A Regular Council Meeting of August 13, 1990, was called to order
at 7 :30 P.M. with Mayor Louise Gardner presiding.
Prayer wan offered by Councilman Kyle Mason.
The Pledge of Allegiance wan led by City Administrator Dave

Present: Feldman, Gordon, Haake, Mason, Scheulen, Vincent,
and Woodman.
Absent: Halsey, Owens, and Veile.
A quorum was declared present.
PUBLIC BEARING:
There was a public hearing for the purpouc of discussing the rate
of taxation for the City of Jetterqon for the 1990-91 fiscal year.
There wan no one present to upeak e ither for or agal nut the
proposed rate.
Thorn wan a public hearing tor the purpose of dincunning the
re:toning of a 16. 4 acre vacant: tract on the norihwont nide of
Southridge Drive from RS-2 , Singlo Family Ronidontial , to C-0,
Office Commercial . There wan no one present to upeak oithor for or
agninnt the proposed rezoning.
The Public llearingn concluded at approximately 7 : 35 p.m.
PRESENTATIONS 'mom GALLERY:
Mn. Marty Asel, Executive Director for the Convention and Visitor's
Bureau, reviewed for the Council the 1909-90 Annual Report of the
Jefferson City Convention and Visitors Bureau. Councilman Feldman
stated he would like to see some figures that would indicate how
much money from tourism is actually brought into Jefferson City as
a direct result of the Convention and Visitor's Bureau ,

Mayor Gardner announced that Elizabeth Wilson' s name would be
deleted from the proposed appointments to the Library Board as she
7 has resigned. Councilman Woodman stated that the Appointments
Review Committee approved the list of proposed appointments.
Councilman Haake moved approval of the Consent Agenda. Councilman
Mason seconded the motion and it was approved.

wished to see them.

Mayor Gardner announced there was a vacancy on the Appointments
Review Committee for the Fifth Ward. Mayor Gardner announced she
was appointing Councilman Larry Vincent to represent the Fifth Ward
on this Committee.

requested be prepared by City Administrator Dave Johnston regarding

!s: Solid Waste. The Mayor announced that a committee would be formed
consisting of four staff members, Dave Johnston, Tom Benton,
11 Charlie Lansford and Allen Garner. The Mayor also announced that
.. h at a later date an ad hoc committee of four Council members would
h be announced to work with staff on this issue.

Mayor Gardner announced the following five items would be the scope
of study for the committee:

1. Review Senate Bill 530 and propose an implementation
' plan. During the review the subject of local versus regional
management should be addressed both from a planning and
implementation standpoint, •

2 . Review the long range plan of the City particularly in

k the area of solid waste. Review the current waste management plan,
propose any recommendations and changes in the City ' s plan.
3 . Review recycling alternatives which currently exist and
11 which are expected to exist In the future, including issues related
to private versus public operation.

Councilman Woodman moved approval of Resolution 90-8 regarding the
authorizing of the Director of Transportation to make application
for a grant for a General Public Transportation Project.
Councilman Haake seconded the motion and it was approved.
Councilman Haake moved approval of Resolution 90-9 regarding the
continued participation of the City in the Narcotics Control
Assistance Program. Councilman Mason seconded the motion and it
was approved.

v UNFINISHED BUSINESS: .
Councilman Haake expressed his displeasure at a joint statement
concerning the Gross Receipts Utility Tax that had been issued to
the news media by certain Council members, stating he felt this set
policy and was inappropriate action.
Councilmen Gordon, Scheulen, Mason and Feldman all addressed the
issue raised by Councilman Haake. The Councilmen stated they had
been questioned as to their support for a Gross Receipts Utility
Tax increase. The Councilmen all stated they had been opposed to
the increase and had responded in the negative. The Councilmen
stated there had been no secret meeting and they did not feel their
: actions were inappropriate.
Mayor Gardner stated that she was not in favor of a tax increase
and would not support a budget based upon a tax increase. 5

City Administrator Dave Johnston asked Public Works Director Mike
Baton if the bid received on the curb & guttering for Fairmount
Court would still be in effect by the next Council meeting, or if
the Council needed to vote on this issue tonight. Councilman Mason
asked for a point of order, questioning the authority of a staff
member of raise an issue that requires Council action. Mayor
Gardner stated that until the meeting is adjourned, any topic may
be brought up for discussion.
Public Works Director Mike Bates stated that he believed the
contractor would honor the bid, even though the sixty days would
have expired.
Councilman Mason stated that he is opposed to the number of bills
ft on which the Council is continuously asked to suspend the rules.
Councilman Mason stated that for the rules to be suspended, it
should be an emergency and felt this should be strongly adhered to.

`+— n Counc lman Feldma stated that he had been presented a placque on I- ____
behalf of the City, from the American Lung Association of Eastern
*z Missouri, in recognition of the Clean Air ordinance that had been
> recently passed. Councilman Feldman presented this placque to f
,4 President Pro Tempore Kyle Mason, requesting that it be displayed J ';:'
`',in the foyer. President Pro Tempore Mason accepted the placque on E
,., behalf of the City and presented it to the City Clerk for display
in the appropriate case. ! a

1 Councilman Feldman requested that Director of Planning and Code
I Enforcement, Tom Benton report to Councilman Feldman at the ;s
September 10 Council meeting the possibility of an ordinance which ji
`; prohibits the sale of tobacco products to anyone under the age of 1
eighteen.

City Administrator Dave Johnston reviewed for the Council the
I recommended position of the City on the proposed formation of one
or more fire districts around the City. They are:

1. Protect City ' s Boundary. White supporting the concept of
the fire districts being established, no encroachment on
City boundaries nhoulci occur as a renal t of the proposal .

2 . Frogholl ow Annexation. The area included w i th i n the fire

districts should exclude the proposed annexation area if i ,
(,(1 possible. The timing of the two issues may create
dproblems with boundaries in this area
3 . General City Interests. Other unidentified issues may
arise during formation of the districts. The City should 1,
• attempt to have a seat next to the discussions to assure j
no City interests are adversely effected.
There was no action taken by the Council at this time.

Councilman Mason requested Councilman Vincent or Tom Benton have !�
the Cable Quality Commission talk with Lincoln University about co- If
operative educational programs with Jefferson City High School and '
Helias High School . Councilman Mason stated this wan part of the
contract with Lincoln University and wanted to Know if there was
participation of local schools in programming.

APPROVAL OP EXECUTIVE SESSION MINUTES:

' ouncilman Haake moved approval of the Executive Session minutes of
July 16, 1990, and July 27, 1990. Councilman Gordon seconded the
!motion and it was approved.
'ADJOURN:
4As there was no further business to come before the Council,
Councilman Gordon moved the meeting adjourn. Councilman Mason
iaeconded the motion and it was approved. The meeting was adjourned
at approximately 8:45 p.m.
