Eugene Akeman, Pastor of Community Christian Church. The Pledge of Allegiance was led by City Administrator Dave Johnston. The following Council Members were present: Present: Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen, Voile, Vincent, and Woodman. Absent: None. A quorum was declared present. Mayor Gardner introduced Mr. David Anderson, Assistant Scout Master for Troop 2 from the First Presbyterian Church in Jefferson City. Mr. Anderson informed those in attendance that ho had brought with A ,k. . him seven boys who were work♦ l on their Citizenship in the Community badge. __ PRESENTATIONS FROM GALLERY: I Marty Asel , Executive Director of the Jefferson City Convention and Visitors' Bureau introduced Gary Collins who reviewed for the Council the proposed budget for the 1990/91 fiscal year. Councilman Feldman asked if the problems that had been experienced - if with the collection of the delinquent funds had been resolved. Ms . Asel stated that to her knowledge all of the past-duo accounts had 1 been settled. After further discussion on the increase in the number of conventions coming to Jefferson City, Councilman Halsey moved to approve the budget of the Jefferson City Convention & I Visitor's Bureau as presented. Councilman Gordon seconded the motion and it was approved. Councilman Voile informed the Council he would like to make a few comments to let the public know how the City had arrived at the issue that was about to be discussed. Councilman Veile stated that on October 17, 1990, a statement had been issued regarding relocation of the poor and homeless from St. Louis to Jefferson City. Councilman Veile stated that he did not believe that anyone on the Council had a problem with individuals wanting a better life, however, there was =r' some concern about a program that brought individuals into Jefferson City and then abandoned them with no recourse. .�; Y Reverend Larry Rice, Route 2, New Bloomfield, Missouri , stated that approximately one and one-half to two years ago he had assisted some individuals who had desired to leave the St . Louis area due to the cost of living and the increase in crime. Reverend Rice stated that his organization had a house that had been set up as a transitional house to assist these individuals into becoming a part of the community, but that due to a lack of volunteers, this house was no longer in operation. Reverend Rico introduced his attorney, Dan Dodson, 420 Hickory, Jefferson City, Missouri., who cautioned the Council about making unsubstantiated statements and innuonclon . Mr. Dodnon stated that it was not the desire of Reverend Rice to bring about a lawsuit, but he would do no if he deemed it necessary. Attar further comments by Reverend Rico, Councilman linaku stated he believed there had some misconceptions about certain comments that .'a had boon made Councilman Henke stated that the questions that had boon nuked by Councilman Voile wore just that., quentionu , and that the Council would like to have those quest.i.onu answered by nomoono who in involved with the organization. Reverend Rico stated that his organization does not have an organized program for relocating individuals from St. Louis to Jefferson City. Councilman Voile asked Reverend Rice if he had over had such a program and was informed that approximately one ono-half to two years ago there had been such a program. Councilman Veil° asked how many families had been brought to Jefferson City. Reverend Rice stated that approximately twelve families had been brought to Jefferson City and that most of these families had been single mothers with small children. Councilman Voile asked Reverend Rice if he was still encouraging and/or motivating individuals to come to Jefferson City. Reverend Rice stated that they were assisting individuals in getting where they wanted to go. Reverend Rice stated that he did not due to time 1 f, h1 factors . Reverend Rice explained that he is travelling frequently 1� and not always available to meet with these organizations . ' Councilman Halsey questioned Reverend Rice as to whether or not he had any type of program used to evaluate those individuals he had assisted in coming to Jefferson City for potential jobs, housing, etc. Reverend Rico stated that they had done some reference checks >.: ; and had assisted these Individuals in getting set up in a place to 1, live. Reverend Rice stated that if there were problems with landlords, he tried to work with the landlord and the tenant to , solve the problem. 1i 1 Councilman Halsey recommended Reverend Rico moot with the Chief of '4 Police, the ministerial aal l iance and other service organizations in the City and explain what .It is he would like to accomplish and peek their assts t sst.tance. '! Councilman Mason thanked Reverend Rico for coning and assisting i.n c lari f y lng th i s issue for the Counci l . Counci lman Mason asked Reverend Ricca if he would consider working with as Tank Force ii composed of members of other organizations to try and establish a program of assisting those in need. Reverend Rice stated that he would consider hosing a member of the task force, i f they would discuss real issuers and problems, not just moot to discuss problems 1 that don' t exist . Councilman Voile reviewed for the Council certain statistics he had f; obtained regarding the number of persons the Salvation Army had assisted who had stated they had come to them from Reverend Rice 's II organization and the increase in Cole County assistance that had ! occurred in the past several months. I Councilman Voile questioned Reverend Rice regarding an estimation of the net worth of his organization having been approximately 3 . 