Prayer was offered by Reverend Eugene Akeman, Pastor; Christian ?; Community Church. The Pledge of Allegiance was led by City Administrator Dave Johnston. The following Council Members were present: Present: Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen, Veile, Vincent, and Woodman. Absent: None. A quorum was declared present. RESOLUTIONS: Mayor Gardner announced that if the Council had no objection, Resolution 90-1 would be considered at this time. There was no objection and Mayor Gardner read Resolution 90-1 honoring Police Chief Gary Kompker on being named Police Chief of the Year by the Missouri Police Chiefs Association. Councilman Mason moved approval of Resolution 90-1, Councilman Gordon seconded the motion and it was approved. PRESENTATIONS FROM GALLERY: Mr. Mark Bruenger, 4405 Village Drive, had requested to address the Council regarding 90-2 . Mr. Bruenger stated he had heard that there were going to be some changes in this bill and would like to iI know what changes were going to be made before he spoke. Councilman Mason stated that this current bill was going to be ;I withdrawn and that a committee was going to be established to draft 1 a new ordinance. Councilman Mason stated that this bill was never meant to be a "gun control" ordinance. Police Chief Gary Kempker stated that in backtracking the current code, it had been determined that when the code was codified in 1983, certain language had been dropped from the 1977 code. Chief Kempker stated this bill had been designed to bring the code back to the 1977 language. Councilman Mason stated that Mr. Bruenger would be notified of the meeting to discuss this issue. Councilman Mason announced that due to a conflict of interest he would not be voting or partaking in any of the discussion on this bill. Councilman Scheulen requested a suspension of the rules for this bill . Councilman Feldman questioned if the Company being considered as Consultant would be able to function as a financial interest after the consulting aspect had been completed. Marty Brose, Director of Transportation, stated that the Company would still be able to act as Underwriter if the City chose them for that function. Councilman Feldman stated he had received several calls expressing concern over this factor and did not see why the Council needed to 2 8 3 1.': '/t'r REGULAR COUNCIL MEETING, MAY 7, 1990 suspend the rules. Mr. Brose stated the City needed to proceed with the issuing and selling of the Bonds so that work could begin on the garage. After further discussion on the lack of information the Council had received on this issue and the need to have the Finance Chairman included in future discussions, Councilmen Halsey, Gordon and Feldman objected to the suspension of the rules. Councilman Voile stated that the Council does not receive as detailed information when awarding contracts for professional services as they do for the purchase of equipment and felt this should be corrected. Councilman Scheulen stated that the Finance Committee has not made a practice of reviewing every contract and he did not believe that had been the o: Iginal purpose of the Finance Committee. Councilman Haake stated that he felt two or three Council members should have been included in the discussions and review of the proposals for this contract. Councilman Halsey stated this was a particular cane and involved large sums of money and there should be more Council input. Mayor Gardner requested Councilmen Scheulen, Feldman and Halsey to meet with staff to discuss this proposal and contract. I i Councilman Owens moved to amend Section 1 , Article 4 . 1. Councilman Feldman seconded the amendment. Councilman Voile spoke `l against the amendment and the bill . Councilman Veile stated that i while there may bo a need for some new blood on the Council , the II voters were quite capable of making that decision. Councilman I Voile stated that if the amendment was approved, the Council would lose some very valuable experience which was also needed. After some discussion, Councilman Owens informed the Council she '' agreed with Councilman Veile and her purpose in proposing the amendment was to make the Council aware of the loss of valuable experience that could occur. Councilman Owens withdrew her amendment and Councilman Feldman withdrew his second. Councilman Owens informed the Council she felt the cost for running a campaign for the entire city would be exorbitant. Councilman Scheulen stated his agreement with Councilman Owens and expressed some unique problems the representatives of the first and second wards have connected with the prison. Councilman Haake stated that he felt it could become very difficult to determine accurate city expenses. Councilman Gordon stated he felt the paperwork involved in keeping track of expenses would be costly, both to the Councilmen and to City personnel. Councilman Scheulen stated that he felt to eliminate the salary might keep some qualified persons from running for office who could not afford to have the expense of a campaign and the expenses incurred in the job if there were not some type of reimbursement. P and, Section 1, 4. 2 to read as follows: There shall be one thousand five hundred dollars ($1, 500. 00) annual compensation of the office of Mayor, 1 but the Mayor shall be reimbursed for actual expenses incurred while fulfilling the duties of the office. Councilman Veile seconded the motion. Councilman Veile informed the Council he was against the amendment and against the bill. Councilman Veile stated that this bill would create a tremendous amount of paperwork for both council and staff. Councilman Veile stated it could also lead to political difficulties, allowing tr opponents to question and challenge all expense vouchers. The amendment was defeated by the following roll call vote: Aye: Halsey. Nay: Feldman, Gordon, Haake, Mason, Owens, Schoulen, Voile, Vincent and Woodman. After further. discussion, Councilman Hawke called for the question. Councilman Mason seconded the call and it wan approved. Bill 90-5 wan defeated by the following vote: Aye: Halsey. Bill 90-7 was read third time by title, placed on final passage. Councilman Voile questioned Fire Chief Bob Rennick why staff had chosen a Springfield firm over a local firm. Chief Rennick stated that eight firms had responded and three had been interviewed. Chief Rennick stated the criteria had been a combination of cost and experience with fire stations. Chief Rennick stated the staff involved in the interview process had used an evaluation format provided by Purchasing. After further discussion, Councilman Scheulen requested this bill be placed on the Informal Calendar and staff submit a formal written report to the Council at the next meeting. Councilman Feldman stated that Council might need to set a policy to inform staff of how they wish to handle those types of situations in the future. Councilman Gordon stated that staff needs to involve at leant one or more of the Council when the Council are the ones that have to make the decision. Councilman Scheulen stated that the issue was choosing local firms over outside firms. UNFINISHED BUSINESS: Councilman Gordon requested Councilman Larry Vincent request the Cable Quality Commission to question TCI about the possibility of 289 REGULAR COUNCIL MEETING, MAY 7, 1990 1 moving Channel 19 to a location that is clearer and where the entire program can be broadcast without interruption. Councilman Scheulen informed the Council he had had an occasion to visit with a clerical employee of TCI and this employee had informed him that the stress level for those positions were very high. Councilman Scheulen stated this employee and others had been harassed in public places, such as the supermarket, in front of their children and other family members. Councilman Scheulen requested the public keep in mind the clerical employees do not set the policy for the Company and that while they may not like what TCI company is doing, they should not take it out on the employees of TCI.
