HomeMy Public PortalAbout19820104 0 216 ' REGULAR COUNCIL MEETING, JANUARY 4, 1982 The regular Council meeting was called to order at 6: 30 p.m. with : ' Mayor Hartsfield presiding. Prayer was offered by Rev. Joel Schmalz, Trinity Lutheran Church. Ball Councilmen present: Blume, Borgmeyer, Gordon, Halsey, Hequembourg, • Call. Kliegel, Prenger, Scheulen and Wade. Councilmen absent: Brant. A Quorum was present. Upon motion by Councilman Blume, seconded by Councilman Wade the Council adjourned into executive session for the purpose of dis- icussing the TCI vs. City of Jefferson litigation. Upon reconvening to regular session the Council was presented Executive a report by the Sub-Committee on Cable TV. Mr. Utterback, the ' Session. :attorney representing the City in this litigation, stated that the report contains no recommendation by the committee as to whom should be awarded the franchise. The report is merely a statement of facts regarding TCI and Central Telecommunications, Inc. Councilman Prenger stated that it was his intention to call a special Council meeting for the purpose of discussing the ' awarding of the cable tv franchise. Upon motion by Councilman Hequembourg, seconded by Councilman Halsey and carried, the special Council meeting was scheduled for January 25 , 1982. Councilman Hequembourg then presented a Resolution extending the current franchise of TCI to April 21, 1982. Councilman Hequembourg moved that the Resolution be adopted. Motion seconded by Councilman Scheulen and carried. I 353 Bob Renard, who was scheduled to give a presentation on Chapter I 053 Development, did not appear due to the weather. Mr. Bros° replied that the City will be reim-- bursed for eighty percent (80%) of the cost under the Section 18 Capital Assistance Grant. After further discussion, Councilman Halsey moved that the Consent Agenda be approved. Mayor Hartsfield stated he has received complaints regarding the Sidewalks sidewalks not being cleared of snow and ice by some of the down- town merchants. It was also questioned if there is an ordinance which would require owners of multi-family housing units to keep the sidewalks and parking lots clear of snow and ice. Dick Preston replied that there were ordinances pertaining to these matters. After further discussion, Mayor Hartsfield instructed the Planning and Code Enforcement Department to strictly enforce these ry ordinances in all parts of the City. Mayor stated that the City has been approached from time time by insurance companies and others wishing to make presentations to 1 Presentations City employees regarding saving plans, insurance plans, IRA, etc. 1 to City He stated that the position of the City would be that, without Employees. • Council approval, there will be no outside vendors permitted to make presentations to employees. Nay: None. The next item for discussion was the disposition of the Old Jail. Mayor Hartnfiald gave a brief history of the Council's actions Old regarding this matter and thin history is outlined as follows: Jail. The Police Department vacated the promises on January 5, 1980; On May 5, 1980, a motion was adopted to leave the jail at its present location for twelve months and that during this time the Historical Society be given the opportunity to raise $100 ,000; that a plan for renovation be submitted to the City for approval; that the City cooperate in applying for a grant for State and Federal funds. If within the twelve month period the money is not raised, then the City will proceed with plans to demolish the building. This motion was amended to require $20,000 additional be raised for maintenance fund. September 15, 1980 , Council adopted a motion to apply for MCCJ Grant for the Old Jail. On December 15, 1980, Council adopted a Resolution to the same effect. On March 2, 1981, Council adopted a motion to return the grant funds. On March 2, 1981, Councilman Wade introduced to approve a contract for the architect's fees for the renovation of the Old Jail. This bill was defeated. On May 4, 1981, the Historical Society appeared before the Council and Council extended the dead- line until December 31, 1981. Councilman Wade spoke briefly to the Council and then moved that the Council accept the proposition of Missouri Heritage Trust Inc. of renovating the Old Jail where it currently stands. Motion was seconded by Councilman Scheulen. Before a vote was taken on this motion Patrick Steel, of the Missouri Heritage Trust, reitera d the proposal made by them, i.e. , that the City grant to the Jefferson City Preservation Committee of the Missouri Heritage Trust a long term lease to run between 25-99 years. The City Iwould be expected to execute that lease enabling the Committee to take full responsibility for the building. All necessary utility easements would have to be worked out with the City. Ground maintenance would be the responsibility of the City. City Preservation Committee will accept responsibility for the on- going maintenance of the building, will take charge of raising private monies for its restoration and rehabilitation of the in- . , terior. He stated that $18, 000 has been raised in pledges in cash, time and services, of which $9 ,820 of that amount is cash. He also stated that over a three year period, he estimates that $60,000 will be required to complete the project. A roll call vote was taken and the motion was defeated by the following vote: Aye: Blume, Hequembourg, Scheulen and Wade. Nay: Borgmeyer, Gordon, Halsey, Kliegel, Prenger. Councilman Borgmeyer then moved that the building be torn down. Motion seconded by Councilman Kliegel. Upon inquiry Mr. Bates replied that an estimated figure would not exceed $4-5,000. Councilman Halsey then moved to amend Councilman Borgmeyer's motion by adding that a marker be placed at the site at a cost Old not to exceed $2 ,000. The amendment died for lack of second. Jail. A roll call vote was taken and the motion was defeated by the following vote: Aye: Borgmeyer, Gordon, Halsey, Kliegel. Nay: Blume, Hequembourg, Prenger, Scheulen and Wade. Councilman Prenger then moved that the Council give the Committee until Monday, February 1, 1982, to come up with $25,000 in cash, not pledges, and with that extension comes a commitment from the Council that they will execute a lease. Motion seconded by Councilman Hequembourg. Councilman Hequembourg then moved that Councilman Prenger's motion be amended by adding that we have both the lease prepared and the money at the meeting on February 1, 1982 . This amendment was seconded by Councilman Prenger. Councilman Scheulen than moved to amend Councilman Hequembourg' = amendment by allowing a reasonable time for staff to draw up a lease to be approved by Council, subject to their aquiring $25,000 and if the money was acquired then the lease would be proapproved. This motion was seconded by Councilman Blume. This motion was ruled out of order. A roll call vote was than taken on Councilman Uaciuemhourg 'ss amendment and the results were as follows : Aye: Blume, IIequombourg, Prancer, Schoulan and Wade. Nay: Borgmeyer, Gordon, Ilsilaey , and Kliegel. The motion passed and was vetoed by Mayor. Hartsfield. A roll call vote was then taken on Councilman Prenger' ss origin. ' motion and the results were as follows; Aye: Blume, Hequembourg , Prenger, Scheulen and Wade. Nay: Borgmeyer, Gordon, Halsey, Kliegel. The motion paused and was vetoed by Mayor Hartafield. Councilman Prenger then moved that Council accept the proposal as given by Mr. Steel, in total. Motion seconded by Councilman Wade. A roll call vote was taken and the motion was adopted by the following vote: Aye: Blume, Hequembourg, Prenger, Scheulen and Wade. Nay: Borgmeyer, Gordon, Halsey, Kliegel. Councilman Gordon moved that the meeting be adjourned. Motion seconded by Councilman Halsey and carried. 4 III
