neighborhood.
