The Agreement will be rewritten by the City Attorney and submitted ! for final approval. Councilman Kliegel made the motion that the Agreement be accepted a amended. Motion seconded by Councilman Prenger and passed. 2. Request from Cole County to vacate a 10' alley adjacent to the Old Library Building. Discussion had about the matter and Mr. Bates explained the same. 11 Councilman Gordon moved that the matter be approved. Motion seconded by Councilman Kliegel and passed. i 3. Data regarding 90 day trial of joint fare system with MOGO (system is currently being operated by OATS) . Mr. John Bryan `I explained there is no duplication in the routes with the City buses, it is on trial basis, and this is just mentioned for informational purposes. f r 4. Mr. Tom Benton i 'explained the matter - there is approximately two hundred (200) feet frontage - the sale no doubt would have to be advertised and bids ': jopened by the Council. There is one party who is interested in i` 'purchasing the property. There are already five duplexes south of ;the alley. It is now zoned residential and would have to be rezoned{ for any other purpose. Mr. Benton suggests it be advertised and '' sold as it is now zoned. ?Councilman Gordon made the motion that Mr. Benton check with ;adjoining property owners as to their feelings regarding rezoning of�1 this property, and report back to the Committee. Bob Simonds presented a sketch showing the 60 x 60-foot area that has been set aside for beautification. MAINTENANCE iiMikeBates reported that the Public Works Department is very pleased :x with Laurence Clarkston' s performance as far as maintenance of the (downtown trees is concerned. Agenda { i 5) ALLEN POLLOCK presented an updated financial statement of the Jefferson City Tree Program (Exhibit A) . a) Three tree replacements have been made on (High Street . b) Madison Street replacements are about eighty per cent completed. c) The Japanese Pagoda tree has been planted in the Monroe Street Parking Lot. d) Sunrise Gardens Nursery is making replacements on Ellis Boulevard. Allen Pol lock will notify property owners that they will need to assist with watering of the trees., 1{6) DICK PRESTON, attending for the first time, reported that he is ! working with Tim Frevert on a landscaping plan for the new City ! Police Building. Currently he is working on landscaping the city ' parking lot on High Street between Adams and Monroe Streets and has an on-going program to be sure that now parking Lots are landscaped properly Environmental Quality 17) BUDGE REQUEST Commission ! Tom Whitecotton reported no progress as far as the EQC request for ! funds from the City is concerned and noted that there has not been an expeditious time to pursue the budget request. It will , however , pjbe presented at a later date. 1' 8) HISTORICAL REPORT BY B. J . DeLONG 1 Mrs. DeLong, presiding for the last time as this year' s chairman of 1the Commission, presented each member with an historical report E which she has prepared covering the accomplishments of the Environmental Quality Commission since its inception , except for the last two years. (Exhibit B) Her report of the past two years will be forthcoming. Judge James A. Finch, Jr. , incoming Co-Chairman, expressed appreciation for Mrs. DeLong' s review and declared that it will be very helpful to him as Co-Chairman with Sam Cook for the coming year. Judge Finch stated further that he looks forward to another y good year for the Commission, especially if some funding can be obtained from the City. 9) APPRECIATION TO MARK SULLIVAN ♦ Judge James Finch made a motion, seconded by Tom Whitecotton, that lea letter of appreciation for his work on the Commission be sent to ;Environmental Mark Sullivan. Motion carried unanimously. ;'Quality 10) Mrs. DeLong expressed appreciation to all members of the Commission ? Commission and especially to all who attend and serve faithfully in , Ian advisory capacity. The second Thursday of each month was agreed upon for regular meetings. Councilman Gordon seconded the motion and it carried. 1! djournment There being no further business meeting adjourned to go into executive p Executive Session. ession 3 • WORK AGREEMENT BETWEEN CITY or JEFFERSON AND LOCAL 45, LIUNA, AFL-CIO ARTICLE I - Preamble This Agreement is entered into by and between the City of Jefferson, Missouri , hereinafter referred to as the Employer, City , or Management , and Local 45 of the Laborers' International Union of North America, AFL-CIO, hereinafter referred to as Union. The Employer and the Union recognize their responsibilities , under Federal , State and Local laws, relating to fair employment practices and appropriate labor legislation; and reaffirm their commitment to the moral principles involved in the area of civil rights. The parties agree that there shall be no discrimination because of race, creed, sex , color , age, nationality, or