5 million dollars in 1986 and higher in 1967 . Reverend Rice stated I this was due largely to the two television stations he operates, , E one in Callaway County and one in St. Louis . l' i Reverend Rice concluded his comments stating the City shows a lack i' of concern for the poor and homeless by collecting the tax placed on the utility bills, the lack of assistance in paying these bills, and the harassment of individuals selling a newspaper they produce 1 I I ; 11 I 1 I 415 REGULAR COUNCIL MEETING, NOVEMBER 5, 1990 f to make a living. # # # Captain Steve Kiger, Salvation Army, stated that there is a need to be cautious about over-simplifying the problem and the solutions. Captain Kiger stated that studies show that illiteracy, drug and alcohol abuse, education, etc. , are all factors which contribute to this problem and that a holistic approach must be taken to reach a solution. Captain Kiger stated that the motivation of the Salvation Army is a love for God and a desire to meet the practical needs of people. Councilman Mason asked Captain Kiger if he would be willing to work with a task force to study this problem. Captain Kiger stated that a task force had been formed a few years ago, but had not been meeting as thorn had not been a significant problem in Jefferson City. Captain Kiger stated that most of the those in Jefferson i City had boon in need of assistance with utility bills . # # # Father Hugh Behan, 3314 Country Club Drive, stated that the problem of homelessness had to be seen in light of joblessness, lack of education, etc. Father Behan stated he would like to see Jefferson City become a leader in this issue in hopes that they may have some influence on the legislature. Father Behan stated that there is a number of prisons, but very little money for rehabilitation. Father Behan also suggested that Reverend Rico have someone in his organization that could act as a liaison with other service ,. organizations in the community and also with the public to answer their questions when they arise. Father Bohan stated this could t help alleviate some confusion on the part of the public. # # # Ms . Judy Baldwin, 5407 Brett Court, spoke to the Council concerning a problem she had had with a sewer, backup in her family room. Ms. Baldwin stated this had come through a portion of the Grays Creek that the City had acquired. Ms . Baldwin stated that the City had been unresponsive to her needs and that she had taken them to Small Claims Court. Ms. Baldwin stated the City had been found negligent but that the City Counselor was going to file an appeal . Councilman Woodman seconded the motion and it was approved. MINUTES/REPORTS RECEIVED AND FILED: Mayor Gardner announced the following minutes/reports had been received and were on filo in the office of the City Clerk. Police Personnel Board 8/2/90; Housing Authority Board of Commissioners 8/31/90; Thomas Jefferson Library System 9/18/90; Jefferson City Library Board 9/19/90; Jefferson City Library Board 10/3/90; Solid Waste Committee 10/15/90; Cable Quality Commission 10/22/90 ANNOUNCEMENTS BY MAYOR: Mayor Gardner announced the Chamber of Commerce agenda, minutes & I monthly reports wore on file in her office if anyone wished to see them. Mayor Gardner distributed to the Council the Final Report of the Housing Concerns Committee. Mayor Gardner stated that the Committee had made a total of 54 recommendations and encouraged the Council to review this report carefully. Mayor Gardner announced she would be appearing on a special live television show to be aired on Channel 3, JCTV, on Wednesday, November 7 from 7:00 p.m. to 9 : 30 p.m. Mayor Gardner stated that she would be on a panel with other individuals from the State and local emergency management associations to discuss what to do during a natural disaster. The Mayor encouraged the citizens to watch the program and call in during the program with questions . Mayor Gardner reminded the public that filing for public office begins at 8:00 a.m. on November 6 . Councilman Woodman requested a suspension of the rules for this bill as the grant papers have to be filed with the State of Missouri prior to the next Council meeting. Councilman Feldman questioned why this had not been sent to the Council prior to this meeting and was informed by Director of Transportation Marty Bross that their Department had not received the grant until after the last Council meeting. COMMERCIAL DRIVERS ` LICENSE TO READ AS FOLLOWS: (d) Reimburse employees who are employed on November 1, 1990, on a one time basis, for the difference between the required higher class Commercial Drivers license foe and the fee for the license formerly required, the $5 . 00 written testing, and the $5 .00 road testing foe (if required) . Testing foes shall be paid it only once, any retesting necessary because of failure to pass the test shall be paid by the �! employee. 2. ADD PARAGRAPH (a) TO SECTION 8-10. SALARY ADVANCEMENTS AND BONUSES TO READ AS FOLLOWS: (a) A pay increase of 2% within the pay range of the class shall be awarded to original appointees, appointed before November 1, 1990, upon successful completion of the required six month or 12 month probationary period. AMOUNT, TO READ AS FOLLOWS: Employees in the municipal service shall earn twelve ( 12 1 hours) of sick leave with pay credit monthly, except for Fire II service personnel assigned to fire suppression duty, who shall 1! earn twenty (20) hours sick leave with pay credit monthly. Each part-time employee with benefits shall earn six hours of sick leave with pay credit monthly. 5. AMEND SECTION 13-3 . ACCRUAL, TO READ AS FOLLOWS: Full-time and part-time employees with benefits, except employees assigned to fire suppression duty, may accumulate sick leave with pay to a maximum of one thousand three hundred and ninety-two ( 1 , 392) hours. Fire service personnel assigned to fire suppression duty may accumulate sick leave with pay to a maximum of one thousand eight hundred seventy-two ( 1872) hours . Sick leave does not accrue while the employee is absent from work without pay or in receiving benefits from Workers Compensation, long term disability insurance, or. LAGERS. 