Prayer was offered by Reverend Phillip Hoyle, Associate Pastor; First Christian Church. The following Council Members were present: Present: Davis, Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen, Veile, and Woodman. Absent: None. A quorum was declared present. Mayor Gardner welcomed the audience both present in the Chambers and those watching by television at home to the first live broadcast of the City Council meeting. b PUBLXC HEARING: The Public Hearing that was scheduled to discuss the Rezoning of a .7 acre tract at 3423 W. Truman Boulevard from RA-1 to C-4 will be reschedule at a later data. CONSENT AGENDA: The Consent Agenda consisted of the following items: a) Council Minutes of 12/11/89 b) Renew contract with Jeff City Taxi Company for providing off- peak special cab service from the Capital Complex to the Old Bridge Drive-In commuter parking lot • • c) Award of following bids: 1129 - Uninterruptible Power Source (UPS) , Finance d) Appointment of Mr. Darrell Ranarbargar as the Central. Mayor Gardner announced that Barbara Lock would be removed from consideration for the Animal Rescue Advisory Commission as she is currently on a different Board. Councilman Gordon moved to approve the Consent Agenda . Councilman Mason seconded the motion and it was approved . MINUTES/REPORTS RECEIVED AND FILED: Mayor Gardner announced the following minutes/reports had been received and were on file in the office of the City Clerk. Police Personnel Board 11/2/09 and 12/7/89 ; Housing Authority Board of Commissioners 11/20/89 ; Transportation Commission 11./21./89 ; Board of Adjustment 12/12/89 ; Traffic Safety Commission 12/14/89 ; Planning & Zoning Commission 12/14/89; Transportation Commission 12/19/89 Reports December Departmental Monthly Reports ANNOUNCEMENTS DY MAYOR: Mayor Gardner announced the monthly agenda, minutes, and reports of the Chamber of Commerce meeting were on file in her office for those interested. Mayor Gardner announced the appointment of three Councilmen to assist her in the reviewing of the "Smoking Ordinance" and establishing a policy for City buildings. Mayor Gardner requested Councilman Feldman, Councilman Haake, and Councilman Veile to assist her in establishing this policy. Fire Chief Robert Rennick informed the Council that the ISO had ;? completed their review and analysis of the City of Jefferson and that effective March 1, 1990, the City would obtain the rating of Town i Class IV. Chief Rennick stated that the City was within three and one-half points of being a Class III. Chief Rennick stated he was !" not sure of the exact figures, but that this would mean a cost '! savings of several dollars to the homeowners of Jefferson City on insurance. REGULAR COUNCIL MEETING, JANUARY 8, 1990 zj Councilman Voile asked what some of the factors were that led to this upgrade. Chief Rennick stated that the continuation of plans for the additional fire station and the hiring of additional personnel had had a factor. Chief Rennick stated that the continued training of #r ° current personnel and upgrading of the equipment had also played a 40. part in this upgrade. ' t; Mayor Gardner distributed the new listing of the members of the =r` various Board and Commissions and informed the Council that as new =?"� appointments were made, the appropriate pages would be updated and distributed. -:- City Administrator Dave Johnston reminded the Council of the need to trt set a date for the work session to discuss the ordinances dealing 73 with housing concerns. Councilman Scheulen recommended the Council meet next week to discuss these ordinances. After some discussion, the date was set for Tuesday, March 16, 1990 at 7 : 30 p.m. at City '? •Hall . Councilman Halsey stated that many individuals had requested information concerning the proposed ordinances. Councilman Halsey "`<t recommended staff work with the Council and wait to nee what is done in the work sessions to avoid confusing the public. Councilman Halsey stated that after the work sessions there would be a public: hearing to allow public input into any proposed changes. Garner concerning the proposed ban on bumper stickers. Councilman Mason stated that after extensive study, City Counselor Allen Garner has informed him that it could not be done to the degree that it would be effective. To ban all bumper stickers would result in a law suit that would cost the City an exorbitant amount of money. Councilman Mason moved that City Counselor Allen Garner be released � from the Council directive to draft an ordinance proposing a ban on all bumper stickers. Councilman Halsey seconded the motion and it = was approved. Mr. Garner requested the Council direct him as to their wishes and whether or not they wish to intervene in this case. After some discussion, Councilman Haake stated he felt it should be automatic that anytime a rate increase is requested, the Legal Department should be authorized to intervene. Councilman Owens Z ci seconded the motion and it was approved. Councilman Halsey stated t he had received a number of phone calls regarding cable television .1.nce the "black out" began in January. K; Councilman Halsey stated there has been a lot of incorrect information given concerning these "black outs" . Councilman Halsey :' stated the public needs to be aware that the City Council has no '' control over these actions. Councilman Halsey further stated that TCI is not the culprit in this case, but the local channels. Councilman Halsey stated he felt the local channels should be invited to attend the Council meeting on the 22nd of January to explain their reasoning to the Council and the public. Councilman Halsey moved to direct the City Counselor. Allen Garner to write a letter to the local channels inviting them to a Public Hearing in City Hall . Councilman Halsey further moved to have the City place an ad in the newspaper announcing the public hearing and encouraging the public to come and express their views. Councilman Gordon seconded the motion. Councilman Feldman stated the Cabte Quality Commission had met to discuss this Issue. Councilman 1'e' Itiman suited the Commission had voted to have Doug Nix, Manager of WI for Jefferson City, and Mr. holy Weber, Chairman of Cable Quality Commission to investigate possible remedies to this problem. Councilman Feldman further stat:od that Mr. John I)caa►uhanu Manager for KHCCl, stated that they had no intention of changing the policy at this time. councilman Feldman stated that this is something neither the Council or the Cable Quality Commission has any control over and that the general public needs to write their elected officials in Washington to express their displeasure over this legislation. After further discussion, the motion was approved. Councilman Gordon moved to direct the Mayor to write Senator Danforth and Senator Bond and the other elected officials and express the Council 's displeasure with this legislation and urge the citizens to also contact their representatives. Councilman Halsey seconded the motion and it was approved. Councilman Voile stated he would like to commend Mr. Bob Priddy for planting the seed for the need for a public access channel and further stated that he felt Jefferson City had one of the best in the state. , Councilman Halsey stated he would like to commend Mike Bates and the Street Department for their outstanding work during the last snow and extremely cold weather. �4; rte! 204 REGULAR COUNCIL MEETING, JANUARY 8, 1990 APPROVAL OF EXECUTIVE SESSION MINUTES: Councilman Haake moved approval of the Executive Session Minutes of the December 11, 1989, meeting. Councilman Woodman seconded the motion and it was approved. Councilman Halsey moved to have the City Clerk and the City Counselor present in Executive Session when the Council is discussing real estate, personnel and litigation. The City Clerk will be present to take minutes and the City Counselor will be present to offer legal advice. Councilman Mason seconded the motion. Councilman Scheulen stated he felt it was improper for the City Counselor to be present when the Council was doing routine personnel evaluations. Councilman Halsey stated that he felt that the Counselor was needed due to the fact that City could become involved in lawsuits and could be avoided with the City Counselor present to give legal advice. Councilman Scheulen stated he agreed with what Councilman Halsey wan saying but felt it would be inappropriate for the City Counselor to be present during routine salary discussions. Councilman Scheulen ntated that if the Council felt they needed an opinion from Mr. Garner, they could invite him into the meeting. After some discussion, a vote was taken on the motion. A voice vote proved inconclusive and the Mayor, requested a roll call vote be taken. The motion was approved by the following roll call vote: Aye: Davis, Feldman, Gordon, Halsey, Mason, and Voile. Nay: Haake, Owens, Scheulen and Woodman. # # Councilman Mason stated he would like to commend the City employees in the Police and Fire Departments who worked during Christmas Eve and Christmas Day, New Year's Eve and New Year's Day. Councilman Mason commended them for doing a fine job. Councilman Gordon moved the Council go into Executive Session to discuss Personnel as provided for in RSMo. 610.025 (3) . Councilman Haake seconded the motion and it was approved by the following roll call vote: Aye: Davis, Feldman, Gordon, Haake, Halsey, Mason, Owens, Scheulen; Veile and Woodman. Nay: None. virriorrar 205 REGULAR COUNCIL MEETING, JANUARY 8, 1990 ACTION TAKEN IN EXECUTIVE SESSION: Councilman Steve Veile moved approval of the City Administrator's 1f recommendation for a 3% meritorious increase for the Director of Planning and Code Enforcement Tom Benton. Councilman Mason seconded ! the motion and after some discussion as to whether this percentage was adequate enough to express the Council 's pleasure at the progress Mr. Benton has made during the year, the motion was approved by the '} I! following roll call vote: Aye: Feldman, Mason, Scheulen, Veile and Woodman. Nay: Gordon, Haake, Halsey and Owens. � Councilman Halsey moved to remove the restrictions placed on Fire ii h Chief Bob Rennick sixty days ago and give the full fledged support ;1 of the Council to the City Administrator to work with Chief Rennick �; to upgrade those areas he deems appropriate and to let all interested parties know of the Council's support of the Fire Chief.
