HomeMy Public PortalAbout19830103 373 z;• REGULAR COUNCIL MEETING, JANUARY 3, 1983 The regular Council meeting was called to order at 7:30 P.M. with Mayor llartsficid presiding. =' Prayer was offered by Rev. John Sewell, Pastor of First Assembly of God. 1. Roll Call Councilmen Present: Blume, Borgmeyer, Davis, Gordon, Halsey, Hequembourg, Kliegel, Lock, Roark and Scheulen. Councilmen Absent: None A quorum was present. Public Hearing The first item of business was a Public Hearing on the Special Special Bus. Business District. Mayor Hartsfield announced that the proponents of is Dist. the Special Business District had requested a continuation of the public hearing until the January 17, 1983 Council meeting. The Public Hearing was continued until that date. Public Hearing The next item of business was a public hearing on a rezoning request _.? Rezoning submitted by Malcolm and Minnie Zumwalt for property rezoning at 1410 Jefferson Street from RS-2 to C-2. Mr. Malcolm Zumwalt spoke in favor of the rezoning request, explaining the property location and the parking situation at the property. No persons spoke in opposition to the rezoning request. Mayor Hartsfield announced that an ordinance for the rezoning was being introduced later in the meeting and would be voted on at the January 17 meeting. Towner Mr. Mark Towner of Towner Electronics spoke from the gallery in Electron- opposition of the lease agreement between the City and United Tele- icra phone in Council Bill 82-134 which was approved at the December 20, 1982 meeting. Mr. Towner stated that the installation of the phone system should have been done on a bid basis. Mr. '!'owner then presented technical criteria regarding the capability of Towner Electro- nics to handle telephone systems of the typcy and size in question. Councilman Halsey was granted the floor to speak concerning the lease agreement between the City and United Telephone. lie stated that the Council voted on t he bill before actually seeing a copy of the lease agreement; that t here were items presented at the time of the vote which he considered a misrepresentation of the actual Rec.onaidorati.on lease. Councilman h a Isey requested recon sideration of hill 82--134, and 82-134. tale- made a motion to that effect. Mayor Hartsfield asked for verification phone contract I of the correct procedures in such a situation. After discussion and review of the "Rules arid Order of Business of the City Council of the City of Jefferson," it was determined that the motion was in order. Mayor Uartsfield requested Councilman Halsey to act as President Pro Tern for the voting procedures. Councilman Halsey restated that the motion on the floor was to reconsider Council 13i11 82-134 as it was presented to the Council for vote on December 20, 1982; the motion was seconded, and approved by the following vote: Aye: Blume, Borgmeyer, Davis , Gordon, Halsey, Hequembourg, Kliegel, Lock, Roark and Scheulen. Nay: None. Council Bill 82-134 was placed before the Council for reconsideration. Bill 82-134, sponsored by Councilman Sheulen, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI , AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF THE CITY OF JEF- FERSON TO EXECUTE AN AGREEMENT WITH UNITED TELEPHONE COMPANY FOR TELEPHONE SYSTEM. Bid No 284 Auto Parts - Public Works - Central Mainten- ance. Bid No. 285 Packing Materials - Public Works - Water Pol.lu- -ti Lion. i Bid No. 286 HELD OVER - Vehicle Conversion Kits - Public ,- Works — Central Maintenance. ', Bid No. 287 Island Drain Materials - Public Works - Street Division. .: Bid No. 288 Tires, New - Public Works - Central Mainten- ance. Councilman Borgmeyer requested an explanation of the items being bid on in Bid No. 287; Mike Bates provided the information requested. Councilwoman Lock asked why new tires were being bid on in Bid No. 288 rather than recapped tires. Mike Bates explained that the new -= tires were for the front of the City buses, and that new tires had - always been used for this purpose as a safety measure. Councilman Scheulen requested that the minutes be corrected to provide more details concerning, Council ' s decision in the City Seal contest. *Minutes should reflect the fact that Council man Halsey's motion was "to use Mrs. Kurtz' ;, entry for any and all purposes." Upon motion and s+econd, the Consent Agenda , showing the Minutes to be corrected, wan approved. Mayor Mansfield stated that the following minutes were received and Minutes Recd are on file in the City Clerk' s office: Jefferson City Memorial Airport & Piled Commission, 11/23/82; Parking & Traffic Commission, 12/9/82; Public Works & Planning, 12/20/82 and Board of Adjustment , 12/14/82. , Mayor Hartsfield referred to the letter sent to the Council written by TCI ICI regarding the beginning of physical work on the system. He announced that TCI will submit a written report to be given to the } Council prior to the next meeting, and will attend the meeting on January 17 to answer questions and report on progress. In February when they appear for their monthly report, TCI will be prepared to discuss programming in detail. Mayor Hartsfield also announced that the Council