Mr. Randolph referred to the Junior and Senior Controller, Airport one employee had been with them for six years and the other for Salaries. two and now they both make the same salary under the new pay plan. Mr. Hamburg explained that the employee who had been with us for six years got better then a seven per cent raise and the employee who had been with us for two years did get a much larger raise. Mr. Randolph read a Resolution passed by the Airport Commission requesting that this inequity be corrected by advancing the senior employee another step. After discussion and questioning on the matter, Councilman Hequembourg made the motion that the salaries remain as they are, that the recommendation of the City Admini- strator to uphold the Pay Plan, be accepted. Motion seconded by Councilman Whitecotton and passed with one no vote from Councilman ! Borgmeyer. I r 1 I I A PUBLIC HEARING was held for an Amended Capital Improvement Project for the City of Jefferson, Missouri, Monday, January 5, 1981, Council Chambers , 7: 30 o'clock P.M. , for the purpose of considering Amendment to No. M0-03-0008, an Urban Mass Transpor- tation Capital Grant. The project is now complete, with remaining funds of approximately $81,000.00. . Mayor Hartsfield stated there had been no response to the ad, either orally or written, but the Transportation Section of the Highway Department stated bhe hearing should be conducted. Mayor asked if anyone desired to speak on the matter - the expenditure of the residual funds of $81,000. 00 left from the Grant . Councilman Borgmeyer asked how this Grant compared to other Grants we have had - is this an added Grant? Mayor and Mr. Marty Brose replied with the information that there was approximately $81,000.00 that had not been expended, it was left over from the original Section 3 Grant, and we are apply- . ing to use that money to provide 12 additional passenger shelters and 800 bus stop signs, a power pack and transmission for the 1979 buses , and 5 two-way radios for tripper (commuter) runs . Councilman Borgmeyer inquired as to where the new shelters would be located and Mr. Brose stated there were thirty possible locations, based on boarding and alighting studies , which they would have to look at and determine just where the 12 should be located, Mayor Hartsfield stated if there were no more questions, or no one else desired to appear for or against the matter, the hearing would be concluded. There being no further comments, the hearing was closed. The next matter Mr. Randolph referred to was the Secretary _ `.•1" at the Airport - who now spends most of her time with the Parking Authority. Her starting salary was low but when taking over duties at the Parking Garage she got a seventy-five dollar increas: ,. and a seven percent increase the first of November, but he stated she still is not on the same level with other secretaries, con- sidering she has been with the City for over two years. After further discussion Councilman Prenger made the motion that we . concur with the decision of the City Administrator and leave her • salary is. Motion seconded by Councilman Wade and passed. Mayor Hartsfield then referred to the Census Report and called on Mr. Nick Monaco, Chairman of the Census and Redistricting Advisory Census Committee, for his remarks. Mr. Monaco presented the following . Report . Resolution , which he stated includes the nine reasons the Com- I mittee did not agree with the preliminary Census count furnished I the Mayor by the United States Census Bureau : RESOLUTION "RESOLVED: That the Commission does not accept and firmly rejects the Preliminary Population Count of 33 , 794 submitted by the Bureau of the Census as stated to Mayor Hartsfield in the telegram dated . •• November 20, 1980, based upon the following : ( 1) That during the past ten years Jefferson City has perfected several annexations which not only involve large tracts of land which have been annexed to the City of Jefferson , but also includes an additional population which was not included in the 1970 census reported at 32 , 407. I ! II ( 8) That the Commission directed specific questions to the Bureau of the Census concerning various aspects of the population . of the City of Jefferson without receiving satisfactory responses. fl (9) That the Bureau of the Census has demonstrated an in- ability to provide basic information concerning the method used in determining the population of the City of Jefferson and has failed to provide the method upon which the population of Jefferson City 1 was determined. The Commission instructed the Chairman to prepare and I furnish this Resolution to the Mayor and the members of the City , Council of the City of Jefferson , reflecting its position relatives; III to the preliminary population count of 33 ,794, showing an Increase } of only 1, 387 persons residing within the City of Jefferson. /s/ Nicholas M. Monaco, Chairman" 1' {E I' 22 5' I REGULAR C6UNCIL MEETING - January 5, 1981 Mr. Monaco stated he had also been Chairman of the Census Committee. in 1970 and this tim4 they used about the same method of checking Yti as they did in 1970. that time the Census Report was 32 ,407 and we came up with 47,00 This time the Census Report was 33 , 79 and we came up with thefigure of 45,087. The first report from the Census Bureau was a figure of some 29,000, a decrease in popu- lation. We complained about that and when they re-evaluated they Census came back with the figure of 33, 794. He further stated the Com- Report mittee did not believe that there was an increase of only 1387 Conttd. people during the past ten years. Mayor Hartsfield stated he had offers of assistance from the Jaycees and the Rotary Club Members to help in the canvas if we decided to challenge the report . Mr. Monaco stated Larry Kolb , Larry Vincent and Dave Turner, all of the Jaycees , who were the first to come to us and offer help, were present here tonight . Mr. Monaco stated the Council will have to determine whether or not they agree with the figure and wish to challenge but would state that the Committee did not agree with the figure , and we will have to live with it for the next ten years. Mayor then stated he thought the Council should go on records as not accepting the figures of the Census Bureau, and also go on record as pursuing whatever recourse seems to be most logical for challenging those figures in a timely manner. Mr. Tom Benton inquired of the Mayor if he could contact Senators Eagleton and Danforth and Congressman Bailey to see if they could apply any pressure to the Census Bureau to get to us some information and count on the