political beliefs, or for participation in or affiliation with any labor organization. The City and the Union agree that the provisions of this Agreement shall apply to all employees covered by the Agreement, without discrimination. The purpose of this Agreement is to set forth terms and condi- tions of employment , and to promote harmonious, orderly and peaceful labor relations for the mutual interest of the Employer, the Union , lit and the citizens of the City of Jefferson . ARTICLE II - Recognition The Employer recognizes local 45 of the Laborers' International Union of North America, AFL-CIO, us the authorized representative of all employees , excluding supervisors , in the Engineering and Sewer Division , Street Division and Transit and Central Maintenance Garage Division of the City of Jefferson , Missouri . The Employer agrees to consult with the bargaining unit concerning matters affecting working conditions or grievances of its members, to the extent that such conferences do not abrogate or in any manner abridge the right of Management to conduct business as set forth in this Agreement . ARTICLE III - Management Rights The parties to this Agreement recognize that specific areas of responsibility must be reserved to Management if the public service mission of the City is to function effectively. Unless specifically modified by any subsections of this Agreement , the City possesses the sole right to operate these departments and all Management rights repose to the City. ARTICLE IV - Work Day and Work Week • Beginning of the work week shall be at 12 : 01 a.m. on Sunday and end at 12: 00 midnight the following Saturday. A basic work week will constitute forty (40) hours. Eight ( 8) hours shall constitute a regular day 's work. 11/ All work performed over eight ( 8) hours in any one regular work day or forty (40) hours in one regular work week shall be paid at the rate of one and one-half ( li) times the regular hourly rate of pay. r .f gr Lt` ARTICLE V - Union Business Employees elected to Union Office shall be granted time to perform their Union functions. The Employer shall allow space on bulletin boards, which may be used by the Union for posting notices bearing the official , written approval of the Union. Union notices shall ;k'° be restricted to: 1 . Notices of Union elections; 2. Notices of Union appointments and results of Union elections; 3. Notices of Union meetings; 4. Other notices of bona fide Union affairs which are not of a political nature. B. Authorized, official Union business agents, not to exceed two (2) at any one time, may have access to the City facilities, during working hours, to investigate matters directly relating to the administration of this Agreement , as long as it does not disrupt regular City business. C. The City shall furnish to the Union , and each member, a copy of the following: 1 . Current Agreement between the City and tho Union; 2. Current adopted personnel policy, procedures, rules and regulations; 3. Departmental rules and regulations; ARTICLE VI -- Rules and Regulations The Union agrees that its members shall comply with all Departments' rules and regulations, including those relating to conduct and performance. They Employer agrees that departmental rules and regulations, which affect: working conditions and performance, shall be subject to the Grievance Procedure. ARTICLE VII - Grievance Procedure A. The Union Grievance Committee , upon receiving a written and signed petition, shall determine if a grievance exists and that effort to resolve the problem at the supervisory level , has been unsuccessful . B. If a grievance does exist, they shall , with the physical presence of the aggrieved employee, present the grievance to the Director of Public Works for adjustment . C. If , within ten ( 10) business days, the grievance has not been settled, it then shall be submitted to the Mayor or his delegate. D. If, within twenty-one (21 ) business days, the grievance has not been settled, it shall then be submitted to arbitration for adjustment. 1 . The Arbitration Board shall consist of : a. Appointee of Employer; b. Representative of the Union c. Representative appointed by the Employer and Union. -2- • • • E. The majority of the Arbitration Board shall render a decision and that decision shall be given to all parties concerned for advisement . Arbitration shall not be binding • on either party. • 1. The cost for the services or arbitrators shall be shared equally by both parties to the arbitration. ARTICLE VIII - City Vehicle Liability Insurance The City shall provide adequate group liability in the form of blanket coverage for employees who are required and qualified to • operate a City owned vehicle while on duty. Individuals operating City owned vehicles must possess a current , valid operator' s license in the State of Missouri. ARTICLE IX - Sick Leave All employees shall accumulate sick leave