6 . AMEND SECTION 13-4 . INCENTIVE PROGRAM, TO READ AS FOLLOWS: No payment k:hall be made for sick leave not used. However, four (4) hours of compensatory time off shall be earned for each calendar quarter during which a full-time employee, not assigned to shift duty in the Police or Fire departments, does not use sick leave. The maximum accumulation of compensatory time as specified in Section 8-13 (b) ( 240 hours maximum, except 480 maximum for public safety & seasonal employees) shall be inclusive of compensatory time earned under the provisions of the incentive program. Councilman Vincent stated the Council had expressed some concern at the last meeting about not rushing into this project and requested that Marty Drone, Director of Transportation, respond to this. Mr. Drone stated that this firm has done an excellent job on the current project and has served the City well . Mr. Bros) stated he could recommend thin firm for the Jefferson Street project. Councilman Vincent questioned if the City would have two projects going at the same time and wan answered in the affirmative. Mr. Brost) stated he believed thin to be to the City' s advantage as there would be one resident engineer who could oversee the two projects . Councilman Scheulen asked whether or not the question regarding ownership of the land had boon resolved. City Counselor Allen Garner stated it had not been resolved, however, that would not effect the design phase of the project. Mr. Garner stated it was his recommendation that the Council purchase the property in question prior to construction. City Administrator Dave Johnston stated his concurrence with this recommendation. Councilman Feldman questioned whether or not any other engineering firms were considered for this project. Mr. Drone reviewed the City's policy for the bidding of professional services and stated that as this engineering firm has presented a bid for a similar project within the last year, it was not necessary to rebid this project. Councilman Halsey questioned the need to begin this project at this time and asked about the possibility of placing this bill on the Informal Calendar until the concern's of the Council have been more fully addressed. Councilman Haake asked if there would be substantial savings by i having this firm work on this project. UNFINISHED BUSINESS: City Administrator Dave Johnston requested City Counselor Allen Garner review for the Council the Proposal that had been distributed prior to the meeting. Mr. Garner informed the Council of the compromises this proposal contained, stating it was staff 's recommendation to proceed and approve the change order. Councilman Vincent stated it was his understanding that long-term parking would still be prohibited in the parking garage, thus give the maximum amount of spaces available for the holiday shopping season. Marty arose, Director of Transportation, stated this was correct. Mark Lindsay, Downtown Business Association, stated that the merchants would still rather nee the project closed down until next spring, however, if the garage were going to be open the City should ensure that no permanent parke n would be allowed and that the public is made aware that the garage was open for parking. Mr. Broeo :stated that steps were being taken to discourage long-term parking in the garage to assist in providing parking for the downtown merchants . Councilman Feldman questioned whether or not the construction vehicles and trailers would be removed from Madison Street by November 23 . Mr. H111 Crull , Project Coordinator for J.C. Industries, stated they would be moved by this date. After further discussion on liquidated damages, Councilman Vincent moved the Council adopt Proposal "A". Councilman Haake seconded the motion and it was approved. # # # City Administrator Dave Johnston stated that his report on the part time and seasonal employees had been distributed in the packet and could be discussed at this time or at a later date. Councilman Feldman stated he would like to have it discussed at a special ii meeting. Councilman Feldman stated that while this report could Justify the number of employees hired in this capacity, it did not 1 address the efficiency with which these employees function. Councilman Scheulen stated he believed this portion �, of the budget was relatively minor in relation to the entire picture. Councilman Scheulen stated that it was his opinion that seasonal employees were getting a "bad reputation" in the City and that he felt the Council should put this matter to rest and let staff get on with their planning. After further discussion as to the need for a special meeting to ;j discuss this issue, Councilman Feldman moved to find an evening in November, other than a Council meeting night, for the Finance ;I Committee to discuss this issue and to have the Department Directors available to respond. Councilman Mason seconded the Imotion and it was approved with two dissenting votes . Councilman Gordon expressed his pleasure with the recent decision on the Capital City Water Company rate case and complimented City Counselor Allen Garner for all of his hard work and efforts in this case. Councilman Gordon requested the Mayor write those who participated in the case and thank therm on behalf of the City. # # # Councilman Haake moved to hold one Council meeting in the month of December and to schedule this meeting for December 10, 1990. Councilman Halsey seconded the motion and it was approved. NEW BUSINESS: 1 Councilman Haake requested the Council not consider the Tax 11 Increment Financing issue on the Agenda at this time, but discuss it at a later date. Councilman Halsey seconded the nomination. As there was no further nominations, nominations were closed and Mr. Johnston appointed. # # # Councilman Halsey requested that Police Chief Gary Kempker schedule a meeting with members of the Sheriff's Department and the Highway Patrol and Lincoln University's Safety Department to discuss the authority of Lincoln University's Safety Officers. Councilman Halsey requested Chief Kempker report back to the Council after this meeting. APPROVAL OF EXECUTIVE SESSION MINUTES: Councilman Voile moved approval of the Executive Session Minutes of October 5, 1990. Councilman Halsey seconded the motion and it was approved.
