T .. ? ..., .t. 380 • a y�rr REGULAR COUNCIL MEETING, JANUARY 17► 1983 ,7..= The regular Council meeting was called to order at 7:30 P.M. with Mayor Hartsfield presiding. Prayer was offered by Rev. Harrel Sanders, Rector of Grace Episcopal Church. Councilmen Present: Blume, Borgmeyer, Davis, Gordon, Hequem- Roll Call bourg, Kliegel, Lock, Roark and Scheulen. Councilmen Absent: Halsey A quorum was present • The first item of business was a Public Hearing on the Special Business Public Hearing District. Mayor Hartsfield announced that the proponents of the Special Gfi= Business District had requested a continuation of the public hearing until February 7, 1983. Representatives of TCI, Mr. Don Morris and Ms. Shirley Zbinden, were TCI Report present to make a report on progress of updating the Jefferson City system. Councilman Borgmeyer asked Ms. Zbinden how long it was expected to take to complete the upgrading process, to which she replied } that it should take seven to eight weeks. Councilman Scheulen asked if TCI would be able to retain Channel 9. Ms. Zbinden stated that an ° announcement regarding Channel 9 would be made in a few days. Councilman Blume asked questions regarding programming to which Ms. Zbinden replied that a programming report would be made at the February 7 meeting. Mr. [flume also asked if TCI would be selling local. advertising on the 2/4--hour free networks. Ms. Zbinden stated that no advertising would be sold to place on the free channels. Councilman Blume also asked if TC I was aware that Channel 6 of Warrensburg is considering offering their channel on re !subscription toasts, and if so, then ICE would not be required to ea rry it . Mr. Blume stated that management of Channel 9 had informed him that the it would be no conflict involved in carrying both Channel 9 and Channel 6. A petition' was presented to the City Clark signed by citizens in support of retaining Channel 9 so that it could be lorwurded tea Tel. The next item of business was the Consent Agenda , which included, Consent Council Minutes of the Regular Meeting held January 3, 1983, the City Agenda Administrator's Report , and awarding of the following bids: Biel No, 286 Vehicle Conversion Kits/Ii ID CANCELLED, WILL R REBID. Bid No. 289 Photographic Supplies, Police Department. Bid No. 290 Shoes, Police Department. Councilman Scheulen asked how the Council can determine, on a percen tage discount bid, what figures on which the City is receiving a quote. discount. James Hartley explained that the two lowest bids were scrutin ized and retail prices were checked before awarding the bid. He als• stated that the City has the option to look at a bidder' s retail price at any time after a bid has been awarded. Councilman Scheulen moved that the Consent Agenda be approved, the mo tion was seconded by Councilwoman Lock, and approved. Those persons approved for F • reappointment are Dan Ruzic, Environmental Quality Commission ; Tell 1.41. • Neff, Environmental Quality Commission; Debbie Cooper, Environmental Quality Commission; Terry Allen, Police Personnel Board; Dr. Bob Fuchs, Animal Control Advisory Board; and Mary Turner, Animal Control Ad- - visory Board. Those persons suggested for appointment are: Mr. Paul Cannon, Parking & Traffic Commission (Alternate) ; Mr. Don Shinkle (Democrat) , Police Personnel Board; and Mrs. Betty Weldon , Housing Authority Board. Chief Patton stated that they administer the testing of prospective police personnel. in order to maintain eligibility Iists from which the actual 1 hiring can be done by Chief Patton and/or any other persons in a 1 supervisory position within the Police Department . Betty Weldon Before Mrs. Weldon was voted on, Councilman Blume asked Mayor Hartsfield why Mr. Wankum was being, replaced. Mayor Hartsfield stetted that Mr. Wankurn had indicated he would serve. if asked, but would • rather be replaced after having served many years on the Board. Councilman Borgmeyer asked if the City already had an ordinance regarding free parking on holidays. Marty Brose, Director of Transporta- tion, stated that there had been considerable confusion in the past t 388 ?„ because people believed there was such an ordinance existing but in '' reality there was not. Nay: Blume, Borgmeyer and Kliegel. 384 • Bill 82-153, sponsored by Councilman Halsey, entitled: 82-153 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AMENDING THE Animal Control CODE OF THE CITY OF JEFFERSON, MISSOURI, BY DELETING SECTION 6-36, Advisory Board RELATING TO ANIMAL CONTROL ADVISORY COMMISSION AND BY ENACTING IN LIEU THEREOF A NEW SECTION 6-36 PERTAINING TO THE SAME SUBJECT MATTER. • Councilman Borgmeyer asked why an opening existed on this commission, to which Mayor Hartsfield replied that when the commission was estab- lished three years ago a position was designated for a Council member. No Council member has been found who wished to fill that position, thus it has been vacant. The bill would allow a citizen to fill the seat that has been vacant. Nay: None. • The next item of business was the Informal Calendar. Informal Cal. Councilman Scheulen stated that he would like to have the bill placed on final passage and :suggested an amendment to the bill which would 82-132 include the burning of trash and brush. Councilman Davide requested an Solid Waate explanation of the differences in the bill being voted on and the one Code presently in force. Since no detailed list of differences were available, Councilman Scheulen requested that the bill be held over once again and • Mayor liartsfield directed Lyndel Porterfield to draft an outline of the differences requested by Councilman Davin,*to be presented at the next meeting. Therefore, Bill 82-132 was held over on the Informal Calendar. Councilman Roark requested that Bill 82-135 be held over on the 82-135 Informal Calendar. Councilman Borgmeyer requested that Bill 82-145 be held over on the 82-145 Informal Calendar. The next item of business was the adoption of Resolutions. The following resolutions were presented to the Council for adoption: RS82-30 Resolution 82-30, pertaining to a light pole on East Capitol Avenue; RS82-31 Resolution 82-31, pertaining to a light pole on Huntleigh Place; and RS82-32 Resolution 82-32, stating Council's support of retaining Channel 9, KETC on the TCI cable system. Councilman Hequembourg moved that all three Resolutions be adopted, Councilwoman Lock seconded the motion, and it was approved. • * and Councilman Borgmeyer • 8 8 6 payroll Mayor Hartsfield stated that the discussion of Payroll Checks/Signatures : check signature: would be discussed in the Executive Session. - status of vide. Councilman Borgmeyer asked the status of the writing of an ordinance game ordinance prohibiting video games on City-owned property. Mr. Porterfield stated that he was still researching the subject at this time. He stated that thus far in his research, no indication has been shown whereby the City can regulate such activities. He stated that he will need to do further research before attempting to write an ordinance. Mayor Hartsfield requested that for the next meeting either a legal opinion stating why the City cannot control video games or an ordinance authorizing control for introduction at the next meeting. Executive Upon motion by Councilman Hequembourg, and second by Councilman Session Davis, the meeting was adjourned to Executive Session for the purpose of discussing litigation and personnel matters by the following vote: • Aye: Blume, Borgmeyer, Davis, Gordon, Hequembourg, Kliegel, Lock, Roark and Scheulen.