as prescribed by Section 28-25, Jefferson City Code, 1978. ARTICLE X - Emergency Leave Each employee shall be granted emergency leave as prescribed in Section 28-26, Jefferson City Coda, 1978. ARTICLE XI - Salaries All employees covered by this Agreement shall be classified and paid in accord with wages and classifications as per Schedule A attached. ARTICLE XII - Retirement Each employee is hired on a six (6) month probationary basis. Upon satisfactory completion of this probationary period, the City will contribute to the LAGERS retirement system for each employee with employee benefits being computed upon a li% basis upon retirement and as provided in Section 28-8 to 28-10, Jefferson City Code, 1978. ARTICLE XIII - Family Medical Coverage Program The Employer agrees to contribute one hundred ( 100%) per cent of the cost to the individual major medical program provided by the City. The Employer agrees to contribute twenty-five (25%) per cent of the cost to the family major medical program provided by the City. • Starting date of coverage will begin November 1 , 1979, and remain in full effect during the term of this Agreement. -3- • ARTICLE XIV -- Holidays Holidays will be observed pursuant to the terms of Section 28-- 27, Jefferson City Code, 1078. The Employee' s Birthday will be observed within fifteen ( 15) • days prior to or fifteen ( 15) days after the actual birthday, and with supervisory approval . ARTICLE XV - Call-in and Call-back An employee called in to work on a day not scheduled, will be given a minimum of two (2) hours work, or a minimum of two (2) hours pay , if given less than two (2) hours work. • 1 . An employee that has completed the scheduled day and left the work place and called back will be given a minimum of two (2) hours work or a minimum of two (2) hours pay. • 2. An employee called to work before the normal shift time and continues workiAg into the regular shift , will not be • considered to be either called-in or called-back, and will be paid only for all hours worked. If there is a thirty (30) minute or less period between the time of completing the work for which the employee was called in before normal starting time, this time will be considered also as time worked. ARTICLE XVI - Vacation Time Each employee shall be granted vacation leave as prescribed in Section 28-24 , Jefferson City Code, 1978. • ARTICLE XVII - Seniority Employees will not be suspended or discharged without just • cause. The City will notify the employee in writing of any suspen- ' sion or discharge, with a copy of said notice to the steward of the respective division. If it is necessary to adjust the work force, employees will be laid off and/or recalled in accord with their "Division" seniority, with the last senior employee being laid off first and the most senior laid off employees recalled first , provided, however, that employees regained or recalled have the necessary qualifications to do the work that is available. Seniority for the purpose of vacation and retirement shall be City-wide seniority, from the employee' s last date of employment . ARTICLE XVIII - Rest and Lunch Periods Employees will be given two (2) fifteen ( 15) minutes rest periods with pay during the normal work shift . The rest periods may be designated by the City. The employee shall be allowed one ( 1) thirty (30) minute lunch • period per work shift . Supervisor may require employee to eat lunch at the employee' s work location, except when the temperature is below 200 or above 900. • -4- • • I • ARTICLE XIX - Stewards 1. The Union may appoint a Steward in each Division and . will notify the Department Head of the appointment. The Steward shall be subject to the same terms of employ- ment as any other employee, but he shall not be discriminated against by reason of the fact that he is serving as a Steward. 2. The Steward shall be a working employee who shall, in addition to his regular work, be permitted to perform his duties as a Steward during working hours. A Steward' s duties shall include the adjustment of grievances. The Union agrees that such duties shall be performed expeditiously and will not interfere with normal work progress. 3. When any employee is subjected to disciplinary action , transfer or discharge, the Employer shall notify the Union. ARTICLE XX - No Strike Clause During the term of this Agreement , the Union agrees not to strike as provided for by the laws of the State of Missouri. ARTICLE XXI - Agreement Binding . on Successors This Agreement shall be binding upon the parties and their successors and assigns, and no provisions, terms or obligations herein contained shall be affected , modified, altered or changed in any respect, without mutual consent . ARTICLE XXII - Duration of Agreement This Agreement shall be effective as of the first day of January, 1980, and shall remain in full force and effect until the last day of October, 1980.