is invited to a Police Reserve dinner given in honor of the Police Reserves on February 3. The Dinner dinner will be paid for with private funds, and the cost is $30 per . couple to attend. The next item of business was the introduction of bills. A memorandum from Lyndel Porterfield, City Counselor, was referred to which was in regard to the contract with Scholastic. Mr. Porter- . field was asked to elaborate on the details in the memo. Mr. Porter- field's memo informed the Council that to execute a contract with an organization after work had already begun on the contracted project was against state statutes. He stated that an alternative was possible wherein the City could take the amount of money in question and I' purchase a portion of the property (in this case a tunnel under the ' { i 378 3 F :4ii ..:4 ;Y ■3v ' City street) , then reduce the amount of the bonds which have to be '" issued by the amount of money in question. FOR THE FISCAL YEAR 1982-83. i_` Councilman Scheulen asked for an explanation of the amount of money .714 spent by Scholastic compared with the figures in the appropriations ordinance. Mike Bates explained that $49,866 had been spent by Scholastic, and $10,000 was for Public Works to use in installing ;.: guardrails at a steep incline on the City street there. The next item of business was the Informal Calendar, 1 Informal Calendar L,* Councilman Scheulen requested that Bill 82-132, Solid Waste Code, be 82-132 '' held over on the Informal Calendar. !I, _.. .. .- - .. - Resolution 82-29 was presented which applied for state Watch funds la RS82-29 for the i�AA grant to the Jefferson City Memorial Airport. After• a i� IAA Gran, , motion was. made by Councilman Blume and seconded by Councilman State match Davis to approve the Resolution, it was adopted. The next item of business was Unfinished Business. ii Councilman Gordon informed Mike Bates that a citizen in his ward ' Sewer Problem was having a sewer problem and requested that the Public Works in 3d ward Committee discuss it at their next meeting. Mr. Bates informed Mr. Gordon that the citizen had already been contacted personally, and that a letter had been sent advising him of steps that will be taken to alleviate the problem. The next item of business was New Business. Councilman Davis requested that future minutes of meetings include more details of discussions. Councilman Davis noted that payroll checks issued by the City still Discussion of . bear the signature of the former City Clerk. He requested that steps ,E payroll checks be taken to change this situation so checks will be signed by the !! & signatures new City Clerk, and that an audit of the period between October 13 i I and January 3. Jim Uffmann, Director of Finance, explained that ii there were still about $500 worth of pre-signed checks left after Judy 11 Mason resigned. Councilman Blume suggested that checks not be • pre-signed in the future, and that the City obtain a machine that ;_ I . will allow automatic check signing at the time they are issued. Mr. ! Uffmann explained in detail the procedures involved in issuing checks, stating that approximately 1 ,100 checks are issued monthly. It Councilman Halsey asked how long it would take to catch an error in ii i i t 370 the case of stolen and forged checks. Mr. Uffmann stated that the monthly bank reconciliation would disclose any such problems. Councilman Davis moved that the remaining pre-signed checks not be issued and that an audit be done of the period October 13 to January 3. Councilman Halsey moved to amend the motion so that the future checks be issued with no preprinted signatures. The amended motion was seconded by Councilwoman Lock. After further discussion regard- ing what signatures are required by statute to be on the checks, Councilman Davis requested withdrawal of his motion to allow time for research in the matter. Mayor Hartsfield directed Mr. Hamburg and Mr. Uffmann to have a recommendation for check procedures at the • next meeting. • Motion to pass Councilman Gordon stated that he has received letters from citizens in resolution his ward regarding Channel 9 (KETC) and requesting that it be Channel 9 allowed to remain on the TCI system. After talking to Shirley Zbinden of TCI, he was informed that any letters received should be forwarded to TCI so they can present the letters to the FCC. Mr. Gordon also asked that the City prepare a resolution showing their support of retaining Channel 9 on TCI. Councilman Gordon moved that the Council go on record as supporting Channel 9. The motion was seconded. Councilman Blume stated that residents in the Housing Authority buildings had contacted him and he had suggested they sign a petition supporting Channel 9 and send it to TCI. After further discussion, the motion was approved. ■ • Councilman Roark questioned Mr. Hamburg regarding a document he had requested which he said he did not receive. Mr. Hamburg stated that documents requested are readily available and that there are no problems to his knowledge pertaining to requests for documents. Adjournment After a motion by Councilman Scheulen, and seconded by Councilman Blume, the meeting was adjourned. •