Enumeration Districts. Councilman Brant made the motion that we go on record as disputing the Census count , and that the City challenge this count and proceed, and that within the next two weeks the Mayor and City Attorney will inquire and bring back to us an approximate cost . Motion seconded by Councilman Halsey and passed unanimously. Mayor Hartsfield then stated there were quite a few people here who were interested in the Landfill -- it is not on the Agenda and there WAS no plan to discuss It nt this methh g - lout if any metnbeii of the Council wishes to b.r.iny, up the mat:lur, I L cottIel be done at 'Landfill thin time. Also there hnss tauten montiy spent on core drilling and he was asking who had paid for this. Mayor Hartssi' told replied that there had been no option signed by him. Also , the two Bills calling for core drilling, etc. , on landfill sites, had boon de- feated. If any further action was to be taken thereon it would have to be started on the Council floor. Councilman Borgmoyer presented a paper regarding a boring which had been made on the Ralph Strueckenmeyer property - who did t:ho work and who paid for it? The Mayor or Council Members had not seen such paper. Mr. Alexander advised that such letter had come from Department of Natural Resources. Mr. Hamburg will chock into the matter. The next matter discussed was that of sick leave extension for Fireman Jerome Jacobs. He was injured while not on duty but now Sick the Doctor says he is unable to work and he is applying for Fire- Leave men 's Pension. The Ordinance of the Pension Board refers to Extension disease or injury in the line of duty. The Board is not willing Fireman to grant disability pension unless a Judge interprets that to mean Jacobs. that Firemen are in the line of duty if they were hurt on their s day off, or if the Council chose to revise the Ordinance language I or take some action. As far as anyone can recall , this is the first case of this kind, where there was application for disabilit due to injury received in an off-duty situation. Mr. Haake has asked the City Attorney to take steps to get a Declaratory Judgmen ' on the interpretation of the language. Ca REGULAR COUNCIL MEETING - January 5, 1981 Councilman Prenger made the motion that we seek a Declara- tory Judgment. Motion seconded by Councilman Kliegel but , after further discussion , the motion was withdrawn. City Attorney Graham stated he did not feel that the City should bring the action for Declaratory Judgment. Councilman Hequembourg made the motion that we grant an extension of thirty days sick leave and have Mr. Jacobs get another opinion from the Doctor in Columbia about his disability, and also about his limited disability. Motion seconded by Council man Kliegel and passed. The next matter to be discussed was that of the Contract with the Firemen ' s Union. Mayor Hartsfield stated a previous contract ratified by the Council was rejected by the Union. The only Firemen ' s change was taking the dues check-off clause out of the contract . Union Our Committee - composed of the Mayor, Fire Chief , Mr. Hamburg Contract . and Mike Bates - agreed to take a compromise position on taking the Training Officer and the three Assistant Chiefs positions out of the Union , so that when the new Contract became effective those positions would be non-Union. We took a fall-back position and said that those positions would change from Union to non-Union as they turn over and did not at that time anticipate one becoming vacant. When the position of Training Officer became vacant it was posted as a non-Union position. The Training Officer retired after the first of November - the contract had expired and the Membership had voted down the new contract . The Local went to the Judge for a restraining order and this case has now been con- tinued while we are trying to negotiate. In the meantime we had a request from the Union requesting that they work under the 1979-80 contract until the new contract was finalized. This; letter was dated November 0, 1980, addressed to Gary Hamburg, and no reply was given . Mayor recommended the Council instruct Mr. Hamburg to reply to this letter - the contract is not to be extended and payments to be made under that contract : will cease. Ten instruct Chief Renni.ck , City Attorney and Mr. Hamburg how to handle the matter. ( payments include meal allowance and s ! stop-up pay) . Mr, Hamburg will notify the Union in writing of this action. Motion seconded by Councilman Wade and passed un- animously. I Councilman h orgmeyer made the motion that the City Adtnini- strator and Chief Renni ck select a Training Officer from applica- tions received and present such name to the Council . Motion seconded by Councilman Prenger and passed with one no vote from Councilman Cruder. Special Mayor Hartsfield advised that the Special Council Meeting called Council for January 12th was being cancelled on account of the State In- Meeting. auguration being held that day. Mayor Hartsfield announced the selection of Earl Campbell to Appoint- replace Dr. Bryan Pope on the Airport Commission, and the selectio ments. of Bob Priddy to replace Roger Hall on the Library Board. He asked for any comments from the Councilman. Councilman Halsey has volunteered to head a Committer Station. that would try to find a more suitable location. If it pleases the Council, I will ask Councilman Halsey to chair the Committee, composed of a representative from the Chamber of Commerce , Down- town Association, Lincoln University , etc. We will proceed in thi. manner if there is no objection. Mayor Hartsfield also announced the resignation of Erie A. Taylor , Resignation due to health problems, as Director of Transportation , effective Erie January 23rd, 1981. Shelter, and these Site, studies did identify 915 East Miller Street, as the hest feasible site; and, WHEREAS, the City Council , meeting as a Committee of the Whole, did, on May 14, 1079, vote to establish the present l.00ati.o* of the Animal Shelter at 915 East Miller Street as the permanent location for the Animal Shelter Facility. NOW THEREFORE, LIE IT RESOLVED that the City Council of the City of Jefferson does hereby officially designate the current Animal Shelter site, at 915 East Miller Street , as the permanent location for the Facility , and that furthermore , any improvements or additions necessary in the best interests of the citizens of the City of Jefferson, be made at this site. Councilman Hequembourg referred to a problem on South Country Club South Drive, a stretch of 5. 6 miles , from Highway 50 to the City Limits, Country there have been numerous accidents.
