(1 IIAbs'nt: Woodman. t 11 A quorum was declared present. !! 1 SPECIAL PRESENTATION TO RANDY SMITH: , II q Alan Kroi:er, Public Education Officer, addressed the Council in I I'! honor of Fire Prevention Week. Mr. Kreter introduced Mr. Randy Smith and Mayor Louise Gardner presented Mr. Randy Smith with a placquo from the Fire Department for his efforts in assisting them stress the importance of fire safety. Mayor Gardner also presented II Mr. Smtih a Key to the City. Mr. Smith wan severely burned in his home last year and has utilized that experience to caution children in the public schools about the need for safety. PUBLIC HEARING: II The first public hearing was for a rezoning of property at 1128 r Jefferson Street from RA-2 (Multiple Family) to C-O (Office lil Commercial) . There was no one present to speak either for or l against this rezoning. The second public hearing was for a rezoning of property at 2722 E. .. McCarty Street from RS-2 (Single Family Dwelling) to C-O (Office Commercial) . The Economic Development Agreement with the Chamber is increased by $2,000 . 00 . 3. The Mayor budget is decreased by $1,000 . 00 in Meetings and Conferences . I 4 . The Council 's budget is decreased by $1,500.00 in Contractual j; Services. 5. The City Counselor's budget is increased by $3,500.00 to cover travel associated with the cable tv system. 6. The Police Department's Equipment purchases are reduced by $16,000 . 00 because of the removal of gun replacement. 7 . Tho Salaries accounts are decreased by $76,000.00 for the reduction of 4% across-the-board increase to 3% and the change of merit from 1 or 2% to 1, 2, or 3% possibilities . 6. The Street 's Operating Budget is increased by $50,000.00 in the asphalt overlay program. . 9 . The Seasonal Salaries in all departments have boon reduced by 60.45% until the City Council can further study all of the seasonal positions. 10. The Public Buildings budget has a restriction that $10,000.00 be used for the replacement of the boiler only and no now areas be air conditioned. 11 . The monies placed in the Transit budget for the purchase of a new bus is restricted until further City Council discussion on the bus sizing. 12. Street Capital Projects expenditures is increased by $30, 000.00 for sidewalk projects. There is an offsetting revenue increase of $10,000.00 to Citizens' Participation. 13. The Stormwater Capital Projects was adjusted by removing $25,000.00 from both the Dunklin/Mulberry and the Marshall t it Street projects and increasing Neighborhood Projects by !� $50,000 .00 . i Councilman Feldman seconded the motion. Councilman Scheulen stated I he would hope that the $307,000 that had been placed in reserve for 1 seasonal salaries could be reviewed and a more realistic amount jf kept in reserve. Councilman Halsey seconded the motion. Councilman Haake called for the question and Councilman Mason seconded the call . Mayor Gardner requested City Counselor Allen Garner clarify the effect placing this money in reserve will have on hiring additional part-time staff at the present time. After an explanation of this effect, Councilman Feldman questioned whether or not this discussion could take place when the question had been called. Mr. Garner stated that the motion to call for the question, after having been seconded ends all discussion, only if the person making the motion had been recognized by the Chair. Councilman Haake moved to call for the question, Councilman Mason seconded the motion and it was approved. The motion to amend the amendment to Hill 90-93 was approved with Councilman Vincent casting the only negative vote. The amendment to Bill 90-93 was approved with the following roll call vote: Aye: Feldman, Gordon, Haako, Halsey, Mason, Owens, and Voile. Nay: Schoulon and Vincent. 1311.1 90-93 was panned, as amended, by the following vote as Ordinance No. 11496 . Aye: Feldman, Gordon, Haako, Halsey, Mason, Owens, Schoulen, and Voile. Nay: Vincent. UNFINISHED BUSINESS: Allen Garner reviewed for the Council a memorandum that had been distributed prior to the meeting outlining the two alternates City staff recommends the Council review concerning the current parking garage contract. Councilman Feldman questioned the Engineering firm being allowed to charge the City for increase costs due to the inability of the garage to be completed on time. Councilman Feldman stated that it was the Engineer's recommendation that the timeframe was acceptable and that it was their job to ensure that the work be completed on time and he was opposed to their being allowed to profit from this situation. Mr. Garner stated that with Alternate #2, the ;;'. engineering firm is being utilized for two projects, the current project and the Jefferson Street garage. Mr. Garner stated that f 'r; = 1; historically, Engineers have not been held liable for projects that �, were not completed on time. Mr. Elmer Kiesling of J.C. Industries, stated that the project had i5 been delayed because of the inability of the stool manufacturer to get them the steel on time. Councilman Gordon asked if there was any recourse against the steel manufacturer. Mr. Kiosling stated `` he did not believe there would be any recourse. P! Councilman Haako questioned if JCI had the steel at this time. Mr. Keisling stated that they are receiving shipments 3 or 4 times per il week and anticipate all of the steel will be delivered by the end iI I, of October. Councilman Voile asked Mr. Kiesling if it was the intent of JCI to ; pay the liquidated damages listed under Alternate #1 or Alternate #2, depending upon the decision made by the Council . Councilman Halsey stated he did not believe the Council should be considering Jefferson Street at this time, but should complete the project currently under construction. After further discussion about the alternates, Councilman Scheul.en asked how many parking spaces would be available under Alternate #2. Mr. Garner stated that on November. 5, 334 spaces would be available and 492 available on December 17 . Councilman Gordon stated he believed the Council should review these proposals and also that input should be given from the Downtown Business Association. Councilman Gordon moved that the Downtown Business Association meat with the Legal Department, the Legal Department meet with JCI and the engineering firm and then make a recommendation to the Council , at a Special Meeting if it is necessary. Councilman Halsey seconded the motion. Councilman Halsey stated that ho would like to nee more cooperation from the State of Missouri on the possibility of using their. garage. Councilman Halsey stated ho did not believe that the State was being very cooperative with the City, a t ter the City had given them the land to construct their garage . Councilman Scheulen requested the Downtown Business Association be allowed to speak to the Council . Mr. Mark Lindsey stated that the Association bad not boon advised of the Alternates presented tonight and wore still in favor of Alternate #3 which had been proposed at the last mooting. Councilman Haake stated that the problems caused by this construction will be there in the spring if the Council closes the project at this time . Councilman Owens questioned the need to make a decision on the east parking garage tonight. After clarification from Allen Garner as to what type of direction staff needed, Councilman Owens moved to !+ shut down any construction on the east parking garage until spring. Councilman Vincent seconded the motion and it was approved. Councilman Feldman requested a short recess at this time.
